Terms and Conditions - Digital Downloads

Please carefully read and understand the following terms and conditions ("Agreement") before accessing or using our digital downloads. By accessing or using the digital downloads available from this website, you agree to be bound by these terms and enter into a legally binding contract with us.

1. Scope of Agreement

a. This Agreement governs all digital downloads, including but not limited to software, files, images, or any other downloadable content ("Digital Downloads") offered by Ashlyn Leidy.

2. All Sales are Final

a. All sales of Digital Downloads are final. Once you have made a purchase and the Digital Download has been successfully provided to you, no refunds or returns will be granted.

b. We strongly recommend that you review all available information, product descriptions, and samples (if provided) before making a purchase decision.

c. If you experience any issues with the Digital Download, please contact our support team (contact information provided below) for assistance.

3. Intellectual Property Rights

a. Ownership:

  i. All rights, title, and interest in and to the Digital Downloads and their respective intellectual property rights, including copyrights, trademarks, trade secrets, and any other proprietary rights, are and will remain the exclusive property of Ashlyn Leidy or its licensors.

  ii. You may access and use the Digital Downloads solely for your personal, non-commercial use in accordance with this Agreement.

b. Restrictions:

  i. You shall not:

   - Reproduce, distribute, or publicly display any Digital Downloads, in whole or in part, except as explicitly permitted by this Agreement.

   - Modify, adapt, translate, reverse engineer, or create derivative works based on the Digital Downloads unless specifically authorized in writing by Ashlyn Leidy.

   - Remove, alter, or obscure any copyright, trademark, or other proprietary notices or labels on or within the Digital Downloads.

4. Disclaimers and Limitation of Liability

a. Ashlyn Leidy provides Digital Downloads on an "as-is" and "as-available" basis. We do not make any warranties or representations, either expressed or implied, regarding the fitness for a particular purpose, or the accuracy, completeness, or reliability of any Digital Downloads.

b. Ashlyn Leidy shall not be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with the use or inability to use the Digital Downloads, even if we have been advised of the possibility of such damages.

5. Governing Law and Jurisdiction

a. This Agreement shall be governed by and interpreted in accordance with the laws of Colorado, without regard to its conflict of laws provisions.

b. Any dispute or claim arising out of or in relation to this Agreement will be subject to the exclusive jurisdiction of the courts in Colorado.

6. Modifications to Agreement

a. Ashlyn Leidy reserves the right to modify or update this Agreement at any time without prior notice. Changes will be effective immediately upon posting the revised Agreement on our website or app.

b. By continuing to access or use the Digital Downloads after any modifications to the Agreement, you agree to be bound by the revised terms.
