Any item sold by Serenity's Garden is required to be credited and hyper linked.

Please either link directly to the asset used or the store itself.

Upon valid purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Assets / Avatars for personal use only unless otherwise explicitly stated in writing.

✔ Assets made by Serenity's Garden may be used on COMPLETE models for Commercial, Free, Public, Nitro/Discord Sub & Commissions¹.

• On all Models (free or paid) where the package is received by the customer, please ONLY INCLUDE THE TEXTURES USED, not every texture.
• When used on a paid model, the model CANNOT be priced lower than the most expensive asset used from my shop. (ie. A $10 asset cannot go on a paid avatar priced less than $10)
• ¹ For commissions, all involved parties must own a license for the product.

✔ Assets and models made by Serenity's Garden can be used for VTubing with proper credit.

✔ ALL meshes made by Serenity's Garden are for VRCHAT ONLY unless given explicit permission by Serenity personally.

✔ Editing any product from Serenity's Garden is fine as long as it is still credited as (product name) by Serenity's Garden, even if heavily edited.

✔ Uploading purchased avatar assets to your own account for personal use

✔ Use the Assets in rendered media/content (screenshots, videos, streams, promotional content)

✔ Any Models / Avatars MUST still look recognizable if edited.

✔ You are NOT ALLOWED to share my Models / Avatars with anyone -- They are for PERSONAL USE ONLY.

✔ You are NOT ALLOWED to RESELL my Models / Avatars -- EVEN IF EDITED

✔ You are NOT ALLOWED to make any Models / Avatars to be PUBLIC in any shape or form.

✔ Do NOT Asset Mine / Reuse anything from my Models / Avatars.

• Asset Mining: When you use assets off of other peoples model for personal usage or commerical usage.

✔ Do NOT Leak, Price Split, or Re-Upload any of my Models / Avatars to anyone's account.

✔ Do NOT REQUEST any of my Models / Avatars for FREE in ANY servers.

✔ DO NOT PUT MY WORK INTO AI

✔ You HAVE to credit me when using my work.

Abuse to any of these terms will result in the following:

• Banned from store
• Banned from server
• Blacklistable Offense

The Licensee (You) may not share, distribute, transfer, sublicense, resell, trade, gift, publish, upload, or otherwise provide access to any purchased or obtained digital assets, whether modified or unmodified, without explicit written permission from the Licensor (Serenity's Garden).

This prohibition includes, but is not limited to:

• Sending files through direct messages, email, cloud storage services, peer-to-peer sharing, or file hosting platforms
• Uploading assets to public or private Discord servers, group chats, forums, websites, repositories, archives, or databases
• Sharing files through temporary links, Nitro uploads, Google Drive, MEGA, Dropbox, MediaFire, Pixeldrain, GitHub, or similar services
• Allowing third parties access to files through shared accounts, shared computers, shared Unity projects, or extracted project contents
• Redistributing edited, altered, recolored, kitbashed, optimized, or otherwise modified versions of the asset
• Uploading assets publicly, privately, or semi-privately in a manner that allows unauthorized extraction, duplication, or redistribution
• Claiming ignorance regarding the source of illegally obtained assets, including statements such as “I got it from a friend,” “it was publicly available,” “someone sent it to me,” or similar claims
• Possessing, using, distributing, or benefiting from assets known or reasonably suspected to be leaked, ripped, extracted, stolen, or otherwise unlawfully obtained
• Attempting to bypass licensing restrictions through alternate accounts, third parties, intermediaries, or transfer of ownership

Any asset obtained through unauthorized sharing, ripping, extracting, chargeback fraud, account compromise, or other unlawful means shall be considered unauthorized and revoked immediately.

The Licensor (Serenity's Garden) reserves the right to revoke access to assets, terminate licenses, blacklist individuals or associated accounts, deny future purchases, remove community access, and pursue further action where applicable in response to violations of this agreement.

The Licensee (You) is solely responsible for maintaining the security and confidentiality of their purchased files and accounts. Failure to secure purchased assets does not exempt the Licensee from responsibility for unauthorized distribution originating from their access.

Use, possession, or distribution of leaked assets constitutes acceptance of liability for violation of this agreement.

You may provide files to a commissioned editor strictly for personal modification work ONLY if:

• Both parties legally own the required assets/licenses
• The files are not retained, reused, or redistributed by the editor
• The editor does not use the Assets for any other purpose

You are responsible for ensuring compliance with this Agreement.

