Terms and Conditions
Version 1.0 · Revised 11 October 2026
1. Product creator, Payhip and scope
AbleTouch is the product brand used by Pieter Klokkenburg, a sole trader established in the Netherlands (the “Creator”, “we”, “us”). AbleTouch is not a separate legal entity. Pieter does not replace Payhip as the contracting supplier identified in Payhip's End User Licence.
- Netherlands Chamber of Commerce (KvK): 87901757.
- VAT identification number: NL004503668B63.
- Geographical business address: Wipmolen 29, 3352 XL Papendrecht, Netherlands.
- Customer contact email: abletouch.support@gmail.com.
These are AbleTouch-specific product and licence terms for downloads obtained through our Payhip store. Sections 5 and 6 permit personal, professional and commercial use by one licensed individual, while restricting resale and redistribution of the product files. A business, church or other organisation may purchase for one designated individual; this does not grant a team or multi-user licence. These terms are not a replacement for Payhip's purchase contract. A consumer is an individual acting outside their trade, business or profession. Purchasing for professional or organisational purposes does not itself create consumer status. Provisions expressly concerning statutory consumer rights apply where the buyer qualifies for those rights; any other mandatory protections remain unaffected.
Payhip's End User Licence identifies Payhip Limited as the contracting supplier of digital content purchased through its checkout. Pieter is the content creator and rights holder for the AbleTouch material identified here. Stripe processes the payment methods offered at checkout. Payhip's purchase terms and the relevant providers' privacy notices apply to their respective services. These AbleTouch terms do not purport to override Payhip's contract or remove mandatory legal rights.
The product description and compatibility information shown when you place your order describe the supplied AbleTouch content. We make the applicable AbleTouch terms readable and downloadable before payment and arrange for the applicable version to accompany the order confirmation on a durable medium. Keep a copy of these terms, Payhip's applicable purchase terms and your order confirmation. Mandatory law prevails over any inconsistent provision. No automatic priority of these AbleTouch terms over Payhip's End User Licence is asserted.
The use permissions below are granted by Pieter for the creator-owned AbleTouch material. They do not amend Payhip's obligations or its separate contract. Mandatory rights and applicable third-party licences remain unaffected.
Responsibilities and contact route
Payhip operates the purchase checkout, payment/delivery interface, receipt and download services and is identified as supplier in its End User Licence. Pieter supplies the AbleTouch content and grants the creator permissions set out here. Pieter's express commitments include released V1 update access under section 7 and handling product, licence and order enquiries; they do not replace Payhip's own obligations.
Payhip's buyer help directs refund requests to the product creator/seller. Send AbleTouch product, licence, withdrawal or refund requests to abletouch.support@gmail.com with your order reference. Pieter handles the request, coordinates with Payhip where needed and carries out any applicable refund action through the connected Stripe account. Payhip support can be contacted at contact@payhip.com for its checkout, receipt, access or platform services. This practical route does not make Payhip solely responsible for every remedy or Pieter solely responsible for Payhip's services; each party retains obligations that applicable law imposes on it. You do not lose statutory rights by contacting the wrong party first.
2. Product and requirements
AbleTouch V1 is downloadable digital content: TouchOSC layouts for iPad and iPhone, a shared ABLETOUCH Remote Script, a prepared Ableton Live demo project, illustrated English and Dutch manuals and the specifically identified creator-owned audio. It is not a standalone iOS app, an Ableton Live licence, a TouchOSC licence or a complete instrument library.
You must obtain the required third-party software and suitable equipment separately. Review the published tested versions and device/layout information before purchase. Optional modules require the rack, track, clip and marker structures described in the manuals; arbitrary existing Live sets are not automatically compatible without setup.
Tested versions and future third-party changes
The tested baseline is Ableton Live 12.4.6 Standard on macOS Tahoe 26.6.2 (build 25G83), TouchOSC 1.5.3.266 and TouchOSC Bridge 1.7.3, with the included mobile layouts tested on iOS 27.0.1 and iPadOS 27.0.1. Windows and other Live editions or versions have not been verified. These are specific tested versions, not a promise of compatibility with every operating-system release.
Compatibility with later Ableton Live, TouchOSC, TouchOSC Bridge, operating-system or device versions is not guaranteed. A third-party update may affect AbleTouch functionality. No ongoing adaptation to every future third-party version is promised.
