Power of Attorney for Personal Care — Ontario
Health Care & Personal Care Decisions — Self-Completion Kit | $200.00 + HST | Instant digital download
Choose who speaks for you — before you can't.
A Power of Attorney for Personal Care is one of the most important documents you can sign. It legally appoints a person you trust — your Attorney — to make decisions about your health care, housing, nutrition, hygiene, clothing, and safety if you become incapable of making them yourself. Without one, those decisions may fall to someone the law chooses for you, not someone you chose.
This self-completion kit, prepared by Solvine Law Professional Corporation for use in Ontario under the Substitute Decisions Act, 1992 and the Health Care Consent Act, 1996, guides you through the full document step by step:
- Appoint your Attorney — plus an alternate, in case your first choice is unable or unwilling to act
- Protection built in — the POA takes effect only if you become incapable of making personal care decisions; it has no force while you are capable
- Record your wishes — dedicated sections for your values and beliefs, housing and living arrangements, medical and life-sustaining treatment, pain management, and any religious, cultural, or spiritual considerations your Attorney must respect
- Specific consents and refusals — an optional section for binding instructions on particular treatments, with guidance on how DNR orders work
- Conflict resolution terms — what happens if your Attorney and health care providers disagree, including recourse to the Consent and Capacity Board
- Proper execution — signing instructions with the two-witness requirements, witness eligibility rules, an Attorney's Acceptance section, and a final completion checklist
The document also serves as your health care consent authorization, so your providers know exactly who has authority to consent to or refuse treatment on your behalf.
Pairs with our Advance Care Directive (Living Will): the POA gives someone legal authority; the Directive records your detailed wishes. Solvine Law recommends completing both.
Self-completion precedent for Ontario. Not legal advice, and purchase does not create a solicitor-client relationship. Independent Legal Advice before signing is strongly recommended. Licensed for single personal use.
