Terms of Service

Dear Customer,

Before the purchase of our products or services we require you to read and accept our Terms of Service. By purchasing Gamepasses or Products you accept the Terms of Service. In this document you may find our Terms of Service & further Rules.

Payment and 3rd Party Procedures

1. By purchasing the product customers automatically agree to the ToS and to this purchase contract.
2. a) The customer is told to read the ToS before purchase, It is the customer’s responsibility to read and understand these Terms before purchasing. We are happy to help with inquiries regarding our ToS. We are not liable if the customer has not read the ToS.
3. Payments are made with Stripe; you may find their ToS here.
4. a) We will help you with any issues in regards to payment. If we are not able to help, we will redirect you to the Stripe Customer Service.
5. DuckTech SecurePay, with our SecurePay program we will refund if your product has not arrived or your pre-order has been cancelled.

1. DuckTech uses Payhip to offer products in the EUR currency.

a) See the Payhip ToS here.

1. When purchasing in EUR the conversion is following: 1 R$ = 0.013€

a) The conversion rate may be changed due to currency rates. Customers will be informed about price changes.

License & Product Ownership

1. When a customer purchases the product they purchase the license to use that product. A license to use our digital product. Without a valid license the product (if scripted) will not work.

a) A license may be revoked when the ToS are broken, or the user breaches the License Agreement. See the License Agreement here.

b) When a user purchases a license it may only be used for themselves or groups they own. The product may not be given to any other group or user to use in their group / project / game.

c) If a user wishes to use their license for another game they may do this by transferring products that can be transferred. Some products might not be able to be transferred due to whitelist matters.

d) Your license may be revoked and your account may be blacklisted when a rule break and leaked usage is found.

1. When you purchase a product you are not allowed to claim it as your own work. This is due to the respect to their original creators.

a) You may customize our products as you wish, but are still not allowed to claim the product as yours.

b) You are not allowed to take parts or sell modified products without a permission & resale license.

c) Re-distributing products is not allowed at all without a resale license or permission.

1. Free products are not allowed to be sold anywhere or redistributed.
2. a) Free product may not be re-published nor re-distributed at all times.

b) This does not change if the group name is published.

c) You may recommend DuckTech’s free products, but a re-distribution is not permitted.

Refund & License Transfer Policy

1. Purchases are final, there will be no refund for requests such as “I do not like the product, I didn’t mean to buy that product, I do not agree with the ToS”.

a) There only will be a refund if the product does not arrive or does not meet the quality of images & descriptions.

b) If you purchased a product and it doesn’t work after contacting Support you will get a refund if; the product doesn’t work for others as well, there is no issue found with the technical team, there will be no product fix.

1. Transfer of License are only allowed for scripted products, other products such as Assets are not allowed to be transferred.
2. a) Assets are Roblox Models that are not scripted or partially scripted that do not meet the requirement of a scripted product.

b) A transfer will only be accepted with a valid reason. The handling person will choose upon accepting the transfer.

c) Customers may only have one transfer per week. (7 Days)

License Agreement

1. When a user purchases a license they both agree to the ToS and the license Agreement.
2. With the license agreement you agree to the possibility of a license removal.
3. You agree that you are not allowed to distribute the product to any other individual.
4. Leaking parts or the whole of your product of which you purchased the license will result in a License removal and blacklist.
5. If a license is used without purchase it will be taken action and the user without license will be blacklisted. 

Service & Commission Policy

1. The customer that orders a commission only purchases the license for their commission. That means that the license of their digital graphic or service product may be revoked if necessary. 

a) The customer is not allowed to re-sale their commission order or re-distribute it. The commission may only be used for one group / project / game. Even if the customer owns different groups they may only use it for one.

1. Liveries may be sold in our pre-made livery category.

a) A livery will not be sold if the customer disagrees.

b) Custom liveries will not be sold.

c) Please tell us if you do not wish to have your livery sold.

d) A different version or new livery may be sold. It may be the same livery.

1. The payment has to be done before the start of your service.

a) We do not accept 50/50 payments, and not buy now pay later options.

b) A payment has to be proven for the commission handler to proceed with the commission.

1. Refund Policy regarding Services

a) There will be only a refund if the request meets these requirements:

   b) The product does not meet the DuckTech Quality Standard, if a High Rank Staff member confirms that the commission does not meet the DuckTech Quality Standards the full price will be refunded.

   c) There will be a refund if the commission handler cancels the commission. However there will be no refund if the user gets banned or blacklisted for a valid reason.

Other Terms

1. DuckTech will inform users of any updates or changes to these Terms.
2. Limitation of Liability: DuckTech is not responsible for any direct or indirect damages, losses, or issues resulting from the use or inability to use our products or services.
3. Eligibility: By purchasing, you confirm that you are legally allowed to enter this agreement or have permission from a parent/guardian.
4. DuckTech reserves the right to terminate access or licenses at any time if the Terms are violated.
