Commissioned Avatars
- NO REFUNDS WHATSOEVER! As these are digital products, once the content has been downloaded, you waive your right to a refund.
- If you change your mind after the first payment, it is still non-refundable and your avatar may still be made with some changes and put on my shop.
- If chargebacks are done, you forfeit all rights on the commission and I will put your avatar on my shop.
- You may stream with the model but you must credit me in your bio if you stream consistently with it
- I do not accept blame if you don't know how to upload the model, just ask me
- I will not recreate other's work, but will see others creations and take inspiration from it.
- You may NOT share the model with anyone, it is yours only
- All commissions have a revision period that allows you to find issues that I will fix for you, these should be expected as I cannot wear your avatar for several hours to test every possible position.
- I am not responsible for lost files. You are expected to back up your own file. Any avatars sent over Google Drive or downloaded from Payhip itself may be deleted at any point as I do not keep your avatar.
Bought Avatars/Assets
- NO REFUNDS WHATSOEVER! As these are digital products, once the content has been downloaded, you waive your right to a refund.
- Under no circumstances may you share, redistribute, leak, or upload my models/meshes/products, nor upload them to someone else's account. If you wish to upload for another person, please contact me first to confirm that they have also purchased the model.
- Models must be uploaded and kept private on your account at all times. Uploading my models for public avatar worlds is strictly prohibited.
- You are not permitted to use my models/products for any profit-making activities. This includes, but is not limited to: reselling (whether edited or unedited), use in commissions, videos, artwork, or 3D printed products.
- You are not allowed to use any parts or meshes from my models for any purpose, including edited assets. All elements are credited, so please purchase or download them from the original creators. This includes textures and icons.
- If you're purchasing a product as a gift for someone else, provide their email, and their information at the time of purchase. Directly buying and sending the product to them is not allowed. If the recipient cannot upload the model themselves, inform me, and I will either upload it for them or give you permission to do so.
- Do not claim any of my models/products as your own.
- Do not remove my name tags or watermarks.
- My models/meshes/products, etc., are only to be used in social VR games. The only exception is if you want to use them for V-Tubing, in which case you must properly credit me on your streams/videos after informing me. (Or commission me for a personal V-Tuber to have a personal style)
- For streaming or YouTube, Instagram and TikTok (and similar platforms), if you use my models, I would really appreciate it if you could credit me (https://nyxthrawrr.carrd.co/). If it becomes your main avatar/persona, crediting is mandatory.
- You may not use my models/products for any content that is harmful, threatening, offensive, or abusive.
- I am not responsible for any updates that might cause my models to stop working. I may or may not update models if they break due to patches, including script and shader updates. ... If you like an avatar that has broken because of updates, message me and I might be able to fix it for you.
- My models/meshes/character designs may not be used for any NFT-related sales, artwork, or similar purposes.
- Under no circumstances are you allowed to copy or heavily reference my character designs in any way, shape, or form.
