These Terms & Conditions apply to purchases of PestScare and use of the PestScare website and digital product.

1. Purchases

The current price is shown before checkout. Payment is taken securely through our payment providers. Once payment is completed, access to the digital product is provided electronically.

2. Digital delivery

PestScare is delivered as a digital audio file. By choosing immediate delivery, you agree that supply may begin straight away. Once delivery begins, your statutory cancellation right for digital content may end, as explained in our Digital Download Terms.

3. Personal-use licence

Your purchase gives you a personal, non-transferable right to use the PestScare audio file on your own devices. You may not resell, redistribute, publicly upload, commercially reproduce, or otherwise share the file without permission.

4. Results, responsible use and liability

PestScare is intended to assist with the deterrence of nuisance birds. We do not guarantee that it will be effective in every situation or achieve complete or permanent removal of birds. Results may vary depending on species, location, surrounding conditions, playback equipment, timing, frequency of use and other factors outside our control.

You are responsible for deciding whether PestScare is suitable for your location and for using it safely, responsibly and in accordance with applicable laws, local noise requirements and consideration for neighbours, wildlife and other third parties.

We are not responsible for loss, damage, nuisance, claims or other consequences arising solely from the way the product is used, misused or deployed by the customer, or because it does not achieve a particular deterrent result, provided PestScare has been supplied as described and is functioning correctly.

The customer is responsible for any consequences arising from their own use of PestScare, including its volume, timing, positioning, playback equipment and use in relation to third parties.

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

5. Download access

Your purchase includes up to 3 download attempts. If you experience a genuine technical problem with your download, please contact us and we will help where reasonably possible.

6. Faulty or misdescribed digital content

Nothing in these terms removes or limits your statutory rights. If digital content is faulty, not as described, or otherwise fails to meet applicable consumer-law standards, you may have legal remedies.

7. Intellectual property

The PestScare name, branding, website content and digital audio remain protected by applicable intellectual-property rights. Purchase of the product does not transfer ownership of those rights.

8. Website availability

We aim to keep the website, checkout and download service available, but temporary interruptions may occur due to maintenance, technical faults or services operated by third parties.

9. Changes

These terms may be updated from time to time. The version in force at the time of your purchase will apply to that purchase.