Check the published AbleTouch compatibility information before upgrading your performance setup. Keep backups and, where available and appropriate, a recoverable working configuration; test changes before relying on them in a performance. This is not advice to ignore necessary security updates or to keep using unsafe software.
Installing an unverified later version does not, by itself, create a promise that we will adapt AbleTouch to that version free of charge. However, these compatibility limits do not exclude mandatory consumer rights, required conformity or security updates, or remedies for a product that fails to meet the description and reasonable expectations applicable to the purchase. We do not treat every third-party change as automatically outside our legal responsibility. Any mandatory obligation is assessed under applicable law and the circumstances of the purchase.
Third-party spoken Guide Announcements audio is not included. Obtain the free Click & Guide pack from MultiTracks.com separately and relink the samples in the configured rack, following the manual and the provider's terms. The separately identified creator-owned ZG Guide audio is included. AbleTouch is independent and is not an official Ableton, Hexler or MultiTracks product.
3. Price, payment and order
Prices are displayed in US dollars and include applicable VAT/sales tax under the store's tax-inclusive settings. The introductory AbleTouch V1 price is USD 59. The total applicable to your purchase is shown before you confirm payment. Your payment provider may apply its own currency-conversion charges.
This is a one-time purchase, not a subscription. Payment is made through the options offered at checkout. An order is accepted when successful payment and the order are confirmed. If a payment fails or remains pending, delivery may wait for payment confirmation.
Future price changes do not change the price of an accepted order. No additional paid service or subscription is created without your agreement.
4. Digital delivery
After successful payment, Payhip normally makes the files available immediately on the download page and sends an email with a download link. Provide an accurate, accessible email address and check your spam folder if needed. If the link or file does not arrive or cannot be accessed, contact us with your order reference.
Download and keep a personal backup. No indefinite hosting period or permanent availability of a third-party platform is promised. This does not limit delivery, access or remedies required by law. Platform or email problems do not automatically remove an applicable delivery obligation. Contact us for help identifying an order or delivery issue; Payhip's obligations under its purchase contract remain unaffected.
5. Single-user licence — templates and Remote Script
One purchase grants one individual user a non-exclusive licence to use the purchased AbleTouch templates and Remote Script for personal, professional and commercial purposes, on multiple computers and compatible devices they own or control, including both included layouts. This includes paid performances, church services, studio sessions, client work, music production, recordings, broadcasts, livestreams and monetised videos. You may release, sell and monetise your resulting music and audiovisual productions without an additional AbleTouch licence fee. This permission concerns using AbleTouch as a tool, not selling or distributing the AbleTouch product files. You remain responsible for rights in your own music and any third-party material. The separate permission for included creator-owned audio is set out in section 6. Backups are allowed. This is a licence to use the product, not a transfer of its intellectual-property ownership.
The licence is not a team, shared-account or multi-user licence and is non-transferable except to the extent mandatory law permits transfer. Other operators need their own licences, even when using the same computer. No general permission is granted to replace the licensed user or pass the product files to another person. Do not share personal Payhip account credentials, product files or download access.
The purchased version may be used indefinitely without a subscription, subject to these terms and the required third-party software. This duration does not promise perpetual download hosting or compatibility with every future software release.
Following valid withdrawal or termination of the purchase contract with a full refund, use of the affected licensed product must stop and its copies and backups must be removed, except records required by law. A partial price reduction alone does not end the licence.
For a material breach of the licence that can be remedied, we will identify the breach in writing and allow at least 14 calendar days from receipt to remedy it before terminating the licence for that breach. A minor breach does not automatically end all use rights. Any termination for a serious, irremediable breach or an unremedied material breach must be proportionate and lawful. On valid licence termination, further use and redistribution must stop and product copies must be removed, without prejudicing mandatory rights.
Do not sell, resell, sublicense, share or redistribute the Remote Script, code, TouchOSC layouts, demo project or documentation, whether unchanged or modified, or include them in another downloadable product or template. Configuration and adaptation for your own licensed personal, professional or commercial use are allowed; they do not grant redistribution rights. Selling or publishing a resulting music or audiovisual production is not resale of AbleTouch, provided it does not supply the AbleTouch product files or code to others. Supplying an editable project containing those files is not covered by this permission.
