PEGASUS LEGAL TERMS AND POLICIES

By purchasing, accessing, or using our digital products and services, as processed through Payhip, you ("Customer") warrant that you have sufficient legal capacity or, if you lack such capacity (e.g., you are a minor by U.S. law), that you have obtained parental or guardian consent to agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Pegasus Company ("we," "us," "our"), hereafter referred to as “Pegasus,” governing the use of all digital products and services offered.


By completing a purchase, using our products, or accessing any of our associated services, you expressly acknowledge and agree that you have read, understood, and accepted these Terms in full. If you do not agree with these Terms as stated on this page, you must refrain from purchasing, using, or accessing our products and services.


We reserve the right to update, modify, or amend these Terms at any time, at our sole discretion. Any updates take effect 24 hours after notice has been provided via our Discord server and our official website. It is your responsibility to review these Terms periodically, and continued use of our products and services after such updates constitutes acceptance of the revised Terms, regardless of whether you have explicitly reviewed them.

1. TERMS OF SERVICE

1.1, AGREEMENT TO TERMS

  • Binding Contract: By accessing, purchasing, or using Pegasus products or services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (the "Agreement"), regardless of whether you have reviewed them in full. This Agreement constitutes a legally enforceable contract between you and Pegasus.
  • Acceptance: Acceptance is further confirmed through an affirmative action when completing a purchase through Payhip and reaffirmed when submitting a Product Access ticket for product access.
  • Exception: Minors by U.S. law, or individuals who are under 18 years old, under California Family Code § 6700, are permitted to enter legal contracts and reserve the right to freely disaffirm their agreement at any time until they become legal adults. If you are a minor by U.S. law, Pegasus reserves the right to revoke your access to our products at its sole discretion in the event that you disaffirm your agreement after a purchase. Pegasus will honor legally-required refunds in this instance, and this situation qualifies as a special circumstance for refunds. All requests for refunds must be initiated by the minor’s parent or guardian. The full process for Refunds is outlined in Group 3.

1.2, PRODUCT NATURE AND ACCESS RIGHTS

  • System Grant: Upon purchase of a system-based product, you are granted a non-exclusive, revocable, limited-use license to access and use our digital system solely on one designated Roblox account and one associated Discord account, in addition to access to product holder-exclusive communications. The designated Roblox account must own any associated experiences utilizing the product or, alternatively, must own the community under which such experiences are operated. This license does not confer ownership of the product nor the transferral of any associated intellectual property and remains subject to compliance with these Terms.
  • Asset Grant: Upon purchase of a non-system-based product, you are granted a non-exclusive, revocable, limited-use license to access and download our digital asset solely for your personal, non-transferable use as the purchasing Customer, in addition to access to product holder-exclusive communications. This license does not confer ownership of the product nor the transferral of any associated intellectual property and remains subject to compliance with these Terms.
  • Discord Membership: Access to any product holder-exclusive communications, including but not limited to updated files, and community and developer support, in addition to meeting the Terms outlined in Group 6, requires joining our Discord server and submitting a Product Access ticket for verification and approval.
  • Transferrals: You may request a system license transfer to a different Roblox and/or Discord account by submitting a new Product Access ticket. Upon Pegasus’ approval, the system license will be revoked from the original account and reassigned to the newly designated account. System license transfers are subject to Pegasus’ sole discretion and may be denied without explanation. Asset license transfers are not offered. All asset sales are final.
  • Restrictions: You are expressly prohibited from: (a) reselling, sublicensing, or otherwise transferring the product as your own; (b) reverse engineering, decompiling, creating derivative works of the product, or otherwise modifying the product in any manner, except for personal-use modifications that do not violate these Terms; (c) distributing, sharing, or otherwise providing unauthorized access to the product, including but not limited to uploading, sharing, or selling it on third-party platforms; (d) engaging in fraudulent transactions or abusing chargeback processes; (e) violating community guidelines set in our Discord server #rules channel. Attempting to bypass these restrictions through alternative means, including but not limited to exploiting game mechanics, custom scripts, or third-party software, will be considered a breach of contract. Any unauthorized modifications, including but not limited to those that alter, disable, or attempt to circumvent product features, security protocols, or licensing mechanisms are strictly prohibited and will be deemed a breach of these Terms.
  • Right to Revoke: Pegasus reserves the absolute right to revoke your access to our products at its sole discretion, including in the event of any breach of these Terms. Revocation may occur without prior notice, and Pegasus shall bear no liability for any losses incurred as a result. By agreeing to these Terms, you expressly waive any right to a refund or reimbursement in the event of a product access revocation due to a violation. Additionally, Pegasus reserves the right to take legal or remedial action for any breaches, including but not limited to enforcing intellectual property rights, restricting access to future purchases, and pursuing monetary relief.
  • Disclaimer: Pegasus does not guarantee uninterrupted access, availability, or error-free performance of its products. Service disruptions may occur due to external factors, including but not limited to Roblox platform issues, third-party service failures on Payhip, Roblox, Discord, or other associated third-party platforms, unforeseen technical difficulties, or Customer-end errors.

