PLEASE READ THESE TERMS CAREFULLY BEFORE PURCHASING, ACCESSING, OR USING ANY COURSE, LESSON, VIDEO, PDF, GUIDE, DOWNLOADABLE FILE, SUPPLIER LIST, OR OTHER DIGITAL CONTENT PROVIDED BY LA Candle Art School (collectively, the “Course”).
BY PURCHASING, ACCESSING, DOWNLOADING, OR USING THE COURSE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT PURCHASE, ACCESS, OR USE THE COURSE.
1. EDUCATIONAL PURPOSE ONLY
The Course is provided strictly for educational and informational purposes only. All content, instructions, suggestions, examples, demonstrations, and recommendations are based on personal experience, artistic practice, and general knowledge. Nothing in the Course constitutes professional, technical, engineering, fire-safety, legal, medical, chemical, regulatory, or business advice. No guarantee is given that any particular technique, formula, product, or method will be suitable for your specific circumstances.
2. ELIGIBILITY AND PERSONAL RESPONSIBILITY
By purchasing or using the Course, you represent and warrant that you are legally permitted to do so in your jurisdiction and that you are solely responsible for ensuring your own compliance with all applicable laws, regulations, safety rules, labeling rules, consumer laws, and workplace requirements that may apply to your use of candle-making materials, tools, or finished products. You are solely responsible for your decisions, actions, purchases, testing, production methods, and outcomes.
3. ASSUMPTION OF RISK
You understand and agree that candle making and related decorative work involve inherent risks, including but not limited to burns, cuts, allergic reactions, respiratory irritation, smoke exposure, overheating, fire hazards, melting accidents, property damage, staining, spills, electrical hazards, and damage caused by improper handling, storage, testing, or burning of candles and materials. You voluntarily assume all risks, known and unknown, associated with the purchase, access, or use of the Course and any techniques, tools, or materials mentioned in it.
4. SAFETY OBLIGATION
You agree that you are solely responsible for safe practice at all times. Without limitation, you agree to:
- never leave melting wax unattended;
- use only appropriate heat-safe containers, tools, and equipment;
- supervise all heated materials at all times;
- keep hot wax, open flame, and heated tools away from children, pets, flammable surfaces, fabrics, paper, solvents, and other combustible materials;
- work in a properly ventilated area;
- test all candles and materials responsibly before use, gifting, sale, or display;
- follow all manufacturer instructions for waxes, dyes, fragrances, wicks, molds, additives, vessels, adhesives, and equipment;
- discontinue use of any material or method that appears unsafe or unsuitable.
Failure to follow proper precautions is entirely at your own risk.
5. NO WARRANTIES
THE COURSE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. LA Candle Art School DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, COMPATIBILITY, OR THAT THE COURSE WILL MEET YOUR EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT.
6. NO GUARANTEE OF RESULTS
Results will vary significantly from person to person and may depend on many factors outside the author’s control, including but not limited to wax type, additives, dyes, fragrances, wick series, room temperature, humidity, heating method, pouring temperature, mold condition, equipment quality, supplier variations, skill level, testing method, curing time, and substitutions. You expressly acknowledge that no specific visual, technical, commercial, or financial result is promised or guaranteed.
7. THIRD-PARTY MATERIALS, TOOLS, BRANDS, AND SUPPLIERS DISCLAIMER
Any references in the Course to suppliers, shops, websites, marketplaces, brands, products, materials, tools, links, or purchasing sources are provided strictly for informational, educational, and convenience purposes only.
LA Candle Art School and its author:
- do not manufacture, distribute, test, certify, inspect, or control third-party products;
- do not guarantee the quality, composition, purity, safety, durability, legality, availability, performance, consistency, shipping reliability, or suitability of any third-party product or supplier;
- do not verify supplier claims, listings, descriptions, compliance statements, safety data, or certifications;
- are not responsible for changes in formula, stock, quality, sourcing, packaging, pricing, labeling, restrictions, delays, defects, or substitutions made by third parties.
You acknowledge and agree that:
- different suppliers may sell similar-looking materials with different actual properties;
- product quality may vary between countries, batches, factories, and sellers;
- substitutions, even minor ones, may materially change the result;
- a supplier recommended in the Course may not be suitable for your location, local rules, experience level, or project.
