Some propositions in the original manual should be taught as claims to investigate rather than established law—for example, that an unanswered private affidavit automatically creates an enforceable judgment, or that silence by itself authorizes a UCC lien against another person's property. The UCC generally requires authorization to file an initial financing statement, such as authorization through an authenticated security agreement. A UCC-1 is fundamentally a notice of a claimed security interest, not itself the agreement creating the underlying obligation. And an actual judicial default judgment ordinarily requires the procedures prescribed by the applicable court rules rather than simply declaring a private correspondence unanswered.
