Dealing with Conduct and Performance issues
One of the most important aspects of the managers' role, is dealing with misconduct and poor performance. Both conduct and capability are potentially fair reasons for dismissal. (We look at this in more detail in our Termination of Employment ePublication.).
It is a legal requirement that all employees who are likely to be employed for one month or more have access to the employer’s disciplinary policy (and grievance policy). (this is cov-ered in greater detail in our Contracts of Employment ePublication)
The aim of a disciplinary and capability policy should be to bring about improvement and not primarily to punish. Imposing a disciplinary sanction should be viewed as a last result.
This quick guide looks at how to handle disciplinary and performance in the workplace fairly and legally compliant.
