ENCOUNTERS TERMS AND CONDITIONS
These Terms and Conditions represent the contractual conditions between you, the Visitor or Customer, and Encounters, located Mgr. Lambrecht 92, 9700 OUDENAARDE BELGIUM, for the visit and use of the Encounters website www.encounters.be or the purchase of Encounters Product through Encounters website.
By visiting the Encounters website or placing an order, you accept these conditions. If you do not agree to these conditions please do not use this site.
We reserve the right to update or revise these conditions. Please check the conditions periodically for changes. Your continued Use of this site following the posting of any changes to the conditions constitutes acceptance of these changes.
A- Trademarks
Encounters, Encounters Engine, the Encounters logo and other trademarks appearing in the Encounters Website are the trademarks of Encounters in the United States and other countries. All the content of Encounters website including text, images, logos, page headers, button icons, and scripts are protected by copyright and may not be used without the prior written consent of Encounters.
B- Ownership of Site Content
All content on this site, including but not limited to text, images, logos, digital downloads, data files and software, as well as the compilation of all content on this site, is the property of Encounters located at Mgr. Lambrecht 92, OUDENAARDE and which you can contact at the email address info[at]Encounters.net.
C- Prices, Taxes, Payments, Orders
1. All prices are stated in Euro for customers located in Europe and in U.S. Dollars for customers located outside of Europe.
2. Taxes apply for customers based in the European Union. Prices displayed are including those taxes.
3. Payment can be made by credit card or PayPal and must be received by Encounters prior to acceptance of an Order.
4. After payment confirmation, the customer will receive via email the Serial Number(s) of the product(s) purchased through the Encounters Website. The Serial Number(s) can also be found on the My Products page (Encounters.net/my-products) and on the invoice which will be available here Encounters.net/order-history.
D- Software License
Software is subject to an additional license agreement, the End-User License Agreement (“EULA”). In case of any discrepancies between the EULA and this Agreement, the EULA takes precedence.
Encounters grants you the non-exclusive right to use each authorized copy of the Encounters Software. Encounters Software license are granted only to a single user. You may use this product on up to three separate computers or iLok Dongles, which shall be owned and used by you exclusively.
E- Upgrades and Bundle
Upgrades may be offered to you. Encounters reserves the right to decide if those offers are time-limited or not, and to stop them anytime.
Resale or ownership transfer of individual products obtained in a bundle, or those used to upgrade or cross-grade to other products are not allowed.
F- Data Protection
Encounters does not collect personally identifiable information except when you specifically provide this information. Upon collection, this information is used for system administration and record keeping. Encounters uses this information to fulfill your requests for certain products and services, as well as to contact you about products.
Some Encounters Software generate a Computer ID value during installation. This ID does not contain any specific information about you or the data on your computer.
In order to measure interest and use of content on our Website, Encounters reserves the right to perform statistical analyses of user behavior. No identification of any individual will occur as a result of these analyses.
The Encounters Website contains links to other sites on the Web. Encounters has no control over these external sites and is not responsible for the privacy practices or content of these sites.
G- Disclaimer of Warranties and Limitation of Liability
All materials available through the Encounters Website are provided “as is” and “as available” for your use. Encounters makes no warranties of any kind, express or implied, for the content of this site including information, materials and products, that the content of this site is accurate, reliable, or correct, or that the content is free of viruses or other harmful components. You expressly agree that your use of this site is at your sole risk.
Under no circumstances shall Encounters or its licensors be liable for direct or indirect, punitive or incidental damages that result from the use of this website. This limitation applies even when Encounters has been advised of the possibility of such damage. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some of the above disclaimers or limitations may not apply to you.
Encounters is in no way liable for any claims arising from your use of this website. You agree to indemnify Encounters for all claims relating to your downloading, use, or receipt of content through the Encounters website.
H- Disputes
These Terms and Conditions shall be governed by and construed in accordance with the laws of Belgium. You expressly agree that exclusive jurisdiction for any claim relating to these Terms and Conditions or use of this website shall be filed only in Belgium, and you further submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim.
I- Returns
Encounters Media DOES NOT ALLOW RETURNS of orders, since you already downloaded all the material. There are plenty of demo's and video's available per product and you have the responsability as a customer to check this out before buying.
