GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. Seller Identification

These General Terms and Conditions of Sale are entered into between:

Brikoverse

Legal form: Sole Proprietorship

Hereinafter referred to as "the Seller".

And any person making a purchase via the Brikoverse website, hereinafter referred to as "the Customer".

2. Purpose

These GTC define the rights and obligations of the parties within the framework of the online sale of products offered by the Seller.

3. Products

The products offered are compatible building sets.

Unless explicitly stated otherwise:

These are not official products of registered trademarks.

They are neither affiliated with, sponsored by, nor endorsed by any third-party brand.

Any reference to a brand is for descriptive purposes only.

Products may be delivered:

In a plain box without a logo.

Or without the original retail box.

The absence of the official box does not constitute a defect.

Photographs are for illustrative purposes only.

4. Price

Prices are listed in euros (€).

The Seller reserves the right to change prices at any time, but the product will be invoiced at the price in effect at the time of the order.

5. Order

All orders constitute full and unreserved acceptance of these Terms and Conditions.

Failure to pay

Suspicion of fraud

6. Payment

Payment is made via the secure methods offered on the website (credit card, PayPal, etc.).

Transactions are secured through specialized service providers.

The Seller does not store any banking information.

7. Delivery

Products are delivered to the address provided by the Customer when placing the order.

The Seller cannot be held liable for delays attributable to the carrier or to force majeure.

If the Customer provides an incorrect address, the Customer will be responsible for the reshipping costs.

8. Right of Withdrawal

In accordance with French law, the Customer has 14 days from receipt to exercise their right of withdrawal.

Conditions:

The product must be returned complete and in good condition.

Return shipping costs are the responsibility of the Customer.

The refund will be issued within 14 days of receipt of the returned item.

The right of withdrawal does not apply to personalized products.

9. Refund

The refund will be issued via the same payment method used for the purchase.

No refund will be issued if:

The product is incomplete

The product is damaged by the Customer

10. Legal Guarantee

The products are covered by:

The legal guarantee of conformity

The guarantee against hidden defects

In the event of a defective product, the Customer must contact customer service.

11. Liability

The Seller shall not be held liable for:

Misuse of the product

Normal wear and tear

Incorrect assembly

12. Personal Data

Personal data is processed in accordance with the Privacy Policy available on the website.

The Customer may exercise their rights in accordance with the GDPR and contact the French Data Protection Authority (CNIL) in the event of a complaint.

13. Intellectual Property

All elements of the website remain the exclusive property of the Seller.

Any reproduction is prohibited without prior authorization.

14. Applicable Law and Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, an amicable solution will be sought first.

Failing that, the competent courts will be those of the jurisdiction where the Seller's registered office is located.

15. Specific Clause – Dropshipping Operation

The Seller operates using a dropshipping model.

As such:

The products offered for sale are not necessarily stored on the Seller's premises.

Orders may be shipped directly by suppliers or logistics partners located in France, Europe, or internationally.

The delivery times indicated are estimates only and may vary depending on the supplier and the country of shipment.

The Customer acknowledges and accepts that:

The packaging may be plain or different from the images shown.

Some products may be delivered without their original retail box.

The sender's name on the package may differ from the website name.

The Seller remains legally responsible for the proper performance of the contract in accordance with Article L.221-15 of the French Consumer Code.

In case of loss, damaged package or non-receipt, the Customer must contact customer service within 14 days from the estimated delivery date.
