Private Security Marketing Insider / FULL ACCESS / Formacha Digital
By purchasing or accessing Private Security Marketing Insider ("the Product"), you ("the Buyer") agree to the following terms. If you do not agree, do not purchase or access the Product.
1. Product Description
Private Security Marketing Insider is a digital educational product consisting of marketing strategy modules, templates, scripts, guides, and related materials ("Content") delivered via online access. The Product is created and sold by Formacha Digital ("the Company," "we," "us").
2. License & Permitted Use
Upon purchase, you are granted a **single, non-exclusive, non-transferable, revocable license** to access and use the Content for your own business or personal education purposes.
**You MAY:**
- Use the templates, scripts, and materials for your own security company's marketing
- Modify provided templates for your own internal business use
- Access the Content on multiple personal devices
**You MAY NOT:**
- Resell, redistribute, share, sublicense, or give away the Product or any part of it — whether in its original form or modified
- Upload, repost, or publish any Content on any website, platform, course, membership, community, or file-sharing service
- Use the Product to create a competing product, course, training program, or consulting offer that incorporates our Content
- Share your login or access credentials with anyone outside your organization
- Claim authorship or ownership of any Content provided in the Product
Any unauthorized use constitutes a material breach of these Terms and will result in immediate revocation of access without refund.
3. Intellectual Property
All Content — including but not limited to text, video, templates, scripts, graphics, frameworks, strategies, and documentation — is the intellectual property of Formacha Digital and is protected by applicable copyright and intellectual property laws.
Purchasing the Product does not transfer ownership of any intellectual property. You are purchasing a license to use the materials, not the materials themselves.
4. Payment & Access
- The Product is sold as a one-time purchase at the price listed at checkout.
- Access is granted immediately upon successful payment.
- All prices are in USD unless otherwise stated.
- We reserve the right to change pricing at any time. Price changes do not affect existing purchases.
5. Refund Policy & Guarantee
Due to the digital nature of the Product and the fact that access is granted immediately upon purchase, **all sales are final**.
However, we offer an **"Implement & Profit" Results Guarantee**: if you implement at least three (3) strategies from the Product and do not generate a single qualified lead within sixty (60) days of purchase, you may contact us at team@formacha.io with documentation of your implementation (including campaign screenshots and relevant data). We will personally review your setup and provide guidance to help you achieve results.
This guarantee is a **service commitment**, not a money-back guarantee. It requires documented good-faith effort and implementation on your part.
6. Earnings & Results Disclaimer
The Product contains marketing strategies, case studies, and educational content. **Results vary.** We do not guarantee any specific revenue, leads, contracts, or business outcomes.
Any case studies, figures, or results referenced in our marketing materials or within the Product represent individual outcomes and are not a guarantee or promise of similar results. Your results depend on many factors including but not limited to: your market, your effort, your existing business, your ad budget, and your implementation.
Nothing in the Product constitutes financial, legal, or professional advice.
7. Limitation of Liability
To the fullest extent permitted by law:
- The Company's total liability to you for any claim arising from or related to the Product shall not exceed the amount you paid for the Product.
- The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost revenue, or lost business opportunities.
- The Product is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Indemnification
You agree to indemnify, defend, and hold harmless Formacha Digital, its owners, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Product, your breach of these Terms, or your violation of any third party's rights.
9. Account & Access
- You are responsible for maintaining the confidentiality of your access credentials.
- We reserve the right to suspend or terminate access to the Product at any time if we determine, in our sole discretion, that you have violated these Terms.
- Termination of access due to a breach of these Terms does not entitle you to a refund.
10. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes take effect immediately upon posting. Your continued access to the Product after any changes constitutes acceptance of the updated Terms.
11. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from these Terms or the Product shall be resolved in the courts located in the State of Oregon.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms constitute the entire agreement between you and Formacha Digital regarding the Product and supersede all prior agreements, representations, or understandings.
