Terms Of Service
This is the full and extensive list of KCTheKhaotic's (me) T.O.S., though not exhuastive, most basis of usage of any intellectual property created and sold by KCTheKhaotic falls under the following rules.
⌬ AI usage with any products by me is NOT ALLOWED under any circumstances. Do not feed the machines my art, my works, or anything under my (KCTheKhaotic)'s brand.
⌬ All Avatars are marked for personal use only. Most assets/textures have an option for personal or commercial use. Please use the licenses accordingly.
⌬ Characters, background lore, and the like are sole creations of mine, you only own the license to use the avatar/asset that stems from it as they are typically original ideas or inspired works.
⌬ Your information (email, discord username, and VRchat username/link) must be filled out correctly by the time of purchase. If it is found to be incorrect, your license will be revoked until you make a ticket in the server to correct it. This goes for all products in the store, even if it is free. If you do not have a VRChat account for some reason, reach out to me via the ticket system in our discord. If you do not own a discord, youre likely under 13 and too young to be online right now and should leave this store alone. Otherwise (if youre over 13 at least), write a note on where to contact you in the discord section.
⌬ Paid items are not allowed to be used in works for MMD. Free assets however are able to be used as long as credit is given. Avatars do not fall under this as it would be based off of many creators TOS's which doesn't allow for MMD usage at all. And for the love of creativity and sharing, dont gatekeep, credits can include the store link.
⌬ Buyer is responsible to check the TOS of listed assets/textures used on a completed model before attempting their own personal conversion. I, KCTheKhaotic, hold no responsibility on conversions and buyer is responsible for following all TOS.
⌬ Commissions using my work by any means must have the commissioner and customer both own the correct licenses to them. For avatars both must own their own license, for assets/textures/etc., the commissioner must own the commercial license to continue. Both can be achieved by the gift function on this website.
⌬ NONE OF MY WORKS ARE ALLOWED TO BE USED FOR NFTS, ANY NFT ARTWORK, NFT PRODUCTS, AND ANY OTHER AFFILIATIONS WITH IT. DO NOT ASK ME ABOUT IT EVER.
⌬ Leaking, Ripping, Price Splitting, even as an edited version is not allowed under any circumstance. If you are found to be doing this, you will be effectively banned from my store and blacklisted.
⌬ Editing my avi's are OK, prefferably the head and body must stay in tact as well as the basis of the avi itself for this to be considered an edit. Unless you're skilled enough to replicate everything for a headswap for some reason, in that case Id prefer you ask first. If there is a headswap option already on the base avi, it is not necessary to make one and doing so anyway will thus leave the realm of editing. Failiure to follow this outline for edits will mark your removal of access to that avatar in particular.
⌬ Codes and coupons found in the server are to be kept in the server for members only, if you are caught using one of these codes outside these bounds you have a high risk of store removal, banning, and a blacklist between you and whoever else was also given said code. This also goes for codes given out due to winning a giveaway for one of my works.
⌬ Do not use my works for asset mining, there is a list of what I’ve used on the description for you to find on your own and purchase separately.
⌬ Do not claim any avatar, asset, texture, and so on as your own. I've put energy, care, effort, and love into every single thing I release and would love to be recognized for it. Art theft is not a cool thing to do and never will be.
⌬ Assets cannot be resold by themselves as is, even as heavy edits. The buyer must own the original asset before using any heavy edit of the same one. It must be on a completed avatar if it is being sold or on something that can be distributed.
⌬ YOU MUST CREDIT ME (KCTheKhaotic) WITH SHOP LINK PROVIDED + MY DISCORD (kcthekhaotic), EVEN IF IT IS A SERVER ONLY, IN THAT CASE MARK IT AS SUCH.
⌬ Some tos's in assets and/or avis differ from one another and for this list as special circumstances and whatnot, specifically under the "Allowed Use" section of a product. It is up to you to read them and agree to them thoroughly, as this TOS and others are subject to change. There will be an announcement on my discord if such changes are made.
⌬ If you are 18- and find yourself here somehow attempting to purchase an 18+ avi or asset, your ability to have it will be revoked until your 18th birthday has passed. Refunds will not be issued out however. Only exceptions made to this rule will be if the -18 customer purchases a SFW variant of the avatar/item. iF YOU HAD MADE A MISTAKE AND ACCIDENTALLY BOUGHT THE WRONG VERSION, MAKE A TICKET IN DISCORD OR CONTACT ME DIRECTLY.
⌬ Asset mining off of my avatars is NOT ALLOWED. There's always an extensive list of credits of assets used and where to get them yourself, some being made by me in which may or may not be sold later on a case by case basis.
⌬ Streaming, pictures, tiktoks, videomaking, VTubing, and so on are OK as long as credit is located somewhere in the captions, bio, pinned comment, or description with a link provided if able. If someone asks about it during please state that the work was made by me and redirect them to my store on where to officially find it. This goes for anything in my store and any commissions (commercial and private) I have done. @'ing me in these spaces while giving credit is OK. (KCTheKhaotic on all socials).
⌬ Making merchandise off of my own works must be discussed with me beforehand with a signed agreement before releasing such, some items or avatars follow other creators TOS that may not permit such usage and must be followed to avoid multiple violations.
⌬ Redistributing any works (assets, avatars, textures) as is or as edits under a paywall or for public usage is NOT ALLOWED. I more than likely will release free items, cheaper alternatives, and public versions of my items on my own time, and I rather not have someone else profit off of my work. This also goes for any known ripping or redistribution sites that are known for this kind of violation (VRM/VRModels, RipperStore, Leaker/Ripper servers, dropbox releases only, etc.)
⌬ ALL SALES ARE FINAL, as every product here is made and sold digitally, the very nature of it would be too difficult to return without running the risk of freezing banks and such. This does include if you have found yourself banned from my store.
⌬ Defamation of any kind to me (KCTheKhaotic) or my brand will NOT BE TOLERATED. If you are found to be spreading rumors, blatantly telling lies about me and my works, comitting slander, libel, forging of proof or "reciepts", releasing false accusations, or any of the like, you will be banned from my store, my works, discord, blacklisted, DMCA'd, and a Cease and Desist will be issued.
⌬ Doxxing me, my staff, anyone in my discord, and so on will NOT BE TOLERATED
⌬ If you find yourself banned from my discord and blacklisted but still have access to my works, no you don't. You are no longer allowed to use my works in any commercial setting and cannot use them for any any photo/video/streaming content. My assets will become personal use only for you specifically unless stated otherwise. If you still have access to my store, know that these are the risks you take when purchasing from me still.
Failure to follow any of the listed terms above shall render the service revoked, null, and voided, regardless of the cost and labor. If you are found to be violating the TOS, store removal, discord banning, and a blacklist can and will be made against you. Some severe circumstances may land a DMCA if violations continue. By purchasing from my store you have read and agreed to my TOS in its entirety.
