Programme | Effective from date of publication These Terms and Conditions of Sale ("Terms") govern the purchase of digital products, including but not limited to the C.R.E.A.T.E. manual series, from Coachall, operated by Spencer Hall ("we", "us", "our"), via www.coachall.co.uk and any third-party platform through which our products are made available (the "Platform"). By placing an order, you ("the Customer") agree to be bound by these Terms. 1. Who We Are Coachall is operated by Spencer Hall, trading from Brighton, United Kingdom. You can contact us at spencer@coachall.co.uk for any question relating to an order, a product, or these Terms. 2. Our Products Our products are digital downloads delivered electronically, comprising PDF and/or Word document files (the "Digital Content"). No physical product is shipped. Product descriptions and previews are provided in good faith; minor variations in formatting, page count, or layout between the preview and the delivered file may occur and do not constitute a material defect. 3. Nature of the Content Our manuals are personal and professional development resources intended for educational, motivational and self-directed reflective use. They are not medical, psychological, psychiatric, therapeutic, legal or financial advice, and do not constitute or replace a coaching, therapeutic or clinical relationship. Full disclaimers specific to each manual are contained within the product itself and form part of these Terms by reference. 4. Price and Payment All prices are displayed in the currency shown at checkout and are inclusive of any applicable taxes unless stated otherwise. Payment is taken in full at the time of order via the payment methods made available on the Platform. We reserve the right to change prices at any time; changes will not affect orders already placed. 5. Delivery Digital Content is delivered electronically, typically by immediate download link or by email, upon successful payment. It is the Customer's responsibility to ensure the email address provided is correct and that any spam or junk filters do not block delivery. If a download link fails or a file is corrupted, contact spencer@coachall.co.uk and a replacement will be issued at no charge. 6. Your Right to Cancel and Refunds Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers ordinarily have a 14-day right to cancel an order for digital content. However, this right is lost once download of the content begins, provided that: (a) you have given your prior express consent to the immediate delivery of the content, and (b) you have acknowledged that you thereby lose your right of cancellation. At checkout, you will be asked to confirm both of these points before your order is completed. By doing so, you agree that your statutory cancellation right ends once the download begins. Page 1 of 2 COACHALL | www.coachall.co.uk COACHALL | Terms and Conditions of Sale www.coachall.co.uk Outside of this statutory right, refunds are not offered for digital products once delivered, save where the Digital Content is found to be materially faulty (for example, corrupted, incomplete, or substantially different from its description), in which case we will either provide a replacement file or, where that is not possible, a refund. Refund requests on this basis should be sent to spencer@coachall.co.uk within 14 days of purchase. Nothing in these Terms affects your other statutory rights as a consumer under the Consumer Rights Act 2015. 7. Intellectual Property All Digital Content, including but not limited to the C.R.E.A.T.E. framework, manual content, methodology and branding, remains the exclusive intellectual property of Spencer Hall. Purchase of a manual grants the Customer a personal, non-transferable licence to use the Digital Content for their own private, non-commercial use only. Reproduction, resale, redistribution, public sharing or commercial use of any part of the Digital Content without prior written permission is strictly prohibited and may constitute copyright infringement. 8. Limitation of Liability To the fullest extent permitted by law, our liability to you in connection with any product purchased is limited to the price paid for that product. We do not exclude or limit liability for death or personal injury caused by negligence, for fraud, or for any other liability which cannot lawfully be excluded or limited under English law. Participation in any programme, course or exercise described within our Digital Content is undertaken entirely at the Customer's own risk, as set out in the medical and professional disclaimers contained within each manual. 9. Complaints If you are unhappy with your purchase or experience for any reason, please contact spencer@coachall.co.uk in the first instance. We aim to respond to all queries within 5 working days. 10. Governing Law These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms or any purchase shall be subject to the exclusive jurisdiction of the courts of England and Wales.