LA Candle Art School shall not be liable for:
- poor or failed results caused in whole or in part by materials, tools, vessels, molds, fragrances, dyes, wicks, additives, or equipment;
- defective, unsafe, counterfeit, mislabeled, delayed, unavailable, or inconsistent products purchased from third parties;
- allergic reactions, skin irritation, smoke issues, scent issues, burning issues, or any other adverse effects related to third-party materials;
- customs issues, taxes, duties, import restrictions, shipping losses, or financial losses connected to third-party purchases;
- any claim that a recommended supplier, product, or tool did not perform as expected.
All purchasing decisions are made solely at your own discretion and risk. You are solely responsible for selecting, evaluating, and testing all materials and suppliers before use.
8. TESTING RESPONSIBILITY
You are solely responsible for conducting your own testing before using, gifting, displaying, marketing, or selling any candle or related product. This includes, where relevant, testing for wick performance, burn behavior, stability, heat resistance, fragrance load, color behavior, compatibility, and safe use in your own environment. Any mention of a wick, wax, additive, dye, fragrance, or process in the Course is not a guarantee that it will work safely or effectively in your specific setup.
9. NO PROFESSIONAL, LEGAL, REGULATORY, OR SAFETY CERTIFICATION
The Course does not provide professional certification, safety certification, legal compliance certification, lab testing, insurance advice, product liability advice, import/export advice, or regulatory approval. It is your responsibility to determine what laws, warnings, labels, burn instructions, insurance requirements, and consumer-product rules apply in your country, state, region, or market.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LA Candle Art School, its owner, author, affiliates, contractors, licensors, and representatives SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES OR LOSSES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:
- personal injury, burns, accidents, or health-related issues;
- fire, smoke, soot, vessel breakage, overheating, explosions, spills, or property damage;
- damage to tools, molds, surfaces, furniture, equipment, inventory, or premises;
- lost profits, lost sales, lost business opportunities, chargebacks, disputes, reputational harm, or loss of data;
- dissatisfaction with course content, teaching style, structure, or level;
- failed artistic or technical outcomes;
- damages arising from third-party products, supplier links, or recommendations;
- any claim by your own customers, clients, students, or third parties.
This limitation applies whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if advised of the possibility of such damages.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless LA Candle Art School, its owner, author, affiliates, contractors, licensors, and representatives from and against any and all claims, demands, disputes, liabilities, damages, judgments, settlements, penalties, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your purchase, access, or use of the Course;
- your violation of these Terms;
- your misuse of materials, tools, or instructions;
- your sale, gifting, or distribution of candles or related products;
- your reliance on any supplier or third-party product;
- any claim brought by your own customer, buyer, student, family member, employee, contractor, or other third party.
12. DIGITAL PRODUCT / NO REFUND POLICY
The Course is a digital product. Due to the immediate nature of digital access, all sales are final to the maximum extent permitted by applicable law. No refunds, returns, exchanges, cancellations, chargeback claims based on dissatisfaction, or partial refunds will be provided once access has been granted, except where mandatory consumer law in your jurisdiction requires otherwise. By purchasing, you acknowledge that you are receiving immediate access to digital content and that you waive any cancellation right to the extent legally permitted.
13. ACCESS LICENSE; PERSONAL USE ONLY
Your purchase grants you a limited, non-exclusive, non-transferable, revocable license for your personal, individual, non-commercial use only, unless expressly stated otherwise in writing. The Course may not be shared, sublicensed, transferred, gifted, assigned, copied, mirrored, republished, uploaded, distributed, or made available to any other person.
14. STRICT INTELLECTUAL PROPERTY PROTECTION
All Course content, including but not limited to videos, lesson structure, text, PDFs, worksheets, scripts, graphics, branding, titles, voiceovers, translations, images, screenshots, downloadable files, and overall educational format, is protected by copyright, trademark, unfair competition, and other intellectual property laws.
