This includes but is not limited to:

• Free distribution
• Paid distribution
• Private sharing
• Commission use where files are transferred and not bought by said commissioner

The Head is licensed to you only. Unauthorized distribution is strictly prohibited.

Violation of this section may result in:

• Immediate termination of license

2. Follow both my TOS and the head creators TOS

Under no circumstance are you allowed to break the original creators TOS when purchasing a head edit from me.

The ORIGINAL head is licensed to you only.

Everything used in renders will always be credited in the description for your convenience.

2. Mandatory Credit

You must always give clear and visible credit to:

Credit must be included in but is not limited to:

• Avatar renders, asset renders for another asset being showcased, and anything retaining to using my assets must always be credited
• Product pages of an avatar using the asset
• Commission listings using the asset, if questioned what asset, you must link my shop or a direct link to the asset being used.
• Social media posts showcasing the model, if asked what asset that retains to my content must always be linked back to my shop or a direct link to the asset
• Any public display of models using the Assets

Credit must not be hidden, misleading, or removed under any circumstance.

Failure to provide proper credit is a violation of these Terms will result in an immediate blacklist and revoke of commercial and personal access to the content.

3. Permitted Usage

You are allowed to use the Assets on:

• Free models
• Public models
• Nitro models
• Personal/private models
• Commercial models
• Commissioned models

You may sell models that include the Assets, provided that:

• The Assets are not distributed as standalone files or by themselves
• Proper credit is given
• The Assets are embedded within a completed model

The Assets must remain part of a finished product and cannot be extracted or resold separately.

4. Alterations

You are allowed to:

• Retexture
• Slightly modify the mesh (EX, make a long sleeved into a short sleeved shirt)
• Add onto the existing mesh
• Optimize them for performance

You not are allowed to:

• Make the original mesh unrecognizable
• Take portions of the mesh apart and add onto another mesh and claim as your own

5. License Termination

Violation of these Terms will result in but is not limited to:

• Immediate revocation of your license, both commercial and personal
• Requirement to delete all copies of the Assets, including from backups, all drives, discord dumps, and any other form of still having access to the files
• Possible restriction from future purchases if there is continuous violation of my TOS

6. Agreement

By using the Assets, you acknowledge that:

• You have read and understood these Terms
• You agree to follow all rules stated above
• upon purchase of the assets you immediately agree to following these terms

• Asset mine assets from my completed models
• Claim the avatars as your own, you did not make it, you bought the avatar from me. in turn you must credit me
• gatekeep the avatar, aka not telling someone where they can also purchase the avatar themselves

This includes but is not limited to:

• Free distribution
• Paid distribution
• Private sharing
• Public clones
• Paid avatar uploads from a 3rd party

The avatars are licensed to you only. Unauthorized distribution is strictly prohibited.

You are not allowed under any circumstance allowed to make my avatars public, regardless of reason, if caught with any public avatars on your account, exception to having your own models public that YOU MADE, will result in an immediate revocation of the avatar being uploaded to your account. Thus the avatar will be deleted from your uploads and will result in a mass blacklist and report against you and your account.

To simplify, if someone bought my avatar, and someone else paid to have it uploaded to a different account, that is breaking my TOS. Offering it out freely, either on VRModeles or RipperStore is strictly against my TOS. Sharing the files to a friend is also against my TOS. Making my avatars public and have it be readily available to the public is against my TOS. Any of those that are found, you are breaking my TOS. If you did not buy it from me or download anything from my store directly, you are not allowed to use my content. I do not tolerate my TOS being broken you break it you get blacklisted.

Violation of this section may result in:

• Public blacklist notice
• Ban from the discord server
• Legal action where applicable

2. Mandatory Credit

You must always give clear and visible credit to:

JUST SAYING THE NAME IS NOT SUFFICIENT FOR CREDIT, YOU MUST TYPE OUT THE AVATARS NAME AND MY FULL NAME

Credit must be included in but is not limited to:

• Using the model in VRChat
• Using the model in TikTok videos/story posts, Instagram Reels/story, TikTok, Twitch, or Instagram streams, pictures being posted on social media
• Used in any promotional content, credit must always be displayed
• Do not gatekeep the avatar, aka, withholding where you bought the avatar, where the avatar can be found, and ignoring people upon request where the avatar is from

Credit must appear where it is clearly visible in the comment section, text on screen, or in the description of the video, picture collage, or tweet.

Regardless of what platform the avatar is being used on for social media posts. Credit must always be clearly shown somewhere where the view can easily find the content being related to me

3. Modified Avatars

You may:

• Recolor of hair, eyes, clothing, and accessories
• Texture Swap
• Optimize
• Addons such as clothing, accessories, species and more
• MINIMAL Re-sculpts of the head and body
• Ask a 3rd party to (for non-profit-paying someone) help with alterations granted if they own the model themselves along with the respective additions being added also being owned

You may NOT:

• Remove anything from the original avatar
• Swap out the head for a different head
• Swap out the body for a different body
• Make the avatar unrecognizable
• Pay for someone to make the edits for you

You must still credit BakaRosie as the original creator of the avatar.

You may not claim the Avatar, in whole or in part, as your own creation. You can claim that you have made alterations to the avatar to your liking.

