Archive and Fair Use Checklist

Archival material can bring authenticity, history and cultural context to a production—but incomplete provenance, unclear ownership and unsupported fair-use assumptions can create costly problems later.

The Archive & Fair Use Checklist helps producers and documentary teams organize the information needed to evaluate archival music and other materials before professional or legal review.

Use the checklist to examine:

• The source and provenance of archival material
• Known owners, custodians and rights holders
• Copyright and public-domain considerations
• Permissions, releases and supporting documentation
• The purpose and context of the proposed use
• The amount and significance of material being used
• Transformative context and fair-use questions
• Territory, media, term and distribution plans
• Credit, attribution and contractual requirements
• Items requiring follow-up with counsel or rights holders

The checklist does not determine whether a use qualifies as fair use. It creates an organized record of what is known, what remains uncertain and what should be examined before relying on an exception or proceeding with clearance.
