[You agreed to these terms when you purchased!]
Please read these terms carefully before purchasing. These rules apply to all products obtained through my official shop, including gifted purchases.
The TOS is subject to change at any time; the updated TOS must be followed regardless of purchase date or method of obtaining any of my products (gifted or purchased for yourself).
ALL SALES ARE FINAL! Due to the digital nature of my products, NO REFUNDS will be provided.
Purchasing my models or assets grants you a LIMITED, NON-EXCLUSIVE, NON-TRANSFERABLE LICENSE to use them under my TOS. You are NOT purchasing ownership or copyright of my original work. All rights not explicitly granted remain with their respective copyright owners!
AVATARS:
1.) ALL AVATARS ARE SOLD WITH A PERSONAL LICENSE ONLY! Each avatar license is strictly limited to ONE individual. The rightful owner is the person whose information is provided at checkout during purchase. Sharing, distributing, transferring, or granting access to the avatar or its files to anyone else is STRICTLY PROHIBITED. Only the original purchaser is authorized to own, access, and use the avatar and its files.
2.) Purchasing an avatar for yourself and then giving or sharing its files with someone else is STRICTLY PROHIBITED. Once purchased, the avatar is licensed exclusively to you for personal use only. If you wish to give the avatar to a friend, you must purchase a separate copy and properly gift it to them. You cannot transfer or share your existing personal license. Each avatar license is valid ONLY for the individual whose information was provided at checkout. If the information entered does not belong to you or cannot be linked back to you, you are NOT authorized to use the avatar, and the license is not valid for you. If you accidentally entered incorrect information at checkout or intended to purchase the avatar as a gift, please open a support ticket so the issue can be reviewed and corrected. Failure to follow these rules is a violation of the personal license agreement.
3.) PRICE SPLITTING IS STRICTLY PROHIBITED! Splitting the cost of an avatar with friends, partners, or other individuals for the purpose of sharing the model or its files is NOT ALLOWED UNDER ANY CIRCUMSTANCES. Each avatar purchase includes ONE personal license for ONE individual only, regardless of how many people contributed money toward the purchase. Paying for a portion of an avatar does NOT grant you ownership, access, or permission to use its files. Only the individual whose information was provided at checkout holds a valid license. If multiple people wish to use the same avatar, EACH PERSON MUST PURCHASE THEIR OWN SEPARATE LICENSE. Sharing a single purchase between multiple individuals is a direct violation of the personal license agreement. Any form of group buying, price splitting, or shared ownership intended to bypass individual purchases is STRICTLY PROHIBITED.
4.) SHARING MODEL PACKAGES IS STRICTLY PROHIBITED! Each purchase grants a personal license to ONE individual only. If you want to match or wear the same avatar as someone else, BOTH individuals MUST purchase their own separate copy!
5.) NO UPLOADING FOR OTHERS! I offer FREE and PAID uploads!
6.) Streaming and monetized content are allowed! However, you MUST credit me (DeadKittyVR) as the creator and include a link to my shop somewhere clearly visible on EVERY post, video, or stream featuring my model!
7.) Gifting is allowed, just make sure to use the gift option and use their email and Discord username!
8.) ABSOLUTELY NO PUBLIC AVATARS! All versions of my models, including Quest conversions, edits, and modifications, MUST remain PRIVATE! Do NOT upload, use, or share unauthorized public versions. My models must ONLY be obtained through my official shop or Discord. NO EXCEPTIONS!
9.) NO REDISTRIBUTION OR SHARING! Do NOT share, distribute, or give my model packages or files to anyone, NO EXCEPTIONS! If you wish to give someone a model, you MUST purchase it separately using the official Gift option!
10.) DO NOT CLAIM MY WORK AS YOUR OWN! You MUST credit me (deadkittyvr) as the original creator. Editing or modifying my work does NOT make it yours!
11.) NO TAKING OR REUSING MY EDITS OR ASSETS USED ON MY MODELS! Taking, copying, or reusing ANY parts, assets, textures, materials, bone settings, or edits from my avatars is STRICTLY PROHIBITED, EVEN FOR PERSONAL USE! Obtain assets from their original creators (all assets are credited). If you like my style, contact me for a custom edit commission!
12.) NO REFUNDS & TOS VIOLATIONS! All digital purchases are FINAL AND NON-REFUNDABLE! If you violate my TOS, I reserve the right to revoke your download access without a refund! Unauthorized chargebacks or payment disputes are prohibited under my store policy, subject to applicable consumer protection laws.
13.) NO RESELLING OR PROFITING FROM MY WORK! You may NOT sell, resell, recreate, or profit from ANY of my creations, whether 2D, 3D, edited, or unedited!
14.) OTHER VR PLATFORMS ARE ALLOWED! My models may be used outside of VRChat (such as CVR, NeosVR, or Helios) for PERSONAL USE ONLY! NO ONE ELSE may access, download, copy, or use your model or its files IN ANY WAY! All models and files MUST remain completely PRIVATE and accessible ONLY to the licensed owner! My TOS applies to ALL platforms, NO EXCEPTIONS!
