These Terms of Service represent a legally binding agreement between you (the "customer") and TopazHachets Work regarding your access to and use of VRChat avatars sold through Payhip. By purchasing any product, you acknowledge and agree to these Terms of Service. These terms may be updated at any time without notice.

 PAYMENTS

All payments are processed securely through Payhip.

Full payment is required at the time of purchase.

 DELIVERY

Since this is a digital product, files will be available for download immediately after purchase.

There are no deadlines or waiting periods.

 AVATAR UPDATES

Avatars may occasionally receive updates, such as bug fixes or improvements.

If an update is released, it will be made available to previous buyers through Payhip.

Access to updates is not guaranteed indefinitely, so it's recommended to download and back up your files upon purchase.

 INTELLECTUAL PROPERTY & LICENSING

All avatars and their assets are the intellectual property of TopazHachets Work, unless otherwise specified.

By purchasing a VRChat avatar, you are granted a non-exclusive, non-transferable, non-sublicensable, royalty-free, and revocable license to use the avatar for personal use, including monetized content.

You may:

Use the avatar for personal use within VRChat.

Customize the avatar for your own personal use.

Feature the avatar in videos, livestreams, and other content that earns revenue, as long as the avatar itself is not being sold or redistributed.

Share content featuring the avatar on platforms like Twitch, YouTube, TikTok, etc., with visible or credited attribution to TopazHachets Work.

You may not:

Resell, redistribute, reupload, or share the avatar or any of its parts—modified or unmodified.

Claim the avatar or any edited version as your own creation.

Upload the avatar to public pedestals or VRChat asset libraries.

Use the avatar or its assets in any way where the avatar is the primary product being monetized (e.g., selling files, kits, packages).

There are no commercial licenses for resale or redistribution. This license only permits personal use and content creation that may generate income.

This work is protected under U.S. Copyright Law, specifically the Copyright Act of 1976, Title 17 of the United States Code.

Violation of these terms will result in immediate revocation of your license and may result in legal action.

 REFUNDS

All sales are final.

Due to the nature of digital products, no refunds will be issued once the files have been downloaded.

If you experience any issues accessing your files or notice errors, please contact me and I will try to assist you.

PAYMENTS

Full Payment: 100% of the total amount due upfront.

REVISIONS

One revision is included. Additional revisions will incur extra fees.

DEADLINES AND DELIVERY

Commissions are typically completed within 3-4 days.

If you need the work sooner, a rush fee will apply.

INTELLECTUAL PROPERTY RIGHTS

I retain full copyright to the work unless otherwise agreed upon.

I may showcase the Work in my portfolio, on social media, or other platforms unless a private commission is requested.

REFUNDS

Refunds are only available before work begins.

Once the process has started, no refunds will be issued.

If I cancel the commission, a full refund will be provided.

COMMUNICATION

We will primarily communicate through VGen unless otherwise requested. Other available communication platforms include, Discord, or Instagram, progress updates on your commission.
