TERMS OF SERVICE (Subject to Change)

By purchasing this digital art asset (hereinafter referred to as the "item"), you (the “purchaser”) agree to the following terms:

1. Nonrefundable:

• Once purchased, no refunds will be given unless otherwise discussed with me.

1. Avatar Alterations:

• Editing and additions such as clothing, accessories and color alterations is permitted but adding different hairstyles or adding heavily altering body and face textures is not allowed unless otherwise discussed with me first. keep the avatar somewhat recognizable.
• Altering the avatar to a point where it is unrecognizable is not permitted as you are basically making a new avatar but with my face and body sculpts and that is not allowed.

1. Redistribution (Assets):

• You are prohibited from redistributing, selling, or sharing the item in its standalone form.
• The item may only be incorporated into finished models and projects.

1. Usage of Textures:

• Do not include all of my textures in files, whether in Unity or any other format, for sharing or distribution purposes.

1. Alteration of Meshes:

• Any unauthorized re-UVing, tracing, or alteration of my meshes for redistribution (reselling) by itself is strictly prohibited and will be treated as theft. You may, however, edit and retexture a mesh to use on an avatar that you plan to sell commercially, personally or publicly. Simply put, you cannot edit the mesh and re-sell the item and claim it as your own.

1. Texture Creation:

• Creating new textures for the item is permitted, provided none of my base textures are used in the process; UNLESS the texture in question is a skin texture, and you are adding makeup or tattoos, in which case, it can be used as a base and included in your package, BUT you MUST properly credit me and have a link on the product page that leads back to the skin texture.

1. Reuse & Credits:

• You may only reuse the item in your models if you have purchased said item from either Cloud(gumroad.com) or Clouds Sky Boutique - Payhip .
• Projects utilizing my assets must provide credit with a link on the page leading back to the product you are using.
• Assets and textures are allowed to be used on; Forsale Models/Projects, Personal Models/Projects, Free/Nitro/Public Models/Projects.
• My assets, textures and models are for VRCHAT use only.

1. Violation Consequences:

• Non-compliance with these terms may result in legal action.
• Violators could face fines, and unauthorized use of the asset may be demanded for removal.

1. Legal & Copyright:

• Copyright for this art asset inherently belongs to its creator upon its creation.
• Infringement of Copyright Law related to this asset may lead to:
• Fines ranging between $200 and $150,000.
• Infringers compensate for actual damages and profits derived from unauthorized use.
• The infringer bears all legal fees and court costs.
• Potential impounding of unauthorized renditions of the work.