Without prior written permission, you may NOT:
- copy, record, download beyond permitted access, or reproduce any part of the Course;
- forward files or grant access to another person;
- upload lessons or excerpts to websites, forums, clouds, drives, messaging apps, or social media;
- translate, adapt, repurpose, edit, or create derivative works based on the Course;
- use the Course or any substantial part of it to teach others, train clients, create your own class, workshop, digital product, PDF, tutorial, mentorship, membership, or paid/free course;
- use screenshots, clips, slides, files, or lesson fragments for public or commercial purposes;
- remove watermarks, notices, logos, or attribution.
15. SOCIAL MEDIA, PUBLICATION, AND DEMONSTRATION RESTRICTIONS
You may not publicly post, publish, stream, share, or demonstrate Course materials, lesson fragments, screenshots, recordings, or downloadable files in any form without prior written consent. Limited sharing of your own finished work is allowed, but not the underlying lessons, files, teaching structure, or protected materials. Where credit is requested or required, failure to provide it does not create permission to use protected content.
16. COMMERCIAL USE RESTRICTIONS
Unless you have separate written permission, you may not use the Course to:
- teach in person or online;
- train assistants, employees, students, or clients;
- create content substantially based on the Course;
- incorporate Course materials into workshops, communities, mentorships, academies, or paid services;
- claim the Course methods, structure, or materials as your own.
17. BREACH; REMOVAL OF ACCESS
Any actual or suspected breach of these Terms may result in immediate suspension or permanent termination of access, without notice and without refund. LA Candle Art School reserves the right to investigate misuse, preserve evidence, issue takedown demands, notify platforms or payment providers, and pursue legal remedies.
18. CHARGEBACKS AND PAYMENT DISPUTES
If you initiate a chargeback, payment dispute, or reversal in bad faith, or after receiving access to the Course, LA Candle Art School reserves the right to contest the dispute, provide evidence of access and delivery, revoke your access, and pursue recovery of fees, damages, and enforcement costs to the extent permitted by law.
19. MODIFICATIONS TO THE COURSE AND TERMS
LA Candle Art School may update, improve, modify, replace, reorganize, remove, or expand any part of the Course or these Terms at any time. Continued access to or use of the Course after any update constitutes acceptance of the updated Terms.
20. AVAILABILITY
While reasonable efforts may be made to keep the Course available, uninterrupted access is not guaranteed. LA Candle Art School shall not be liable for outages, platform issues, payment-provider interruptions, file-hosting issues, account limitations, cyber incidents, or other technical problems beyond reasonable control.
21. FORCE MAJEURE
LA Candle Art School shall not be liable for delay, interruption, unavailability, or failure to perform caused by events beyond reasonable control, including but not limited to technical failures, platform outages, internet disruptions, third-party service failures, illness, accident, natural events, war, governmental action, labor dispute, or force majeure events.
22. SEVERABILITY
If any provision of these Terms is found unenforceable or invalid, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
23. NO WAIVER
Failure to enforce any provision of these Terms shall not constitute a waiver of any right or provision.
24. GOVERNING PRINCIPLES
These Terms shall be interpreted under the general principles applicable to international digital commerce, subject to any mandatory consumer-protection rules or other non-waivable laws that apply in the purchaser’s jurisdiction.
25. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and LA Candle Art School regarding the Course and supersede all prior discussions, messages, descriptions, or understandings relating to the Course.
26. FULL ACKNOWLEDGEMENT
BY PURCHASING, ACCESSING, OR USING THE COURSE, YOU ACKNOWLEDGE AND AGREE THAT:
- YOU USE THE COURSE ENTIRELY AT YOUR OWN RISK;
- YOU ARE SOLELY RESPONSIBLE FOR SAFETY, TESTING, MATERIAL CHOICE, SUPPLIER CHOICE, LEGAL COMPLIANCE, AND RESULTS;
- LA Candle Art School IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR PERFORMANCE OF THIRD-PARTY PRODUCTS OR SUPPLIERS;
- NO REFUND IS PROVIDED AFTER DIGITAL ACCESS HAS BEEN GRANTED, EXCEPT WHERE REQUIRED BY LAW;
- ANY UNAUTHORIZED COPYING, SHARING, TEACHING, OR COMMERCIAL USE IS STRICTLY PROHIBITED.
If you do not agree to all of the above, do not purchase, access, download, or use the Course.
