TERMS OF SERVICE

Please review ALL Terms of Service and product-specific rules before completing your purchase. By buying, downloading, or using this product, you acknowledge that you have read, understood, and agreed to these terms:

License

• All products are licensed, not sold.
• Licenses are valid only for purchases made through my official storefront/discord directly through me.
• Each person who has access to the avatar or assets must own their own valid license. Sharing files, access, or copies with users who have not purchased the product is strictly prohibited.

Asset Specific Rules

• My assets may be used on personal, commercial, free, paid, Nitro, public and commission VRChat avatars unless otherwise stated on the product page itself.
• My assets may only be distributed as part of a completed avatar and must include proper credit to Lumey, along with a direct link to the asset used. Selling, sharing, redistributing, or repackaging my assets separately, whether in their original or modified form is strictly prohibited.
• You may create custom textures, edits, or addons based on my assets, but you may not include or distribute any of my original files. This includes, but is not limited to, my original meshes, textures, materials, or other source files.
• If you would like to port any of my assets to another platform outside of their intended use (VRChat), please contact me for permission before doing so (Make a ticket in my server). Unauthorized ports or conversions are not allowed.

Avatar Specific Rules

• Personal use only! You may not use this avatar to generate income or profit in any way, including but not limited to selling edits, using it for paid content, commissions, branding, or monetized services.
• Private Upload Only! This avatar may only be uploaded as a private avatar. Public uploads, public avatar sharing, or making the avatar accessible to others is strictly prohibited.
• No asset mining! Do not extract, reuse, or redistribute any assets, parts, meshes, textures, materials, or files from this avatar. If you want to use an asset, please purchase it directly from the original creator. I always link and credit where you can get the asset in page description. I will sell you my assets even if it not on store, please just make a ticket in my server.
• Editing restrictions! You may edit the avatar for personal use, but you may not remove, hide, or alter my logos, branding, or any meshes containing my name. Exceptions may be made for texture-only changes, such as edited collars or similar minor adjustments. Feel free ask if your unsure!
• Couple Model Policy! If you purchase a couple model set, the paired counterpart may only be shared with the specific person included under the license. Access may not be transferred, gifted, sold, or shared with anyone outside of the licensed users. Any additional user must purchase their own copy (Even if you break up).
• When uploading the avatar, inside the description please use the format “[Avatar Name] by Lumey” with an link to my store in the description (Optional).

General Rules/Info

• No Refunds or chargebacks! All sales are final. Due to the nature of digital products, refunds are not available. Please review your purchase carefully before completing your order.
• Technical Issues! I am not responsible for upload problems, Unity issues, blender issues or compatibility errors that cannot be resolved by myself or others. Upload assistance and paid upload requests available separately through my Discord.
• NSFW Purchase Requirement: NSFW products are strictly restricted to users who are 18 years of age or older. By purchasing an NSFW product, you confirm that you meet this age requirement. If a minor is found purchasing, accessing, or using NSFW content, they will be immediately banned and blacklisted from my store and community spaces. I will let other creators know to do the same.
• Credit Required! If someone asks about the origin of an avatar or asset, please credit Lumey as the creator. Do not misrepresent or claim the avatar as being made by another person. If my avatar is used in videos, streams, social media posts, or platforms such as TikTok, please credit Lumey as the creator and include the avatars name.
• No AI Usage! My work may not be used for AI training, machine learning datasets, AI-generated content, AI models, or any form of AI-assisted reproduction, modification, or generation.
• No Resale or Profit! You may not sell, transfer, trade, or otherwise profit from this avatar, its uploads, or any included assets. All models and assets are licensed for personal use only and may not be used as paid products, services, commissions, or redistributed content.
• Upload Requirements! You must have access to a PC capable of uploading avatars to VRChat. Upload assistance is limited to the provided instructions, and an optional upload service may be available for $5 per upload in my server. You may not send, share, or provide the avatar files to another person for the purpose of uploading the model on your behalf. Each user must upload the avatar themselves or use an approved (by me) upload service.
• Couple Model Discount Policy: If you purchase one half of a couple model set and later decide to purchase the matching counterpart, you may be eligible for a discount equivalent to the original bundle pricing. Please open a ticket or contact me through my server to receive the available discount for the remaining model.

File Sharing & Redistribution

• Do not upload, redistribute, resell, trade, leak, gift, or share the original or edited files in any form.
• You may not extract assets from a finished avatar and distribute/use them separately.
• Every person who has access to the files must own their OWN valid license. No price splitting.

License Enforcement

• Failure to comply with these Terms of Service may result in immediate license revocation and loss of access to my products. Users involved in malicious activity, including leaks, fraud, unauthorized distribution, or misuse of my assets, may be permanently blacklisted. Leaks may also result in DMCA take down requests and further legal action where applicable. Information such as names and email addresses may be shared creators solely for fraud prevention, asset protection, and creator security purposes.
