TERMS & CONDITIONS

These Terms & Conditions (“Terms”) apply to the purchase, download, access, and use of digital fitness programs, guides, training materials, and related content provided by DALE PINCHE GANAS (“we,” “us,” or “our”). By purchasing, downloading, accessing, or using any DALE PINCHE GANAS program or digital product, you acknowledge that you have read, understood, and agreed to these Terms.

1. EDUCATIONAL PURPOSE

DALE PINCHE GANAS fitness programs and materials are provided for general educational and informational purposes only. Our programs are not intended to provide medical advice, diagnosis, treatment, physical therapy, rehabilitation, or individualized medical or healthcare services. Purchasing or using a DALE PINCHE GANAS program does not establish a physician-patient, healthcare-provider, physical-therapist, or other medical professional relationship.

2. HEALTH & MEDICAL RESPONSIBILITY

You are responsible for determining whether you are physically capable of safely participating in any exercise or activity contained within our programs.

Before beginning a new exercise program, you should consider consulting with a physician or other qualified healthcare professional, particularly if you have an existing medical condition, injury, physical limitation, are pregnant, are taking medication that may affect your ability to exercise safely, or otherwise have concerns regarding physical activity.

Never disregard professional medical advice because of information contained within a DALE PINCHE GANAS product. If you experience pain, dizziness, faintness, unusual shortness of breath, chest pain, or other concerning symptoms while exercising, stop exercising and seek appropriate medical attention.

3. ASSUMPTION OF RISK

Physical exercise and training involve inherent risks. These risks may include, but are not limited to, muscle soreness, strains, sprains, falls, equipment-related injuries, cardiovascular complications, serious bodily injury, and other health consequences. By voluntarily participating in exercises or activities contained within a DALE PINCHE GANAS program, you acknowledge and voluntarily assume the risks associated with physical exercise. You are responsible for exercising within your own abilities, using appropriate technique and equipment, selecting appropriate resistance and intensity, and modifying or discontinuing exercises when necessary.

4. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, DALE PINCHE GANAS and its owners, employees, contractors, representatives, affiliates, and agents shall not be liable for injuries, losses, damages, claims, costs, or expenses resulting from or related to your use or misuse of our programs, materials, recommendations, or information.

Nothing in these Terms is intended to waive or limit rights or liabilities that cannot legally be waived or limited under applicable law.

5. INDIVIDUAL RESULTS

Individual results vary based on numerous factors, including training history, consistency, nutrition, recovery, genetics, lifestyle, effort, and individual physical condition. DALE PINCHE GANAS does not guarantee any particular result, including weight loss, muscle gain, strength increases, improved endurance, athletic performance, body composition changes, or completion of any particular fitness standard. Testimonials, examples, photographs, or results shared by DALE PINCHE GANAS are not guarantees that you will achieve the same or similar results.

6. NO REFUNDS — DIGITAL PRODUCTS

ALL SALES OF DIGITAL PRODUCTS ARE FINAL.

Due to the immediate-access and downloadable nature of our digital products, refunds, returns, cancellations, or exchanges are not available once a purchase has been completed, except where otherwise required by applicable law. Please carefully review the product description and program information before completing your purchase. If you experience a technical issue that prevents you from accessing a product you purchased, please contact us so we can assist with restoring access or providing the purchased materials.

A technical access issue does not automatically entitle the purchaser to a refund.

7. PERSONAL-USE LICENSE

Your purchase provides you with a limited, non-exclusive, non-transferable license to use the purchased program for your own personal use.

Purchasing a program does not transfer ownership of the program or its intellectual property to you.

You may not:

Share your download or account access with another person.
Email, message, upload, or otherwise distribute copies of the program.
Reproduce or copy the program for distribution.
Resell or sublicense the program.
Upload the program to websites, social-media platforms, file-sharing services, groups, forums, or other public or private distribution channels.
Modify the program and sell or distribute it as your own.
Use the program or substantial portions of it to create a competing commercial product.

Each purchase is intended for one individual user only.

8. INTELLECTUAL PROPERTY

All DALE PINCHE GANAS programs, written materials, workout structures, graphics, photographs, branding, logos, designs, videos, and other original content are protected by applicable intellectual-property laws. Except for the limited personal-use license provided above, no content may be reproduced, distributed, republished, sold, licensed, or commercially exploited without prior written authorization from DALE PINCHE GANAS.

9. EQUIPMENT & EXERCISE ENVIRONMENT

You are responsible for ensuring that any equipment used during the program is appropriate, properly maintained, and used according to the manufacturer's instructions. You are also responsible for ensuring that you have sufficient space and a reasonably safe environment in which to exercise. DALE PINCHE GANAS is not responsible for injuries or property damage resulting from improperly used, defective, incorrectly assembled, or inadequately maintained equipment.

10. PROGRAM MODIFICATIONS

Exercises may need to be modified based on your individual abilities, experience, equipment availability, injuries, or physical limitations. DALE PINCHE GANAS does not guarantee that every exercise or training method contained within a program is appropriate for every individual.

11. THIRD-PARTY PRODUCTS & SERVICES

DALE PINCHE GANAS may occasionally reference, recommend, link to, or partner with third-party products, equipment, websites, platforms, or services. We are not responsible for the availability, safety, performance, policies, or practices of third-party products or services. Any sponsored, affiliate, or compensated relationships will be disclosed when required by applicable law.

12. AGE REQUIREMENT

Our fitness programs are intended for adults age 18 or older unless a particular product expressly states otherwise. Individuals under age 18 should not purchase or participate in a program without the involvement and permission of a parent or legal guardian and, when appropriate, guidance from a qualified professional.

13. MISUSE & TERMINATION OF ACCESS

We reserve the right to restrict or terminate access to our products when we reasonably determine that a purchaser has violated these Terms, including unauthorized sharing, reproduction, resale, or distribution of our materials. Termination for violation of these Terms does not entitle the purchaser to a refund.

14. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our products, business practices, or applicable requirements. The version presented at the time of purchase will apply to that purchase except where subsequent changes are required by applicable law.

15. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of Hawaii, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

16. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
