TERMS OF SERVICE

Introduction

Welcome. These Terms of Service ("Terms") constitute a legally binding agreement between you ("the Client" or "the Purchaser") and the creator known as Earthship / sixuri ("the Creator"). By commissioning custom work ("Commissions") or purchasing digital products ("Store Items") from the Creator, you acknowledge that you have read, understood, and agree to be bound by these Terms.

SECTION 1: GENERAL TERMS APPLICABLE TO ALL SERVICES & PRODUCTS

1.1 Intellectual Property & Copyright

Creator's Rights: The Creator retains full, exclusive ownership of the copyright and all other intellectual property rights for all created works. This includes, but is not limited to, the right to display the work in portfolios, on social media, for promotional materials, and in derivative works.
Prohibited Uses: You may NOT resell, redistribute, modify for redistribution, or use any work for any commercial purposes. This prohibition explicitly includes, but is not limited to, incorporation into any blockchain-related technology (e.g., NFTs) or AI training datasets.

1.2 Payment & Financial Terms

Finality of Sale: All payments are non-refundable and all sales are final, as detailed in the sections below.

1.3 Attribution (Credit)

You are required to provide clear and prominent credit to the Creator (Earthship / sixuri), including a hyperlink to the Creator's website or primary social media profile, whenever the work is displayed publicly.

SECTION 2: TERMS FOR CUSTOM COMMISSIONS

2.1 Commission License

Upon full payment and project completion, the Client is granted an exclusive, non-transferable license for personal, non-commercial use only.

2.2 Commission Workflow

Inquiry: All commission requests must be submitted via direct message, providing comprehensive details including commission type, visual references, and budget.
Quotation & Payment: A formal price quotation will be issued. Full, non-refundable payment is required in advance to secure a commission slot. No work shall commence until payment is received in full.
Revisions: The initial quotation includes up to two (2) minor revisions (e.g., small color adjustments). Substantial alterations (e.g., changing a pose, a different outfit) will be classified as major revisions and are subject to additional fees.

2.3 Cancellation Policy

By Creator: Should the Creator cancel a commission for any reason, a full refund will be issued.
By Client: If the Client cancels after work has commenced, no refund will be issued.

SECTION 3: TERMS FOR STORE ITEMS (DIGITAL PRODUCTS)

3.1 General License for Store Items

All Store Items are licensed for personal, non-commercial use only.

3.2 Specific Rules for Video Collections

Purchased videos are for private viewing only. You are strictly prohibited from re-uploading, streaming, or sharing the video files on any public or private platform.

3.3 Specific Rules for 3D Assets & Textures

Permitted Use: Assets are licensed for use on your personal, complete digital projects (e.g., private cards, personal renders).
Commercial Use Restriction: Without prior written permission, you are prohibited from using these assets on any commercial projects, including but not limited to: cards for sale, or public cards.

3.4 Refund Policy

Due to the intangible and irrevocable nature of digital products, all sales of Store Items are final and non-refundable.

SECTION 4: LEGAL & ENFORCEMENT

4.1 Violation of Terms

Any breach of these Terms of Service will result in an immediate and permanent revocation of your usage license for all purchased and commissioned works. The Creator reserves the right to issue DMCA takedown notices, pursue legal action for damages, and permanently ban violators from all future services.

4.2 Limitation of Liability

The Creator shall not be held liable for any damages that may result from the use or inability to use the final work.

4.3 Modification of Terms

The Creator reserves the right to amend these Terms at any time. The most current version will always be posted on the Creator's primary website.