1.3, DISPUTE RESOLUTION

  • Arbitration Requirement: This Agreement shall be governed by the laws of the State of California and applicable U.S. Federal Law. All Customers, including international purchasers, agree to be bound by the laws of the State of California and applicable U.S. Federal Law. In jurisdictions where certain local laws or consumer rights conflict with these Terms, this Clause applies to the fullest extent allowed by local law or consumer rights. By agreeing to these Terms, you waive any right to pursue litigation, engage in class-action lawsuits, or participate in any group legal action against Pegasus. Any dispute, claim, or controversy arising under or in connection with this Agreement, and in concern to the product in the original condition it was provided in, shall be exclusively resolved through binding arbitration administered by the American Arbitration Association (“AAA”) or the International Centre for Dispute Resolution (“ICDR”) under its Commercial Arbitration Rules. The Customer is responsible for initiating claims through arbitration. All arbitration proceedings shall be governed by California law and applicable U.S. Federal Law, administered under the AAA or ICDR Rules, and conducted over remote hearings to reduce burdensome travel. Pegasus also maintains an optional informal dispute resolution process. The full process for Dispute Resolution is outlined in Group 7.

1.4, UPDATES AND AMENDMENTS

  • Right to Modify: Pegasus reserves the right to update, modify, or amend this Agreement at any time. All changes made are set to take effect after 24 hours from notification. It is the Customer’s responsibility to review these Terms periodically. Continued use of Pegasus services or products after an update takes effect constitutes acceptance of the revised Terms, regardless of whether the Customer has explicitly reviewed them.
  • Notification: All changes will be communicated via Discord announcements and a temporary website banner notification. Changes will be listed by Policy Groups and detailed briefly via Discord announcements. The website banner notification will last for a period of 72 hours. Significant changes will be communicated via Discord announcements using Discord @everyone pings. Significant changes will also be communicated with a 7-day website banner notification.

1.5, CONSEQUENCES UPON BREACH OF AGREEMENT

  • Breach: Any violation of these Terms will result in immediate product access revocation, removal from the Discord server, and may lead to legal action, depending on the severity of the violation. You will be notified individually via the Discord server in such cases. Lack of membership in the Discord server constitutes a violation of these Terms, as outlined under Group 6, and you will not be entitled to receive proper notification as a result. Revocation is final unless otherwise decided at the sole discretion of Pegasus. Upon product access revocation due to a breach of these Terms, Customers forfeit any right to a refund, reimbursement, or compensation of any kind.
  • Legal Recourse: Pegasus reserves the right to pursue all available legal remedies for any breaches of this Agreement. Legal remedies may include but are not limited to injunctive relief, statutory damages, and compensation for losses incurred due to the breach. Damages incurred due to a breach shall be determined based on financial loss, legal costs, and any demonstrable harm caused to Pegasus.