This restriction does not prohibit a transfer of a lawfully acquired software copy or use right to the extent that applicable mandatory law permits that transfer, including where software distribution rights are exhausted. Any such transfer must satisfy the applicable legal conditions, including making the transferor's retained software copies unusable where required. This exception does not itself grant a right to reproduce or redistribute the entire bundle, its audio or its documentation, or to sell modified code or derivative products. The applicable rights must be assessed for each component.
Nothing in this clause overrides permissions granted by any applicable third-party/open-source licence or restrictions that cannot lawfully be imposed. Any such components and notices must retain their applicable licence rights.
6. Included demonstration audio
The core AbleTouch product is the TouchOSC templates and Remote Script integration. Creator-owned audio is included as demonstration material for the supplied example set, not as a separately marketed sample library. For the files identified in Appendix A, Pieter grants the licensed user a non-exclusive, worldwide, royalty-free permission to use, edit and incorporate that audio in personal, professional and commercial musical or audiovisual work. This permission covers the creator-owned composition, recording and performance rights held by Pieter in those files.
Permitted uses include live and paid performances, church services and their livestreams or recordings, studio and client work, music releases, broadcasts, podcasts and monetised videos. You may distribute, publish, broadcast, sell and monetise resulting musical or audiovisual productions incorporating the audio, without an additional AbleTouch royalty or attribution requirement. A resulting production may include the demo song as a performance or recording, but this permission does not allow repackaging the supplied demo recording itself as your own standalone music release.
Do not sell, share, sublicense or redistribute the supplied audio files as standalone files, a sample library, sample pack, stock-audio product or another downloadable asset collection, whether unchanged or modified. Do not provide the source samples or an editable sample/project package to others. Selling your resulting production is allowed; selling or giving away the supplied audio assets themselves is not. Mandatory rights remain unaffected.
Appendix A identifies the included creator-owned files. This permission does not license unrelated music or third-party material added by a customer.
Third-party Guide cues are not licensed by us and remain subject to their provider's terms.
7. Documentation, assistance and updates
This is a self-service product. Personal technical coaching, remote installation, custom set-building, live-performance assistance and video tutorials are not included at launch. The manuals provide setup and operating instructions.
This exclusion of optional assistance does not exclude contact about orders, delivery, licence questions, complaints or statutory remedies. A faulty or misdescribed product cannot be treated as merely a request for optional support.
If we release updates within the AbleTouch V1 product line, existing V1 buyers receive them without an additional product charge through their Payhip download access. No optional new-feature development or update schedule is promised. Separately marketed major versions, such as AbleTouch V2, and separate expansions may be sold at an additional price and are not automatically included in a V1 purchase.
Your statutory rights against the responsible supplier remain unaffected. Pieter will address reported issues in the creator-supplied content and provide any correction, update or information legally required of him, coordinating with Payhip where the purchase-contract remedy concerns its supply. Neither this role division nor the exclusion of optional coaching removes a legal obligation of either party. A necessary correction cannot be made chargeable simply by labelling it a new major version. These obligations do not promise every requested feature or unlimited custom installation assistance.
Free access to any V1 updates we choose to release is not a promise that an update will be developed for each new Ableton Live, TouchOSC, TouchOSC Bridge or operating-system release. The tested-version and future-change provisions in section 2 apply, without limiting mandatory obligations.
8. Withdrawal and immediate delivery
Where applicable, consumers have a statutory 14-calendar-day withdrawal period from conclusion of the contract for paid digital content not supplied on a physical medium. Other mandatory local rules may provide additional rights.
Immediate supply during that period requires your prior express consent and your acknowledgement that the withdrawal right is lost when supply begins. The required confirmation of that consent and acknowledgement must be provided on a durable medium, such as email. Payhip operates checkout and delivery; Pieter configures the AbleTouch checkout statements and coordinates the confirmation arrangements with Payhip. Neither merely displaying these terms nor storing a checkout response alone substitutes for the required confirmation.
The withdrawal right is lost only when supply begins and all applicable legal conditions have been met. Merely buying a digital product, reading these terms, accepting general terms, or ticking a preselected box is not by itself sufficient. If the conditions have not been met, we will not rely on this exemption to refuse a valid statutory withdrawal.