15.) AVATAR UPLOADS & USER RESPONSIBILITY! Basic Unity knowledge is REQUIRED to upload my models yourself. If you are unfamiliar with Unity or don't know how to upload avatars, I offer FREE and PAID upload services!
16.) AVATAR EDITS & MODIFICATIONS! You're more than welcome to customize my models! <3 Changing colors, textures, and adding Unity gimmicks is perfectly fine! You can also change or add outfits, hairstyles, and accessories, as long as my model STILL remains clearly recognizable as my original creation! However, HEAVY EDITS that make my model unrecognizable are NOT ALLOWED! Please don't change so much that you're essentially only using my edited face and body mesh to create your own avatar. My models are NOT meant to be used as bases for new creations! If you're unsure about an edit, feel free to ask me!
17.) By purchasing my models, you agree that if you violate my TOS, I may share your email, Discord username, or VRChat username with trusted creators or relevant parties solely for reporting and addressing TOS violations. No other personal information will be shared under this policy, and any disclosure will be subject to applicable privacy laws.
18.) Hiring someone to edit or upload my avatars does NOT automatically grant them access to my files! Both the creator and client MUST have their own valid license, unless I provide written permission for an exception. Unauthorized file sharing is STRICTLY PROHIBITED!
ASSETS:
1.) NO PAID ASSETS ON FREE MODELS! My paid assets CANNOT be used on any free avatars, including Nitro, server freebies, or any other free distributions!
2.) You're welcome to use my assets on PUBLIC avatars for others to wear! However, the assets MUST remain part of the avatar and cannot be extracted, redistributed, or shared as standalone files.
3.) DO NOT CLAIM MY WORK AS YOUR OWN! You MUST credit me (deadkittyvr) as the original creator and include a direct link to my shop somewhere CLEARLY VISIBLE in your product description, credits, or wherever my assets are showcased. Editing or modifying my work does NOT make it yours!
4.) My assets MAY be included in completed, for-sale avatar packages with proper credit! However, they MUST NOT be sold, redistributed, or provided as standalone assets, whether edited or unedited. Buyers may only use the included assets as part of that purchased avatar unless they obtain their OWN separate asset license!
5.) COMMERCIAL ASSET USE & DISTRIBUTION! My assets CAN be used on for-sale models, but you MUST publicly credit me (deadkittyvr) as the original creator with a direct link to my shop somewhere CLEARLY VISIBLE in your product listing or description! Customers MUST NOT receive standalone asset files or extract, remove, or reuse my assets from the purchased model IN ANY WAY! If they wish to use the asset separately, including on another model or personal edit, they MUST purchase their own license directly from my shop!
6.) IF MY ASSET IS BEING USED ON A COMMISSION! Only the CREATOR (person doing the commission) is required to purchase my asset. The CLIENT (person receiving the commission) may use the asset on their commissioned model, but DOES NOT own a separate license! Unless the client purchases the asset themselves, they are STRICTLY PROHIBITED from extracting, reusing, transferring, or adding it to ANY other models or versions, including personal edits or alternate versions of their avatar. A separate purchase is REQUIRED for any additional use!
7.) ASSET EDITS & MODIFICATIONS ARE ALLOWED! You're welcome to freely customize my assets, including textures, meshes, and other modifications! However, you MUST still credit me (deadkittyvr) as the original creator. Editing my assets does NOT make them your own work!
8.) NO ASSET RIPPING OR REUSING! You MUST purchase my assets directly from my shop before using them! Taking, extracting, or reusing my assets from another creator's model is STRICTLY PROHIBITED, even for personal use!
9.) You MAY NOT resell my assets or ANY parts of their meshes, textures, or materials, whether edited, unedited, or combined with other assets! Repackaging or modifying my work to sell as your own asset is STRICTLY PROHIBITED!
10.) OTHER GAMES & PLATFORMS ARE ALLOWED! You're welcome to use my assets in other games and platforms, as long as you properly credit me (deadkittyvr) as the original creator! However, my assets MUST NEVER be shared, distributed, or made accessible as standalone files IN ANY WAY, SHAPE, OR FORM! They must remain part of your finished creation and CANNOT be extracted or obtained separately!
11.) MODDING & THIRD-PARTY USE! My assets CAN be used in game mods (such as FFXIV), but EVERY individual receiving access to the mod MUST purchase their own copy of the asset directly from my shop! This applies to ALL users, whether the mod is free, paid, private, or shared. Purchasing the asset once does NOT grant permission to distribute it to others without their own license!
By purchasing any of my products you agree to the following terms above, if said terms are broken, you are a subject to be taken action against according to the DMCA (Digital Millennium Copyright Act).
Violating my TOS may result in LICENSE REVOCATION, LOSS OF DOWNLOAD ACCESS, STORE RESTRICTIONS, AND COPYRIGHT TAKEDOWN REQUESTS where applicable. I reserve the right to take appropriate action against unauthorized use or distribution of my original work, subject to applicable law!
Please respect my work and the time and effort that goes into creating my models and assets! If you're ever unsure whether something is allowed, feel free to reach out and ask before proceeding!