1.6 ADDITIONAL POLICIES

  • Basis: These Terms incorporate the following Policies by reference. By making a purchase, accessing our services, or using our products, you acknowledge that you have read, understood, and agreed to be legally bound by these Policies, regardless of whether you have read them in full. Violations of any of the following Policies may result in product access revocation, legal action, or other enforcement measures as outlined in the respective Policies.
  • Group 2: Privacy Policy, which outlines the collection, storage, and usage of your personal information, and outlines our data protection practices.
  • Group 3: Refund and Cancellation Policy, which outlines the conditions under which refunds and cancellations are granted.
  • Group 4: Limitation of Liability and Guarantees Policy, which defines the extent of Pegasus’ liability regarding product performances, service disruptions, and external factors.
  • Group 5: DMCA and Copyright Policy, which explains intellectual property rights, content ownership, and Pegasus’ copyright enforcement and compliance.
  • Group 6: Acceptable Use Policy, which outlines acceptable behaviors when using Pegasus products or services.
  • Group 7: Governing Law and Dispute Resolution Policy, which clarifies the legal jurisdiction governing all disputes and how to resolve any disputes, claims, or controversies.
  • Group 8: Customer Conduct and Content Policy, which outlines acceptable behaviors when interacting with Pegasus’ community and uploading any Customer Content to the Discord server.
  • Group 9: Security Measures Policy, which outlines Pegasus’ security measures and Customers’ rights concerning their data.
  • Group 10: Third-Party Links and Integrations Policy, which addresses interactions with third-party services, limiting Pegasus’ liability for disruptions or policy changes made by these third parties.
  • Group 11: Contact Information and Support Policy, which outlines how to reach Pegasus support and legal correspondence.

2. PRIVACY POLICY

2.1, DATA COLLECTION AND USAGE

  • Data Collected: Pegasus collects only the minimum necessary Personally Identifiable Information (PII) for account verification, fraud prevention purposes, and enforcement actions. This may include but is not limited to: (a) your PayPal email address, name, and city and country associated with the account; (b) your Discord username and ID number; (c) your Roblox username and ID number; (d) relevant Payhip receipt or transaction IDs.
  • Usage Limitation: We do not sell any of your data to third parties. Your data is primarily used for providing and supporting our services. Data is retained only for as long as necessary to fulfill these purposes but remains archived upon ticket closure. Archives are only accessed when needed to verify certain information that has been reported or for fulfilling any of the previously listed purposes. Requests for full data purges from archived tickets will be honored. Customers may submit a Store Support ticket to request this service.

2.2, THIRD-PARTY SERVICES AND PAYMENT PROCESSING

  • Payment Processing: All financial transactions are handled by third-party processors approved by Payhip (PayPal and Stripe). Pegasus does not store or process sensitive financial data.
  • Third-Party Disclosures: Our privacy practices comply with the policies of these third parties. Any financial disputes or claims, including those related to international law, should be directed to Payhip. Customers must follow Payhip’s dispute process before requesting any action from Pegasus, and we assume no liability for any financial losses or disputes arising from transactions processed by Payhip or its approved third-party providers.

2.3, CUSTOMER RIGHTS AND LEGAL COMPLIANCE

  • Data Access: To comply with and honor the California Consumer Privacy Act (CCPA), the European Union’s General Data Protection Regulation (GDPR), and other similar international laws, Customers may request access to screenshots of ticket archives containing their stored data and request its removal. Requests will be processed within 10 business days, and the Customer will be notified upon completion. Customers should note that if the removal of their data leads to the deletion of essential PII, the validity of their product access may become unverifiable in the future. In such cases, Customers must resubmit the necessary PII to restore product access, as outlined in Group 1.

