These Terms & Conditions govern the purchase and use of the digital product “A Grain of Sardinia”. By purchasing the product, you agree to these Terms & Conditions.

2. What is A Grain of Sardinia?
A Grain of Sardinia is a symbolic digital product created to represent a personal connection with Sardinia.
Following a successful purchase, the customer receives a unique Grain Number and a personalized digital certificate associated with that number.
The Grain Number is intended to uniquely identify the customer’s symbolic Grain within the A Grain of Sardinia project.
3. Symbolic nature of the product
A Grain of Sardinia is exclusively symbolic and digital.
The purchase does not constitute or transfer ownership, possession or any other legal right over land, real estate, beaches, sand, soil, natural resources or any portion of the territory of Sardinia or Italy.
The Grain Number and digital certificate are not deeds of ownership, land titles, public records or documents issued or recognized by any governmental or public authority.
No physical grain of sand, land or other physical object is transferred to the customer unless expressly stated otherwise in a specific product description.
4. Digital delivery
The product is supplied electronically.
After payment, the customer will receive access to the digital content and/or communications necessary to receive the unique Grain Number and personalized digital certificate.
Delivery times may occasionally be affected by technical problems, incorrect information supplied by the customer, email filtering or circumstances outside our reasonable control.
If the customer does not receive the digital product, they should contact us using the contact details provided on the website.
5. Customer information and personalization
The customer is responsible for providing accurate information when placing an order.
Where personalization is requested, the certificate will be generated using the information provided by the customer.
The customer must ensure that any name, message or other material submitted for personalization does not infringe third-party rights or contain unlawful, offensive or inappropriate material.
6. Price and payment
The applicable price is the price displayed at checkout at the time the order is placed.
Applicable taxes will be handled and displayed in accordance with the checkout and payment arrangements provided through the sales platform.
Payment processing may be performed by third-party payment providers subject to their respective terms and conditions.
7. Right of withdrawal and digital content
Where applicable consumer law provides a right of withdrawal, that right will be respected.
For digital content supplied without a tangible medium and made available immediately, the consumer may lose the right of withdrawal once performance has begun only where the legal requirements for such loss have been satisfied, including the consumer’s prior express consent to immediate performance and acknowledgement of the consequent loss of the right of withdrawal.
Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded.
8. Refunds and technical problems
Because A Grain of Sardinia is a personalized digital product, refunds are generally not available after the digital content has been supplied where the applicable legal requirements have been met.
This does not affect any mandatory statutory rights.
If the customer receives an incorrect, corrupted or inaccessible certificate, or if a technical error occurs in the assignment of the Grain Number, the customer should contact us so that the issue can be corrected.
9. Grain Numbers
Each Grain Number is generated and assigned according to the internal numbering system of A Grain of Sardinia.
A Grain Number identifies the corresponding symbolic digital registration within the project. It does not represent a financial instrument, investment, cryptocurrency, NFT, security, property title or ownership right.
The purchase of a Grain does not promise or guarantee any future financial value, appreciation or resale value.
10. Intellectual Property
Unless otherwise stated, all intellectual property rights relating to A Grain of Sardinia — including original texts, graphics, designs, certificates, branding, creative materials and website content — remain the property of their respective rights holder.
Purchasing a Grain grants the customer the right to retain and use their personalized certificate for personal, non-commercial purposes.
Purchase does not transfer copyright, trademark rights or other intellectual property rights in the A Grain of Sardinia project.
Unauthorized commercial reproduction, resale or exploitation of protected project materials is prohibited.
11. Limitation of liability
To the extent permitted by applicable law, Nuova Gia’ S.r.l. shall not be liable for indirect or consequential losses arising from the use of the digital product.
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.
12. Privacy
Personal data is processed in accordance with the Privacy Policy available on this website.
Personal data necessary for processing payments may also be processed by the e-commerce platform and relevant payment providers according to their respective privacy policies.
13. Changes to these Terms
These Terms may be updated when necessary to reflect changes to the product, services, business operations or applicable law.
The version applicable to a purchase is the version made available to the customer at the relevant time.
14. Applicable law
These Terms are governed by Italian law, without prejudice to any mandatory consumer protections applicable to customers residing in other jurisdictions.
For consumers residing in the European Union, any mandatory rights regarding jurisdiction and consumer protection remain unaffected.