I am in now way responsible is you break the model when making edits. If you are having trouble with adding onto the avatars, please seek out help either in the tickets or the help channel in the discord server.

4. Agreement

By using any Avatar created by BAKAROSIE, you confirm that:

• You understand the credit requirement
• You agree to always provide proper credit
• You accept that failure to credit violates these Terms
• You accept that in any violation of these terms will result in an immediate blacklist and revoked access to access any of my content that I publish

Terms of Service – Artificial Intelligence (AI) Usage Prohibition

By purchasing, downloading, commissioning, or using any avatar, model, asset, texture, mesh, design, or related content created by me, BakaRosie, you agree to the following terms regarding Artificial Intelligence (AI) usage.

To simplify, don't use ANY of my content for AI, I do not want any AI machine using my content to better it's output. It does not matter to me if it is a trend or not, do not use any of my content for AI related content. I will file a DMCA against you if you break this rule.

1. Absolute Prohibition on AI Usage

Use of my Avatars in connection with Artificial Intelligence systems is strictly prohibited under any circumstance.

This prohibition applies regardless of:

• Current industry trends
• Platform popularity
• Technological advancements
• Personal, commercial, or experimental intent

AI usage is not permitted, even if it is considered common practice elsewhere. Such as TikTok trends, if it involves AI usage of any kind, it is NOT permitted.

2. What Counts as AI Usage

AI usage includes, but is not limited to:

• Uploading the Avatar or any of its parts to AI training datasets
• Using the Avatar to train machine learning models
• Inputting the Avatar into image, model, or content generation tools
• Using the Avatar to create AI-generated derivatives
• Style training or replication using AI systems
• Feeding renders, textures, meshes, or files into AI tools for enhancement or alteration
• Using AI to replicate the design, likeness, structure, or artistic style

Both direct and indirect AI involvement is prohibited.

3. No Dataset Inclusion

You may not:

• Include the Avatar in public or private AI datasets
• Allow third parties to scrape, scan, or process the Avatar for AI purposes
• Use the Avatar in automated data collection systems

Even temporary or “testing” use in AI systems is forbidden.

4. No AI Derivatives

You may not create:

• AI-generated versions of the Avatar
• AI-modified edits of the Avatar
• AI-based redesigns inspired by or derived from the Avatar
• AI-generated assets trained on or referencing the Avatar

Manual editing is permitted only if it does not involve AI tools (unless separately authorized in writing).

5. Commercial & Non-Commercial Ban

This AI prohibition applies to:

• Personal projects
• Free models
• Public avatars
• Nitro models
• Commercial products
• Experimental/private research
• Academic or dataset research

There are no exceptions unless explicitly granted in written permission by BakaRosie.

6. Enforcement

Violation of this AI policy will result in:

• Immediate termination of your license
• Revocation of usage rights
• Mandatory deletion of all copies
• Possible blacklist from future purchases
• Potential legal action where applicable

7. Future Technologies

This prohibition extends to:

• Existing AI technologies
• Emerging AI systems
• Future automated or generative systems
• Any technology that replicates, learns from, or analyzes the Avatar through machine-driven processes

If a tool uses machine learning, neural networks, generative algorithms, or automated content synthesis, it falls under this restriction.

8. Agreement

By using any Avatar created by BakaRosie, you acknowledge and agree that:

• AI usage is strictly forbidden
• This rule applies regardless of trends or popularity
• Violating this section constitutes a serious breach of these Terms

1. VRChat-Only License

All assets and avatars are licensed exclusively for use within VRChat.

You are granted a non-exclusive, non-transferable, revocable license to use the assets solely for upload and use on the VRChat platform.

Use of the assets or avatars outside of VRChat is strictly prohibited.

All products were strictly made for VRChat usage.

To simplify, you're not allowed what-so-ever to re-sell my meshes for profit on any other platform. My content is strictly for VRChat and I will file any DMCA against anyone caught breaking this rule.

2. Prohibited Platforms & Uses

You may not use the Assets on or within:

• Other games or virtual worlds
• Other social VR platforms
• Game engines for redistribution
• Animation projects outside of VRChat
• Film, commercial, or promotional media unrelated to VRChat
• 3D marketplaces or asset stores thats NOT VRChat
• NFT or blockchain-related platforms such as GTA, Sims, and any other 3D game that allows importing your own content.
• Any other digital or physical product outside of VRChat

Exporting, converting, or adapting the Assets for other platforms is not allowed.

3. No Cross-Platform Conversion

You may not:

• Port the Assets to other engines or software for redistribution
• Convert file formats for use outside VRChat
• Modify rigs or structures for compatibility with other platforms
• Commission others to port the Assets elsewhere

Even private or personal off-platform use is strictly prohibited.

4. Commercial Use Limitation

If commercial use is permitted under separate terms, it still applies only within the VRChat ecosystem (such as selling VRChat-compatible avatars, if allowed).

Commercial use outside of VRChat is not permitted.

5. Violation & Enforcement

Any use of the Assets outside of VRChat constitutes a violation of this agreement and may result in:

• Immediate revocation of your license
• Mandatory deletion of all files
• Blacklisting from future purchases
• Potential legal action if behavior continues

6. Agreement

By using the Assets, you confirm that:

• You understand they are licensed for VRChat use only
• You will not port or adapt them to other platforms
• You agree to comply fully with these platform restrictions