3. REFUND AND CANCELLATION POLICY

3.1, NO REFUNDS

3.2, CHARGEBACK AND PAYMENT FRAUD

  • Fraud Prevention: Unauthorized chargebacks or fraudulent disputes will result in: (1) the immediate contesting of the chargeback via the payment processor; (2) the immediate revocation of your product access; (3) removal from the Discord server; (4) relevant legal action taken under the U.S. Computer Fraud and Abuse Act (CFAA) (18 USC 1030) and California Penal Code § 502, in addition to necessary reporting to relevant financial institutions and law enforcement agencies, depending on the severity and persistence of the unauthorized chargebacks or fraudulent disputes.
  • Enforcement: Any active dispute taking place will result in a temporary revocation of product access in addition to limitation of available communications. Limitation of available communications is established in the Discord server through the Limited Pending Action role, effectively restricting your access to the Discord server while retaining membership. You will be kept informed and updated through access to a Store Support ticket that also includes communications with relevant moderation staff. Former access will be reinstated only if the dispute is resolved in favor of Pegasus.
  • Third-Party Processing: Transactions are processed through Payhip, which supports PayPal and Stripe. Pegasus does not store or process sensitive financial data.

3.3, EXCEPTIONS AND REFUND ELIGIBILITY

  • Special Circumstances: Refunds are considered on a case-by-case basis through a Store Support ticket consultation in our Discord server. Approved refunds will not exceed the original purchase amount recorded by the payment processor. Please state any relevant special circumstances supported by substantial evidence when creating a Store Support ticket regarding this exception.
  • Resolution Process: Customers are expected to request support immediately via a Store Support ticket consultation to resolve any issue before attempting to initiate any chargeback. Failure to follow the guidance of this Clause may result in your chargeback attempt being interpreted as fraudulent regardless of its original intent.

4. LIMITATION OF LIABILITY AND WARRANTIES POLICY

4.1, NO WARRANTIES OR GUARANTEES

  • Basis: All products are provided on an “as-is” basis, without any express or implied warranties. Pegasus does not guarantee compatibility with future Roblox updates that alter the functionality of certain products within an experience.
  • Disclaimer: Pegasus disclaims any liability in instances that include but are not limited to: (a) Roblox account moderation actions resulting from inappropriate product use; (b) interruptions or performance issues arising from the development of your own experiences on the platform; (c) any damages resulting from but not limited to Customer error, improper product use, or actions by third-party programs integrated into your experiences.

4.2, LIMITATION OF LIABILITY

  • Liability Cap: Pegasus shall not be liable for any incidental, consequential, or indirect damages. Our Policies explicitly state that we assume no liability for Customer error or third-party violations. In jurisdictions where limitations on liability are restricted, this Clause applies to the fullest extent allowed by local law. Total liability shall not exceed the amount paid for the specific product that gave rise to the claim, and no incidental or consequential damages will be recoverable, equivalent to a refund of the recorded purchase transaction. We reserve the right to revoke your access to Pegasus products and services if we are held liable, as outlined in Group 1.

4.3, ADDITIONAL DISCLAIMERS

  • Force Majeure: Pegasus shall not be held liable for any failure or delay in performance due to causes beyond our reasonable control, as defined under Force Majeure. These causes include but are not limited to natural disasters, platform changes, unforeseen technological issues, acts of government regulation, platform suspensions, cyberattacks, changes to Payhip or Discord services, legal restrictions, or actions taken by Roblox that impact product access.
  • Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Survival: Provisions related to limitation of liability, intellectual property, and dispute resolution will survive the termination of this Agreement. These can be found in Groups 4, 5, and 7.
  • Compliance: Pegasus abides by other state laws in accordance with their exact provisions. If a properly issued and evidenced notice of rights infringement is received, we will take the necessary actions to ensure compliance with other state laws. Notices should include the bill text and official court orders, as appropriate, the primary concern or rights being infringed, and sufficient evidence to support the claim that the right is being infringed upon. Failure to follow the guidance of this Clause may result in your rights infringement notice remaining unaddressed or facing rejection due to a lack of proper validity or issuance.

