1. Background

1.1 This license agreement ("Agreement") regulates the rules of using graphic works, including "3D Models" and other works made by the author ("TheDarkQ"), through the website http://payhip.com/TheDarkQ and its users ("Licensees") obtaining the right to download a certain number of digital files and use them in the form of files, in the manner specified in this agreement.

2. Grant of license

Licensor (“TheDarkQ”) represents that he or she has sufficient authority to enter into this agreement and to grant Licensee the rights set out herein. Standard and free licenses are offered.

2.1 Standard License (applies to all premium works)

2.1.1 Licensor (“TheDarkQ”) grants the Licensee a non-exclusive license, without time and territory limitations, to use the Works to the extent specified below.

2.1.2 All rights relating to the Works, in particular copyrights, remain the property of the licensor (“TheDarkQ”), its licensors, and the creators of the Works.

2.1.3 The licensor reserves the right to edit the license conditions at any time, informing the current licensees of any changes.

2.1.4 Restrictions on use

(a) Works may not be distributed by Licensees in any way, except for works that are free.

(b) Works may be modified as long as the author and characteristic elements representing the author of the work are preserved (e.g., subtitles with a visible logo of the author of the work.)

(c) The use of the works for advertising, promotion, and other marketing purposes or to endorse certain ideas is permitted under the standard license.

(d) The rights obtained under this agreement may not be transferred, assigned, or sublicensed.

(e) The license is unlimited towards time and territory.

(f) The Works may be used for commercial purposes, with the exception mentioned in 2.1.4 (a).

2.2 Free license (applies to all free Works)

2.2.1 Person (“TheDarkQ”) grants Licensee a non-exclusive license, without time or territory limitations, to use the Works to the extent set out below.

2.2.2 All rights relating to the Works, in particular copyrights, remain the property of the licensor (“TheDarkQ”), its licensors, and the creators of the Works.

2.2.3 The Licensor reserves the right to edit the license terms at any time, informing the current licensees of any changes.

2.2.4 Restrictions on use

(a) Works may be distributed free of charge only when the link to the original distributor is provided, in this case, http://payhip.com/TheDarkQ

(b) Works may be modified as long as the author and characteristic elements representing the author of the work are preserved (e.g., subtitles with a visible pseudonym of the author of the work.)

(c) The use of the works for the purpose of advertising, promotion, and other forms of marketing or endorsing certain ideas is allowed under conditions of a free license.

(d) The license is unlimited towards time and territory.

(e) The Works may not be used for commercial purposes.

3. Types of licenses

(a) standard license (applies to all paid works) - its conditions specified above in point 2.1 

(b) a free license (applies only to fully free works) - its conditions are specified above in point 2.2 

4. Granting and terminating the License

4.1 The license to use the Works is granted at the time of purchase or download of the Work.

4.2 In the event of a refund or due to problems with payment by the licensee, the license is canceled and further use of the work is prohibited.

5.Complaints

5.1 The fact that the Licensee does not use the granted rights does not entitle the Licensee to demand a refund.
