Privilege Log Template
Thank you for checking out my charts and personal work-product. As you know, I am an experienced paralegal with several decades of experience. The charts I am sharing for use are charts which I use on a daily basis and have used for a very long time. I have shared them with co-workers and people end up using them and adjusting them to their particular flavor or need.
The purpose of this chart is to identify privileged documents during production (discovery). The design of this chart is currently being used and has been repeatedly used successfully for its intended purpose. Once downloaded, the information contained is no longer considered proprietary to the creator and as such may be freely supplemented, adjusted and modified to fit its preconceived use by the recipient or his/her firm. This chart is shared in good faith and for general informational purposes only. This form is simply a productivity tool/chart used by an experienced paralegal. It does not constitute legal advice in any way, shape or form.
A privilege log is a chart used to formally list specific documents that have come up during the discovery phase in a litigation matter which a party is withholding the production of. The log identifies the details of the document itself which is usually a communication amongst the parties or a document containing protected information. The log identifies the document and the privilege the party is naming to protect it. The most commonly used privileges are that the document is either an attorney-client privileged communication or that is protected by the privilege of work product. This log usually accompanies a production made in response to a request for production by one of the parties or by a non-party who has produced possibly protected documents. The information being filled into the chart is pretty self-explanatory and must be reviewed by a licensed attorney to determine if the alleged provileges will stand.