5. DMCA AND COPYRIGHT POLICY

5.1, COPYRIGHT OWNERSHIP AND USAGE RESTRICTIONS

  • Intellectual Property: All digital products are the exclusive property of Pegasus and are protected under U.S. Copyright Law (Title 17, U.S. Code).
  • Exception: For select assets, Pegasus employs external developers. These developers agree to retain their original intellectual property rights and provide Pegasus with a non-exclusive, sublicensable white-label distribution license. These assets will be indicated as such in the product description.
  • Limited License: Purchasing our product grants you a limited-use license, with no rights to modify, resell, or redistribute the product, except for personal-use modifications, as defined under Group 1.

5.2, UNAUTHORIZED DISTRIBUTION

  • DMCA Process: In cases of unauthorized distribution or copyright infringement through any medium, including sharing in private Discord servers, social media, or direct messages, Pegasus will pursue Digital Millennium Copyright Act (DMCA) takedown notices against unauthorized distribution and infringement. Violations or refusals to comply may result in product access revocation, removal from the Discord server, and legal action under the CFAA (18 USC 1030) and California Civil Code § 980(a)(1), depending on the severity and persistence of the copyright infringement.
  • Compliance: Pegasus abides by the DMCA and will respond appropriately to valid DMCA takedown notices. If a properly issued and evidenced DMCA takedown notice is received, we will take necessary actions to remove or disable access to the infringing content. In order to comply with the DMCA, the notice must include specific information that includes but is not limited to: a description of the copyrighted material, the location of the infringing material, and sufficient evidence to support the claim of copyright infringement. Failure to follow the guidance of this Clause and the DMCA itself may result in your copyright notice remaining unaddressed or facing rejection due to a lack of proper validity or issuance. Pegasus reserves the right to revoke product access from the accounts of repeat infringers, in accordance with the DMCA’s provisions. This may occur without prior notice.

5.3, “BROKEN SPECIAL” INTERNATIONAL CONCERNS

  • Compliance: While our primary focus is not on international Customers, Pegasus welcomes Customers from all around the globe and will fully cooperate with relevant authorities regarding copyright enforcement. We abide by international laws in accordance with their exact provisions. If a properly issued and evidenced copyright infringement notice is received, we will take the necessary actions to ensure compliance with international copyright standards. Notices should include specific information, such as a description of the copyrighted material, the location of the infringing material, and sufficient evidence to support the claim of copyright infringement. Failure to follow the guidance of this Clause may result in your copyright notice remaining unaddressed or facing rejection due to a lack of proper validity or issuance.

6. ACCEPTABLE USE POLICY

6.1, PROHIBITED ACTIVITIES

  • Conduct: Customers must not engage in, including but not limited to: (a) reselling, sublicensing, or otherwise transferring the product as your own; (b) reverse engineering, decompiling, or otherwise modifying the product in any manner, except for personal-use modifications that do not violate these Terms; (c) illegally redistributing the product, including but not limited to sharing it with third parties; (d) engaging in fraudulent transactions or abusing chargeback processes; (e) violating community guidelines set in our Discord server #rules channel. For a more comprehensive list of restrictions and subsequent actions Pegasus will take, see Group 1.

6.2, DISCORD MEMBERSHIP

  • Access Condition: Access to our products requires a Product Access ticket to be made in our Discord server. It is the Customer’s responsibility to submit a Product Access ticket, as Pegasus does not grant access otherwise. Membership is expected to be retained in order to facilitate communications from Pegasus to the Customer, including but not limited to product updates, support, or for the purposes of enforcement actions.
  • Third-Party Disclosures: Our Policies comply with Discord’s Terms of Service and Community Guidelines. Violations will result in immediate moderation action at the sole discretion of Pegasus’ moderation staff.

