These Terms & Conditions govern the purchase and use of digital products available through the MBCSound online store.
By purchasing, downloading, or using any product from MBCSound, you agree to be bound by these Terms & Conditions and the applicable product license.

2. Products
MBCSound sells digital music production products, including sample packs, drum samples, one-shots, loops, and other downloadable audio content.
All products are supplied exclusively in digital format. No physical products are shipped.
Product descriptions, included content, file formats, and other relevant information are provided on the corresponding product page before purchase.
3. Digital Delivery
After a successful purchase, the customer will receive access to the purchased digital product through the delivery system provided by Payhip.
The customer is responsible for providing a valid email address and ensuring that they have the necessary equipment, software, storage, and internet connection required to download and use the products.
MBCSound is not responsible for compatibility issues arising from the customer's hardware or software environment.
If you experience a problem accessing or downloading a purchased product, please contact hello@mbcsound.com and we will make reasonable efforts to assist you.
4. Pricing and Payment
All prices are displayed on the relevant product page before purchase.
Payments are processed through the payment methods made available by Payhip, including PayPal.
MBCSound reserves the right to change product prices at any time. Price changes will not affect orders that have already been completed.
Any applicable taxes, including VAT, will be handled in accordance with applicable legislation and the payment platform's checkout process.
5. License Grant
When you purchase a MBCSound sample pack, you receive a non-exclusive, worldwide, perpetual license to use the included audio samples in your own musical and audiovisual productions, subject to the restrictions set out in these Terms & Conditions.
The license allows you to use the samples in:
- Original songs and musical compositions.
- Beats and instrumental productions.
- Albums, EPs, singles, and mixtapes.
- Commercial and non-commercial productions.
- Film, television, video, games, podcasts, and other audiovisual projects.
- Live performances.
- Music released through streaming and digital distribution platforms.
- Commercial productions created for clients.
You may combine, edit, chop, process, pitch, stretch, resample, layer, or otherwise modify the samples as part of your own productions.
You may use the resulting productions commercially and may generate income from them.
6. No Exclusive Ownership of Individual Samples
Purchasing a MBCSound product does not grant you exclusive ownership of the individual samples.
The same samples may be licensed to other customers.
MBCSound retains all ownership and intellectual property rights in the original samples and in the sample packs, except where otherwise expressly stated.
7. Permitted Use
You may incorporate the samples into musical or audiovisual works and distribute those finished works commercially or non-commercially.
Once a sample has been incorporated into a substantially original production, the resulting production may be sold, licensed, distributed, monetised, performed, or otherwise exploited by you.
You do not need to credit MBCSound when using the samples in your productions, although credit is always appreciated.
8. Prohibited Use
You may not:
- Resell, redistribute, share, upload, or make available the original samples as standalone audio files.
- Sell or distribute the samples individually or as part of another sample pack, sound library, preset pack, construction kit, or similar product.
- Make the samples available for download, whether for free or for payment.
- Upload the original samples to sample-sharing websites, file-sharing services, cloud libraries, torrent sites, or similar platforms.
- Claim authorship or exclusive ownership of the original samples.
- Register the original, unmodified samples as your own copyrighted works.
- Use the samples in a way that allows third parties to extract or access the original audio files.
- Use the samples to create a competing sample library or sound-effects library.
The samples must form part of a larger, original production and must not be distributed in a manner that allows the original samples to be extracted or reused as standalone files.
9. Content ID and Automated Copyright Systems
You may use MBCSound samples in productions that are distributed through platforms such as YouTube, TikTok, Instagram, Facebook, streaming services, and other digital platforms.
However, you must not register the original MBCSound samples, or substantially unmodified samples, with automated copyright identification or fingerprinting systems such as YouTube Content ID or equivalent services.
If your distributor or rights-management service requires you to confirm that you own exclusive rights to all audio contained in a production, you are responsible for ensuring that your use of MBCSound samples complies with that service's requirements.
MBCSound does not grant exclusive rights to the individual samples.
10. Music Distribution and Royalties
You may commercially release music containing MBCSound samples through digital distributors and streaming platforms.
You retain the rights and royalties associated with your original contribution to the resulting production.
However, purchasing a sample pack does not transfer ownership of the underlying samples to you.
11. Use for Client Projects
You may use MBCSound samples in productions created for clients, including music produced for artists, companies, brands, films, advertisements, games, and other commercial projects.
The client may receive and commercially exploit the resulting production.
However, you may not transfer the sample license itself or provide the client with the original sample files separately from the finished production.
12. Sample Pack Creation and Redistribution
MBCSound samples may not be used as the primary content of another sample pack, sound library, construction kit, drum kit, loop pack, or similar product.
You may create derivative musical works using the samples, but the resulting product must not function primarily as a redistribution of the original samples.
13. Copyright and Intellectual Property
All original samples, recordings, sounds, artwork, text, logos, and other materials provided by MBCSound remain the intellectual property of MBCSound or their respective licensors.
Your purchase grants you a license to use the sounds under these Terms & Conditions. It does not constitute a transfer of copyright or ownership.
Nothing in these Terms & Conditions prevents you from owning or claiming the copyright in your own original musical compositions or recordings created using the samples, provided that your claim does not extend to the underlying MBCSound samples themselves.
14. No Warranty
MBCSound products are provided for use in music production and related creative applications.
While reasonable care is taken to ensure that products are correctly packaged and delivered, MBCSound does not guarantee that every product will meet every customer's particular creative, technical, or commercial requirements.
15. Refunds and Digital Content
Because MBCSound products are digital products that can be downloaded or accessed electronically, the right of withdrawal applicable to physical goods may be affected by the specific rules governing digital content.
Where permitted by applicable law, once the supply of digital content has begun with the customer's express consent and acknowledgement that this may affect their right of withdrawal, the customer may lose the statutory right of withdrawal.
Nothing in these Terms & Conditions limits any mandatory consumer rights that cannot legally be excluded.
If you experience a technical problem with a purchased product, cannot access the download, or receive an incomplete or corrupted file, please contact hello@mbcsound.com so that we can investigate and, where appropriate, provide a replacement or other appropriate solution.
16. Fraudulent or Unauthorised Use
MBCSound reserves the right to take appropriate action against unauthorised distribution, piracy, fraudulent purchases, chargebacks associated with legitimate purchases, or other misuse of its products.
Where legally permitted, access to products may be suspended or revoked in cases of serious or repeated violation of these Terms & Conditions.
17. Account and Purchase Information
Customers are responsible for providing accurate information when placing an order and for maintaining the security of any account or access credentials used to obtain their purchases.
MBCSound is not responsible for problems caused by incorrect customer information or unauthorised access resulting from the customer's failure to protect their credentials.
18. Third-Party Services
The MBCSound store uses third-party services including Payhip for e-commerce and digital product delivery and PayPal for payment processing.
The use of these services may also be subject to their respective terms and conditions.
MBCSound is not responsible for interruptions or failures caused exclusively by third-party services, although we will make reasonable efforts to assist customers where possible.
19. Changes to These Terms
MBCSound may update these Terms & Conditions from time to time to reflect changes to its products, services, business practices, or applicable legislation.
The version applicable to a purchase is the version in force at the time the order is completed.
The latest version will always be published on this page.
20. Applicable Law and Jurisdiction
These Terms & Conditions are governed by the laws of Spain and applicable European Union legislation.
Where the customer is a consumer, nothing in these Terms & Conditions affects any mandatory consumer protection rights or rules that apply to them under the laws of their country of residence.
Any disputes shall be subject to the jurisdiction applicable under mandatory consumer protection legislation.