Where you retain a withdrawal right, send an unequivocal withdrawal statement before the applicable deadline to abletouch.support@gmail.com, or use the applicable store withdrawal facility. You may also contact Payhip at contact@payhip.com about its purchase contract. Pieter will handle a request received by him and coordinate with Payhip where necessary; you are not required to identify the correct allocation of legal responsibility before making the request. The optional model form below may be used, but is not required. A legally required accessible electronic withdrawal process and acknowledgement must remain available; email alone is not asserted to replace that facility.
For a valid withdrawal, the applicable payment must be reimbursed without undue delay within the legally required period, normally no later than 14 days after notification, using the original payment method unless you agree otherwise, without a reimbursement fee. Pieter processes refund requests through the connected payment route in accordance with Payhip's seller workflow, coordinating with Payhip where needed. This describes the practical refund route; it does not release Payhip or Pieter from an obligation that the law imposes on them.
9. Voluntary refunds and defective content
We do not offer a voluntary change-of-mind refund policy or satisfaction guarantee beyond your statutory rights. Digital delivery is not, by itself, a reason that a refund is legally or technically impossible.
You retain all applicable rights if the content is not delivered, is defective or does not conform to the contract. Depending on the circumstances and applicable law, these may include having the content brought into conformity without charge, a price reduction or termination and reimbursement. Any required remedy must be provided within the legally required reasonable period and without significant inconvenience.
Contact abletouch.support@gmail.com with your order reference and a description of the problem. Pieter investigates creator-content issues and handles or coordinates the appropriate remedy; Payhip remains responsible for obligations imposed on it as supplier. Relevant version details and screenshots may help establish the issue, but unnecessary personal information is not required and statutory rights are not restricted to a particular reporting format.
10. Complaints
Use the contact details in section 1 for complaints or order/download problems. We aim to provide a substantive response within 14 working days. If investigation takes longer, we will explain the delay and give an expected response time. This target does not extend a statutory deadline or excuse urgent action where required by law.
If a complaint is unresolved, you remain free to seek assistance from the competent consumer authority, an applicable dispute-resolution body or a competent court. No membership of a trade-association complaints scheme is represented unless expressly identified.
11. Responsible use and liability
You are responsible for your configuration, your musical material, personal backups and your decision to rely on a setup in a performance. Keep unmodified backup copies of Live sets, test the complete configuration before a performance and provide a suitable fallback. AbleTouch is not a backup service and does not guarantee uninterrupted performances or protection against every hardware, operating-system, third-party software or user-configuration failure.
Use is at your own risk insofar as the risk arises from matters within your control or external failures for which we are not legally responsible. We are not responsible for loss of set files, data or interruption of an event caused solely by those matters, rather than by a failure for which we are responsible. These statements do not excuse a defective or misdescribed AbleTouch product or automatically make every failure the customer's fault.
For business customers only, to the extent permitted by applicable law, liability for consequential losses such as lost profit, missed performance revenue and business interruption is excluded. This exclusion does not apply to intentional misconduct or gross negligence by the Creator, or to liability that cannot lawfully be excluded. It is not imposed on consumers.
For all customers, mandatory rights and liabilities remain unaffected, including statutory consumer remedies and liabilities that cannot lawfully be excluded. No blanket “no liability under any circumstances” exclusion or consumer compensation cap at the purchase price is imposed. This section concerns Pieter's responsibility; it does not rewrite Payhip's separate contract.
12. Privacy
Order, payment and contact information is processed as described in the accompanying AbleTouch Privacy Notice and the relevant Payhip/Stripe notices. A copy can also be requested from abletouch.support@gmail.com. These terms do not constitute marketing consent. A purchase does not automatically subscribe you to a mailing list.
13. Changes and governing law
The version of these terms supplied for your purchase applies to that purchase. Changes published later do not retrospectively reduce your agreed rights.
Dutch law applies to AbleTouch-specific undertakings by Pieter, without purporting to change Payhip's stated governing law for its own purchase contract or deprive consumers of mandatory protections applicable in their country of habitual residence. Consumers retain access to the courts and dispute procedures available under mandatory law; no exclusive Dutch-court requirement is imposed by these AbleTouch terms.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. No provision is to be read as waiving mandatory rights.