7. GOVERNING LAW AND DISPUTE RESOLUTION POLICY

7.1, LEGAL JURISDICTION

  • Jurisdiction: This Agreement shall be governed by the laws of the State of California and applicable U.S. Federal Law. All Customers, including international purchasers, agree to be bound by the laws of the State of California and applicable U.S. Federal Law. By agreeing to these Terms, you waive any right to pursue litigation, engage in class-action lawsuits, or participate in any group legal action against Pegasus. In jurisdictions where certain local laws or consumer rights conflict with these Terms, this Clause applies to the fullest extent allowed by local law or consumer rights.

7.2, DISPUTE RESOLUTION

  • Informal Resolution: The Customer may elect informal dispute resolution before choosing to pursue binding arbitration. A written Notice of Dispute must be made through a Store Support ticket in the Discord server or to the Legal Inquiries email found in Group 11 describing the nature of the dispute and its factual basis. Upon receiving the Notice of Dispute, Pegasus will then agree to meet and confer in good faith. The time period for conferring will be set to last for 30 days upon Pegasus’ affirmation of receiving the Notice. If neither party is able to resolve the dispute within the given time period, all further pursuits will be redirected to this Policy and through binding arbitration.
  • Arbitration Requirement: All disputes, claims, or controversies arising under or in connection with this Agreement, and in concern to the product in the original condition it was provided in, shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. International Customers can consult the International Centre for Dispute Resolution (ICDR). The Customer is responsible for initiating claims through arbitration. All arbitration proceedings shall be governed by California law and applicable U.S. Federal Law, administered under the AAA or ICDR Rules, and conducted over remote hearings to reduce burdensome travel. By agreeing to these Terms, you agree that arbitration shall be the exclusive forum for dispute resolution, and you expressly waive any right to a jury trial in any jurisdiction.
  • Arbitration Fee Allocation: If the Customer chooses to initiate arbitration, the Customer will be responsible for any initial filing fee required. Both parties are individually responsible for their respective attorney’s fees. If any claim or dispute is determined to be frivolous or made in bad faith in the arbitration process, as determined by the arbitrator under the Rules of the AAA or ICDR, the Customer shall be responsible for all reasonable arbitration fees and associated costs as decided by the arbitrator. Conversely, if a dispute is found to be valid and substantiated by evidence presented during arbitration, Pegasus will assume responsibility for and reimburse all reasonable arbitration fees and associated costs as decided by the arbitrator. By default, Pegasus will agree to cover 50% of all arbitration fees and associated costs while the remainder will be the responsibility of the Customer.

7.3, INTERNATIONAL CONCERNS

  • Compliance: While our primary focus is not on international Customers, Pegasus welcomes Customers from all around the globe and will fully cooperate with relevant authorities. We abide by international laws in accordance with their exact provisions. If a properly issued and evidenced rights infringement notice is received, we will take the necessary actions to ensure compliance with international law. Notices should include the bill text and official court orders, as appropriate, the primary concern or rights being infringed, and sufficient evidence to support the claim of rights infringement. Failure to follow the guidance of this Clause may result in your rights infringement notice remaining unaddressed or facing rejection due to a lack of proper validity or issuance.

8. CUSTOMER CONDUCT AND CONTENT POLICY

8.1, EXPECTED BEHAVIOR

  • Acceptable Conduct: All Customers are expected to abide by the guidelines set forth in our Discord server #rules channel. Pegasus reserves the right to enforce these guidelines through moderation actions after review by our moderation staff, as outlined in the #rules channel, at its sole discretion.
  • Compliance: By agreeing to these Terms, Customers acknowledge their obligation to comply with all applicable local, state, and federal laws regarding online conduct. In the event that legal action is necessary, Pegasus reserves the right to cooperate with law enforcement agencies to address violations of the law.