• The Assets are provided “as is” without warranties of any kind.
• The Licensor shall not be liable for:
• Rig/Armature conflicts
• Clipping/Weight painting issues that occur when applied to a non-base model
• Platform incompatibilities
• Indirect or consequential damages
• User misuse of the Assets
• Users are responsible for understanding the software/platform requirements before purchase. Please have basic Blender/Unity knowledge before purchasing my assets.

You can be BANNED from my store or Discord due to misbehavior or broken TOS of either myself or creators I support.

Breaking terms of anything listed in ANY TERMS above can result in you being banned/blacklisted, I reserve the right to remove/revoke someone's access to files at anytime due to their conduct and refuse further service. Refunds are not given when this occurs as the agreement made to follow TOS is broken.

BANNED OR REVOKED TOS

These rules apply to all assets: free, nitro, paid and commissioned assets.

・If you have been banned or blacklisted from my store or Discord, use of all avatars or assets for Personal / Commercial / Public / Free is completely revoked.

・Any assets I, Serenity's Garden, helped create falls under the umbrella of my blacklist and is not allowed to be used by blacklisted/banned users. It may not be on my shop, but it is still my work. [Ie. Anything I rig, texture, make meshes for, etc.]

You may appeal a ban/blacklist 6-12 months after the decision. Timeline is based on severity. Appeal is not guaranteed to be accepted.

The Licensor (Serenity's Garden) reserves the right to blacklist offenders from future purchases, support services, communities, or affiliated platforms.

This license automatically terminates if you violate any part of this Agreement.

Upon termination, you must cease all use of the Assets and delete all copies in your possession.

This also includes my Models / Avatars.

No refunds for digital products. This applies to all my avatars. By making a purchase you agree to these terms. Chargebacks lead to bans and reports from my store.

Fraudulent chargebacks or payment disputes made after receiving the Assets may result in:

• Permanent revocation of license access
• Blacklisting from future purchases
• Removal from associated communities/services
• Reporting to relevant platforms or payment processors

Discord Server: Serenity's & Phantom's Hub

An End-User License Agreement (EULA) is a legal contract between a software provider (myself/Serenity's Garden) and a user, granting a license to use the software (my assets or avatars) while retaining ownership. It protects my intellectual property, restricts redistribution, and limits liability. However, EULAs do not grant ownership rights to the software/digital asset, only permitted use. The creator (myself/Serenity's Garden) retains control and ownership rights, as the software/digital asset is my intellectual property.

My EULA is enforced through click-wrap agreements ("I Agree" at checkout/purchase) or installation/use of my creations. It manages user expectations regarding data collection, usage, and restrictions.

Common Clauses

• License Grant: Defines the user's rights to use the software/digital asset (e.g., non-transferable, commercial, personal, etc.).
• Restrictions: Prohibits actions like modifying, reverse engineering, or redistributing the software/digital asset.
• Disclaimer of Warranty: States the software/digital asset is provided "as-is" without warranty, protecting the vendor (myself/Serenity's Garden) from liability for issues.
• Termination: Allows the vendor (myself/Serenity's Garden) to terminate the agreement if the user breaks the terms.

A EULA is not the same as Terms of Use or Terms of Service (TOS), although both are legal agreements between providers and users.

EULAs specifically pertain to software/digital asset usage, focusing on licensing terms, intellectual property rights, and usage restrictions. They typically apply to software/digital assets that individuals or companies install or access on their devices.

In contrast, terms of use or terms of service are broader agreements covering a wide range of online services, including websites and platforms. ToS outline general rules for service usage, user behavior, privacy policies, and dispute resolution.

While EULAs are software/digital-centric, ToS apply to various online interactions and services. Both documents serve important legal purposes but differ significantly in their scope, content, and application contexts.

“Leaking” refers to the unauthorized sharing, distribution, trading, gifting, reposting, uploading, or resale of privately obtained or purchased digital assets, including but not limited to VRChat avatars, textures, models, animations, packages, source files, edits, or other creator content.

This includes distributing files through direct messages, cloud storage links, Discord servers, archive sites, file-sharing platforms, alternate accounts, or any other method without the explicit permission of the original creator or rights holder.

Assets obtained through ripping, extracting, unauthorized uploads, shared accounts, chargeback fraud, or other illicit means are also considered leaked content.
