1. Agreement to the TOS

By purchasing, downloading, accessing, or otherwise using any products of spaceebean ("seller"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service.

If you do not agree to be bound by these Terms of Service, you are NOT allowed to purchase, download, access, or use any products by spaceebean.

2. Digital Product Policy - No Refunds

All products that are being sold are digital goods. ALL SALES ARE FINAL. No refunds, or returns will be provided in ANY circumstances.

Any disputes, or chargebacks will lead to:

• You losing the product license rights,
• Permanent ban from our platform and communities,
• Legal response to these disputes.

Upon chargeback or payment dispute, you immediately lose ALL rights to use any of our products.

3. License Grant - Personal Use ONLY

Upon buying, the products are personal, private use ONLY in VRChat.

The license:

• Belongs only to the buyer or the giftee listed at the checkout,
• Will be cancelled automatically if false or misleading purchase information is provided.

Any bought products are only going to be uploaded and used on the buyer's own VRChat account PRIVATELY.

4. Strict Prohibitions

4.1 Redistribution and File Sharing

You CANNOT:

• Share, leak, trade, or resell, the files privately or publicly,
• Do price splits or trade avatar packages,
• Make the avatar available to others in any form.

This applies to:

• Unedited packages,
• Edited versions,
• Extracted assets,
• Free products

Products may only be distributed and bought directly through the our Payhip store.

4.2 Public Uploads

You CANNOT upload any of our avatar publicly or for others. All avatars are for private use ONLY, including free and edited versions.

4.3 Asset Extraction

You CANNOT take, or reuse any parts, meshes, textures, materials, or assets. All assets are only for that product.

4.4 Editing Restrictions

You may edit the avatar for:

• Personal customization,
• Optimization purposes

You CANNOT:

• Head swap or body swap,
• Create a version that is unrecognizable from the original,
• Remove logos or identifying marks

*Edited versions still applies to the TOS.

4.6 AI / NFT Restriction

You CANNOT use any of the models, files, assets, or renders for AI training or generation, and NFTs.

4.7 Misrepresentation

You CANNOT:

• Claim our products as your own work,
• Remove branding or credits,
• Sell commissions or products using the model as a base.

4.8 Design Protection - No Copying or Imitation

You CANNOT:

• Copy, of replicate, any of my avatar or product design
• Use the design as inspiration to create a different avatar

These apply to EVERYONE, including those who have not purchased the product.

4.9 Streaming & Public Content

Streaming and VTubing use is permitted if:

• Proper credit to our store link is given,
• The avatar is not used to promote hate speech, harassment, discrimination, illegal activity, or sexually exploitive content involving minors.

4.10 Commissioning & Third-Party Work

If you wish to commission another creator to modify, convert, or work on any of the products:

• Both you and the person that will be working on any of our products must have purchased a valid license for that specific product, free or not,
• You must have prior permission from us to commission work on any products, including free products,
• The commissioned work must still follow the TOS.

Failure to comply with this rule would result in the cancellation of your license.

5. Age Restriction

You must be 18+ to purchase NSFW products.

6. Technical Disclaimer

We are not responsible for:

• VRChat updates that might break the avatar
• SDK changes
• Performance or ranking adjustments
• Issues from editing the avatar

7. Credits, Attribution & Anti-Gatekeeping

7.1 Credit Requirement

When using any avatar or product in social media, etc., you should provide a clear credit us.

Credits must:

• Include our credit ("spaceebean")
• Include a link to the our store (https://payhip.com/spaceebean)
• Be placed in a visible place like in the description, pinned comment, caption, or profile link

If we find out you failed to credit we will contact you, and may lead to cancelling your license.

7.2 Anti-Gatekeeping Policy

You CANNOT:

• Claim the avatar as your own,
• Provide misleading information about us.

You must provide credit to our store link.

8. Chargeback, Payment Reversals & Fraud

All products are delivered digitally. By completing a purchase:

• The buyer and giftee waive the right to initiate a chargeback based on "item not received", dissatisfaction, or fraud.
• Any chargeback, reversal, or fraudulent claim violates the TOS

If a chargeback is initiated:

• Buyer's license to the product is immediately cancelled,
• Permanent ban from our store and communities, losing the rights to any purchases from past to future,
• You must delete all products, files, or assets that is part of our products,
• We will respond to any disputes, report fraud, and pursue legal action

Unauthorized use after a chargeback constitutes willful copyright infringement.

9. Support & Checkout Verification

To receive support regarding any purchased products ensure all checkout information is correct & true, including:

• Discord ID
• VRChat profile Link

Join our discord server and submit a support ticket

Important:

• If the product was purchased as a gift, only the designated giftee listed at checkout is eligible for support.
• False or incomplete information will be denied support,
• Support requests outside of the will not be entertained.
• Any rude, or disrespectful behavior towards us, the staff, or community members while requesting support will be immediately denied.

11. Enforcement & Cancellation

Failure to follow our TOS will result in:

• Your product license cancellation,
• Legal and DMCA reports to take down leaks,
• Permanent ban from our store,
• Sharing your information to group/community.

12. Information Sharing of Enforcement

Violators agree that the we will share transactions or any information with trusted parties, platforms, or communities for fraud prevention, intellectual property enforcement or TOS compliance.

13. Updates on TOS

We may update or change the TOS at any time. Using our products will still apply to the updated Terms.
