1. Digital Product Nature

All products are digital downloads delivered as UnityPackages or other digital formats for use in VRChat or similar platforms. No physical items are shipped.

2. No Refund Policy

All sales are final. No refunds will be given for any reason.

Due to the digital nature of the products and immediate access granted upon purchase, we do not offer refunds, chargebacks, or exchanges under any circumstances. You are responsible for reviewing product details before purchasing.

3. Usage License

Your purchase grants you a non-transferable, non-commercial personal license to use the avatar or asset as follows:

You may use the avatar or assets for:

• VRChat and similar virtual platforms.
• Streaming, VTubing, and creating monetized or non-monetized content (YouTube, Twitch, TikTok, etc.).
• Creating NSFW or adult content (images, videos, streams, etc.), as long as it complies with platform and legal rules.
• Personal customization for your own private use.

You may not:

• Resell, redistribute, or share the files in any form (even if edited).
• Upload to any public world, pedestal, or avatar pedestal accessible to others.
• Give the files or access to someone else, even for "editing" or "upload help."
• Claim any part of the product as your own creation.
• Use the assets commercially (e.g., in a game, app, or as part of your own avatar sale) unless the specific product explicitly allows commercial use.

4. Modifications

You are allowed to edit or customize the assets for personal use. Modified versions are still bound by this TOS — you may not share or distribute modified files.

5. Credits

If showcasing the avatar in content (e.g., YouTube, TikTok, VRChat Showcase), you are encouraged—but not required—to credit GaryAsparagus. Redistribution of the files is never allowed, even with credit.

6. Liability Disclaimer

GaryAsparagus is not liable for any damages, losses, or performance issues resulting from:

• Use or misuse of the product.
• Compatibility with VRChat updates or third-party tools.
• User-side editing or upload errors.

7. Support Policy

Support may be offered at our discretion, but we do not guarantee troubleshooting, especially for:

• Upload problems due to user modifications.
• Conflicts with third-party shaders or tools.
• Issues with non-official editing practices.

8. Policy Changes

We reserve the right to update these Terms of Service at any time. Continued use of our products constitutes your agreement to the current version of the TOS.
