Texas HOA Governance & Lien Kit — §§ 209.0051 · 209.009 · 209.014 Letters (PDF)
Fill-in Texas HOA letters: fines-only lien (they may not foreclose it), open-meeting vote, annual-meeting demand, 15-day recount. Property Code Chapter 209. Instant PDF. Not legal advice. Not a foreclosure defense. Not for condos.
If the lien is only fines, they may not foreclose it.
Texas Property Code § 209.009 says a property owners’ association may not foreclose its assessment lien if the debt securing that lien consists solely of fines, or of attorney’s fees incurred solely on those fines. § 209.0051 says fines, enforcement, and a particular owner’s suspension are voted in a noticed open meeting — not only in executive session.
§ 209.014 says the board shall call an annual meeting of the members, even if the bylaws say otherwise.
This kit is those letters, filled-in Fort Worth samples, and the certified-mail send list.
If you already have a notice of sale, a citation, a lawsuit, or a date from a trustee, stop. Call a Texas HOA attorney. D2 and D3 do not stop a sale.
What is inside:
THE LIEN
• D1 Fines-only / fees-only lien — ask them to confirm they will not foreclose, release a recorded fine-only affidavit, and itemize if they claim assessments
• D2 Pre-foreclosure information cover — itemization, plan, hearing, 45-day collector rule, judicial vs not. This is not an answer, a TRO, or a defense packet. Send with C1 / C3 / B1 as needed
• D3 Redemption inquiry — AFTER a sale. Asks for the § 209.010 mailing date (that starts the ~180-day window), purchaser, and itemized § 209.011 figures. It is not a tender and does not redeem the property
THE BOARD
• D4 Open meeting / vote in the open — fine, enforcement, or suspension decided only behind closed doors; demand the motion, or vacate and set a noticed meeting
• D5 Demand an annual meeting — D5-A certified to the registered agent AND the management-certificate address; D5-B a copy to EVERY owner (the statute requires that); D5-C election-committee sketch only if 30 days pass with no meeting — do not record D5-C as a joke
• D6 Recount of votes — within 15 days of the meeting or the announcement of results. They invoice you within 20 days; you pay within 30 or the demand is withdrawn
• D7 Owner petition cover + signature page — when YOUR bylaws require a % of lots to call a special meeting. This is not the § 209.014 demand (that is D5)
Also: how to send (management certificate; D5’s two certified envelopes plus copies to members; D6 verified mail or in person), and a fictional Fort Worth filled sample on every letter.
Typical first envelope: D1 if the lien is fines. D4 if they never voted in the open. D5–D7 are board-process letters. D2 and D3 are information only.
Not included: a lawyer, a foreclosure defense, a guarantee they will release the lien or call a meeting, or Chapter 82 condo procedure. D1 does not wipe lawful assessments. If the ledger mixes assessments and fines, itemize first (Collections kit, C1), then use D1 on the fine-only piece. If a foreclosure is already on file, this kit is not that case.
