z3vios Seamless Patterns Universal Licence Agreement

Licensor: M TEKA T/A MXZTAR a.k.a "z3vios" (operated by MXZT☆R, Wellington, New Zealand)

Licensee: The purchaser named in the Payhip transaction ("You")

By downloading, accessing, or using any seamless pattern design files ("Assets") purchased from payhip.com/z3vios, You agree to be bound by these Universal User Guidelines and the license terms below. If You do not agree, do not use the Assets and request a refund within Payhip's policy window.

1. Grant of License

z3vios grants You a perpetual, worldwide, royalty-free, exclusive commercial license to use the purchased Assets for any lawful purpose, subject to these terms. This includes:

Full commercial production and sale of physical or digital end products incorporating the Assets (e.g., textiles, fabrics, wallpaper, flooring, vinyl coverings, apparel, home decor, merchandise, print-on-demand (POD) items via platforms like Gelato/Fourthwall, branded goods).

Unlimited units, reproductions, modifications (e.g., color changes, scaling, combinations with other elements), and derivative works, as long as the end product transforms or incorporates the Assets in a new context.

Use in manufacturing, printing (digital, screen, sublimation, etc.), marketing, packaging, and worldwide distribution/sale.

This is an exclusive license: The Assets are sold once only and removed from the store post-purchase. No other party will receive rights to the exact same design from z3vios.

2. What You Own vs. What You Don't

You own: Full rights to use, modify, and commercially exploit the Assets as described above, royalty-free (no ongoing payments to z3vios).

You do NOT own: Copyright or intellectual property in the original Assets remains with Michael Teka. You receive a license only—not title or ownership transfer.

You may not claim the original design as your own creation (e.g., in portfolios, credit as "designed by You" without modification context).

3. Restrictions & Prohibited Uses

To preserve exclusivity and protect z3vios:

Do not resell, redistribute, share, sublicense, or make the Assets (original files, grids, or unmodified versions) available for download, as stock, templates, or standalone digital products.

Do not upload the Assets to stock libraries, marketplaces, or POD platforms as sellable digital files (e.g., no listing the pattern itself on Creative Market/Etsy as a download).

Do not use the Assets in a way that competes directly with z3vios (e.g., offering identical or near-identical seamless patterns for sale).

No reverse-engineering to create competing assets.

If modified substantially into a new unique design, limited resale of the derivative as part of end products is allowed, but not as a reusable digital pattern file.

4. Term & Termination

The license is perpetual unless terminated for breach (e.g., violation of restrictions). Upon breach, z3vios may revoke rights (with notice), and You must cease use/destroy copies.

5. Warranties & Liability

Assets provided "as is." z3vios warrants they are original creations but disclaims all other warranties (fitness for purpose, non-infringement). Liability limited to purchase price. No consequential damages.

6. Governing Law

New Zealand law applies. Disputes resolved in Wellington courts, New Zealand.
