Definitions

For the purpose of this License:

• "Product" refers to the digital assets, including but not limited to 3D models, shaders, tools, environments, characters, Unity assets, and other digital content provided as part of your purchase.
• "Creator" refers to the individual or entity responsible for designing, creating, and distributing the Product. In this case, the term refers to me (The asset creator).
• "You" refers to the individual or entity purchasing, downloading, or using the Product, as well as any affiliates or agents acting on behalf of the user.

This license applies to the assets and digital content provided with your purchase (the "Product").

By purchasing, downloading, or using any Product covered by this license, you agree to the following terms:

1. Permitted Uses

You are granted a non-exclusive, worldwide, royalty-free license to use the Product for personal and commercial purposes, provided that:

• The Product is incorporated into a larger project such as a game, film, animation, simulation, app, or other media.
• The Product is not shared, resold, or distributed as a standalone item or in any way that allows others to access, extract, or modify it.
• You may modify the Product for use in your own projects, but redistribution of modified versions is also prohibited.

2. Prohibited Uses

You may not:

• Sell, distribute, share, sublicense, or make the Product available to third parties in its original or modified form.
• Use the Product in a way that allows users to access or extract the original files.
• Use the Product for illegal, defamatory, or misleading purposes.

3. Special Terms for Software & Games

If using the Product in a game, app, or software, you must take reasonable steps to prevent asset extraction, such as:

• Using proprietary formats (e.g., encrypted, compiled, or packed asset files).
• Restricting direct access to source files.
• Implementing DRM or access controls where applicable.

4. Ownership & Attribution

• The creator retains full ownership of the Product.
• Attribution is not required, but appreciated.
• This license does not transfer copyright or trademark rights to the user.

5. License Updates

• This license may be updated from time to time. It is your responsibility to regularly check for any changes to the license terms. The most recent version of this license will apply to your use of the Product, even if it differs from the version included with your initial download.
• If a separate license.txt file is included with the Product, the terms outlined in that file may not supersede this license. This license is the authoritative version, and any conflict should be resolved in favor of the terms stated herein.

6. No Warranty / "As Is" Clause

The Product is provided "as is", without warranties or guarantees of any kind, either express or implied. The creator does not warrant that the Product will meet your requirements, operate uninterrupted, or be error-free.

You acknowledge and agree that the Product may contain defects or errors, and you use it entirely at your own risk.

The creator shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, business interruptions, data loss, or any other damages arising from the use or inability to use the Product, whether or not the creator was advised of the possibility of such damages.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the creator shall not be held liable for any damages, losses, or claims of any kind arising out of or in connection with the use or misuse of the Product. This includes, but is not limited to, any issues with the Product's functionality, compatibility, or integration with other software or hardware, or any loss of data or business opportunities resulting from your use of the Product.

Under no circumstances will the creator’s liability exceed the amount paid by you for the Product.

The Product is provided "as is" without warranties of any kind. The creator is not liable for any damages resulting from the use of the Product.

You agree to indemnify the creator from any legal claims arising from misuse of the Product.

8. Support Disclaimer

The creator may, at their discretion, offer support or assistance with the Product. However, the creator is under no obligation to provide support, and any such assistance is provided on a best-effort basis, without any guarantee of response or resolution.

9. Refunds and Returns

Due to the nature of digital products, no refunds or returns will be offered after the Product has been downloaded or accessed, unless required by applicable law.

You acknowledge that once the Product has been downloaded, it is not possible to guarantee that it has been completely removed from your devices or any other storage. As such, refunds will not be issued for any Product that has been downloaded, accessed, or used in any way.

10. Indemnification

You agree to indemnify, defend, and hold harmless the creator from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Product or any violation of these terms.

12. Why These Terms?

I understand that licenses can sometimes seem intimidating, but these terms are in place to protect both you and me. As the creator, I want to ensure my work is respected and used properly, and these guidelines help prevent misuse, unauthorized reselling, or redistribution.

While I aim to build trust and always want to make my customers happy, these terms also safeguard both my products and your rights as a user. I’m happy to assist where I can, but please note that support is provided at my discretion, not as an obligation.
