1. Scope and Provider

These General Terms and Conditions apply to all orders placed via the online shop of STERNTAUCHER Filmproduktion GmbH, Schröderstiftweg 8, 20146 Hamburg, Germany; Managing Directors: Marina Kem and Oliver Neis; Email: web@sterntaucher-filmproduktion.de (hereinafter referred to as the "Seller"). The offer is directed at both consumers and entrepreneurs.

2. Conclusion of Contract

(1) Product presentations in the online shop serve as an invitation to submit a purchase offer. By clicking the "Buy now" button, you submit a binding purchase offer.

(2) In the case of physical goods (DVD/Blu-ray), the contract is concluded upon our declaration of acceptance or upon shipment of the goods. The confirmation of receipt of the order does not yet constitute acceptance.

(3) In the case of digital content (Video on Demand), the contract is concluded as soon as the access link or the stream is provided.

3. Special Conditions for Video on Demand (VoD)

(1) Usage Rights: Upon purchase of digital content, the Seller grants the customer a simple, non-transferable right to use the content exclusively for private use via streaming or (if offered) download.

(2) Restrictions: Commercial use, public screening, or sharing of access data with third parties is prohibited.

(3) System Requirements: The customer is responsible for providing the necessary hardware and internet connection required to access the digital content.

4. Youth Protection (FSK)

(1) The Seller only delivers goods subject to youth protection regulations to persons of legal age.

(2) By submitting the order, the customer assures that they have reached the minimum required age.

(3) For goods with an age rating of 18 years or older, delivery may be carried out via a shipping method involving identity and age verification.

5. Prices and Shipping Costs

(1) Prices are final prices including the applicable statutory value-added tax (VAT).

(2) Shipping costs only apply to physical goods and are displayed during the ordering process. Digital content is provided free of shipping costs.

6. Payment Terms and Retention of Title

(1) Payment may be made via direct debit or PayPal.

(2) In the case of physical goods, the goods remain the property of the Seller until full payment has been received.

7. Right of Withdrawal and Expiration of the Right of Withdrawal

Special note for digital content: The right of withdrawal expires prematurely for contracts regarding digital content if the customer has expressly agreed that the Seller shall begin execution of the contract before the expiry of the withdrawal period, and the customer has confirmed that they lose their right of withdrawal by giving such consent.

8. Warranty and Update Obligation

(1) Statutory warranty rights apply.

(2) For digital products, the Seller fulfills the statutory update obligation (§ 327f BGB / German Civil Code), provided this is necessary to maintain the conformity of the product (e.g., security updates).

9. Liability

The Seller is liable without limitation for intent and gross negligence. In the event of slight negligence, the Seller is only liable for the breach of an essential contractual obligation (cardinal obligation).

11. Online Dispute Resolution (ODR Platform)

The EU Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

12. Final Provisions

German law shall apply. If the customer is a merchant (Kaufmann), the place of jurisdiction is Hamburg.
