TERMS AND CONDITIONS

Agreement between FINANCIAL GURU (referred to as "Company") and Client



1. Purchase and Usage of Digital Products


This Agreement is entered into by and between FINANCIAL GURU (referred to as the "Company") and the purchaser of a digital product (hereafter referred to as the "Client") for the purpose of the Client acquiring a digital product known as "Promptlate" from the Company's online store (referred to as the "Product"). The Client agrees to the terms and conditions described below by either checking the designated box during the online shopping cart checkout or by making a payment for the Product.



1.1. Access to Digital Product


Upon purchasing the digital product, the Client will receive access to the product materials within 48 hours through a download link delivered to their provided email address. This EXCLUDES ANY PRE-LAUNCHES in which the product will become available upon the DATE STATED. The Client will retain access to these materials for an indefinite period as long as the Product remains available.


1.2. License for Product Usage


The Company grants the Client an exclusive, non-sublicensable, non-transferable license to use the Product. The Client acknowledges and agrees that the Product materials must not be shared with any third party. In the event the Company suspects unauthorized sharing of the Product, the Company reserves the right to immediately terminate the Client's access to the Product.


1.3. Permissible Usage


The Client may use the Product for PERSONAL USE ONLY!


2. Fees and Payment Processing


In exchange for access to the Product provided by the Company, the Client agrees to pay the fee specified during the online shopping cart checkout. In cases where a payment method is declined by the online payment processor, the Client must furnish an alternative eligible payment method before gaining access to the Product. If the Client has already accessed the Product and a payment method is declined, the Company reserves the right to collect any outstanding payments.


3. Refund Policy


Due to the immediate accessibility and/or Digital Nature of digital products upon purchase, no refunds for any fees or payments related to the Product will be granted under any circumstances.


4. Personal Information


To purchase the Product, the Client will be required to provide personal information, including their name, email address, mailing address, and billing address. The Client consents to the Company's use of this personal information for legitimate purposes. The Client is responsible for the accuracy of their provided information, ensuring the security of their data, and promptly updating the Company regarding any changes.


4.1. Billing Information


Billing information provided to the Company will be kept secure and subjected to confidentiality and accuracy requirements similar to the Client's personal information. Providing false or misleading information or engaging in fraudulent or unlawful activities while using the Product may result in the immediate termination of access.


5. Copyright


All content, materials, and digital products offered by FINANCIAL GURU are protected by copyright laws and international treaties. The reproduction, distribution, or public display of any part of our digital products without prior written permission from FINANCIAL GURU is strictly prohibited. Unauthorized use may subject individuals or entities to legal action and associated damages.

This includes, but is not limited to, the following:

  • Copying, sharing, or distributing our digital products to third parties.
  • Modifying, adapting, or altering our digital products.
  • Using our digital products for commercial purposes without explicit consent.

Any violation of our copyright will result in legal consequences. We actively monitor and enforce our copyrights.

FINANCIAL GURU reserves the right to modify or update these copyright terms as needed, and such changes will be effective immediately upon posting.

6. Warranties and Liability


The Company endeavors to ensure the accuracy and suitability of the Product for its customers. However, the Company does not accept responsibility for the Product's suitability. The Company provides no warranties, whether express, implied, or statutory, including but not limited to merchantability or fitness for a particular purpose. The Client agrees to indemnify the Company against liabilities, claims, expenses, costs, damages, or losses arising from a breach of these terms and conditions. The Company shall not be liable to the Client or any third party for consequential, indirect, special, or exemplary damages, including, but not limited to, loss of profits, business, or anticipated benefits, whether arising under tort, contract, negligence, or otherwise.


7. Force Majeure


In situations where the performance of this Agreement is hindered by factors beyond the reasonable control of the parties, including but not limited to natural disasters, acts of God, war, or similar conditions, the affected party shall be excused from fulfilling their obligations, provided they promptly notify the other party.


8. Guarantees


The Company does not guarantee specific results, including financial or personal gains, resulting from the Client's use of the Product. The Client acknowledges responsibility for their own outcomes when using the Product.


9. Release and Reasonable Expectations


The Client acknowledges that individual results using the Product may vary and that the Product is designed for a broad audience.


10. Entire Agreement


This Agreement represents the complete understanding between the parties, superseding any prior written or oral agreements. Any modifications to this Agreement must be in writing, signed by both parties and physically attached to the original Agreement.


11. Transfer


This Agreement cannot be transferred or assigned to a third party without the written consent of both parties.


12. Severability


If any part of this Agreement is deemed invalid or unenforceable, the remainder of the Agreement remains valid and enforceable. The failure to enforce a provision of this Agreement does not constitute a waiver of any other part or provision of the Agreement.

This revised Agreement is intended to clarify the terms and conditions between the Company and the Client without infringing on copyright.