8.2, CONTENT OWNERSHIP

  • Personal Liability: Any content uploaded by Customers to our Discord server, including but not limited to text, files, images, video, or audio ("Customer Content"), remains the intellectual property of the Customer. However, by uploading Customer Content to the Discord server, Customers grant Pegasus a non-exclusive, transferable, sublicensable, royalty-free license to display, reproduce, distribute, and archive such content for the sole purposes of support, moderation, and improvement of services.
  • Moderation: Customers may report inappropriate or harmful Customer Content within the community via General Support tickets, which will be reviewed by our moderation staff. If said Customer Content is found to violate these Terms or community guidelines, it may be removed, and the responsible Customer may face moderation actions. In cases of repeated violations, product access revocation and removal from the Discord server may be considered.

8.3, INTELLECTUAL PROPERTY

  • Liability Cap: By uploading Customer Content, Customers affirm that they hold the necessary rights to the content they share and that it does not infringe upon the rights of others, including intellectual property rights. Customers agree to indemnify and hold Pegasus harmless for any claims, damages, or legal actions arising from Customer Content uploaded by them.
  • DMCA Compliance: Pegasus abides by the DMCA and will respond appropriately to valid DMCA takedown notices. If a properly issued and evidenced DMCA takedown notice is received, we will take necessary actions to remove or disable access to the infringing content. In order to comply with the DMCA, the notice must include specific information that includes but is not limited to: a description of the copyrighted material, the location of the infringing material, and sufficient evidence to support the claim of copyright infringement. Failure to follow the guidance of this Clause and the DMCA itself may result in your copyright notice remaining unaddressed or facing rejection due to a lack of proper validity or issuance. Pegasus reserves the right to revoke product access from the accounts of repeat infringers, in accordance with the DMCA’s provisions. This may occur without prior notice. In addition, Pegasus will facilitate the issuance and response to a takedown notice via counter-notices if the Customer feels that they have been wrongly accused by providing the necessary information relevant to the original takedown notice. However, the Customer will take sole responsibility for all resultant counter-counter-claims, damages, or other legal remedies pursued. The full outline of DMCA Compliance is outlined in Group 5.

9. SECURITY MEASURES POLICY

9.1, DATA PROTECTION

  • Measures: Pegasus employs robust technical and organizational measures to protect Customer data, utilizing Discord’s roles and associated permissions system as well as external Discord bots such as the Tickets bot. No Customer data is stored in off-site clouds or servers. These measures are designed to prevent unauthorized access, disclosure, alteration, or destruction of Customer data.

9.2, SECURITY BREACHES

  • Breach Notification: In the event of a security breach that compromises Customer data, Pegasus will notify all Customers as soon as possible, in accordance with applicable laws and regulations. Relevant regulatory authorities will also be informed, as required under certain data protection laws, including the GDPR.
  • Vulnerabilities: If Customers become aware of any security vulnerabilities or issues within the Discord server, they are encouraged to report them by submitting a Store Support ticket. Pegasus will assess the issue and take appropriate action, including addressing the vulnerability and notifying affected Customers.

9.3, CUSTOMER RIGHTS AND LEGAL COMPLIANCE

  • Data Access: Pegasus complies with applicable data protection laws, including the CCPA and GDPR. Customers may exercise their rights under these laws as outlined in Group 2.

10. THIRD-PARTY LINKS AND INTEGRATIONS POLICY

10.1, EXTERNAL SERVICES DISCLAIMER

  • Links: Pegasus may provide links to third-party websites or services for the convenience of Customers. However, Pegasus is not responsible for the content, privacy practices, or terms of service of these external sites. Customers are encouraged to review the privacy policies and terms of service of any third-party websites or services they access through links from Pegasus.
  • Liability Cap: By using third-party services integrated with Pegasus, Customers agree to comply with the third parties’ terms and conditions and acknowledge that any disputes with such third parties are outside of Pegasus’ control. Customers agree to indemnify Pegasus from any liability arising from their use of third-party services.

10.2, INTEGRATION TERMS

  • Liability Cap: Use of third-party integrations, such as payment processors or external services, is subject to the terms and conditions of those third parties, including those authorized by Payhip. Pegasus is not responsible for any issues that arise from the use of third-party integrations, including but not limited to payment errors, technical problems, or data-sharing practices.
