TOS FOR PURCHASE AND USE OF 3D MODELS

By purchasing, downloading, or using any 3D model from me (Zgakihiro), you (“Buyer”) agree to the following Terms of Service (“TOS”). Failure to comply may result in revocation of access, blacklisting from future purchases, and reports to relevant platforms, including VRChat and Discord where appropriate.

Note: These terms apply to standard purchases only. Commission work may be subject to separate agreements.

PURCHASE AGREEMENT

1.1.

All purchases are final. Due to the nature of digital products, refunds are not provided once the product has been downloaded, except where a refund or cancellation is required by applicable law.

1.2.

Payment must be completed in full before access to the product is granted.

1.3.

The purchase grants the Buyer a non-exclusive, non-transferable, single-user licence. Ownership of the model is not transferred to the Buyer.

1.4.

Licence keys, activation codes, access codes, download links, and any other method of accessing or activating the product are personal to the original Buyer and must not be shared, transferred, sold, gifted, published, or otherwise provided to any other person without prior written permission from Zgakihiro.

1.5.

Any use, sharing, transfer, or provision of a licence key or access method that allows any person other than the original Buyer to access, activate, download, or use the product is considered an unauthorised transfer of the licence and a breach of these Terms.

PERMITTED USE

2.1.

The Buyer may use the model for personal use only.

2.2.

Personal use includes:

Use in private avatars, including VRChat
Personal renders, images, or videos
Non-commercial content such as social media posts or showcases

2.3.

The following uses are strictly prohibited without prior written permission:

Any commercial use, including commissions, paid content, or monetised projects
Uploading the model to public avatars, worlds, or shared platforms where the model itself can be obtained
Sharing, transferring, or giving access to the files to any third party
Allowing another person to use the model or licence obtained by the Buyer

EDITS AND MODIFICATIONS

3.1.

Personal modifications are permitted for private use only.

3.2.

Modified or edited versions of the model may not be shared, distributed, uploaded, or resold under any circumstances without prior written permission.

3.3.

Any transfer, shared use, or exception must be explicitly approved in writing by me in advance so ownership and version tracking can be recorded.

3.4.

Unauthorised possession of the model, whether original or modified, may be treated as evidence of redistribution, unauthorised access, or a breach of these Terms where supported by credible evidence.

DISTRIBUTION RESTRICTIONS

4.1.

The Buyer must not upload, distribute, leak, or make the model available in any form, including but not limited to:

Asset-sharing websites
Discord servers
File-sharing platforms
Peer-to-peer services
Public or private repositories
Public VRChat content where the model or its assets can be extracted or obtained

4.2.

Reselling, sublicensing, gifting, transferring, or redistributing the model, whether free or paid, is strictly prohibited.

4.3.

The Buyer must not knowingly obtain, distribute, or use an unauthorised, leaked, ripped, or redistributed copy of my models or assets.

PROHIBITED CONDUCT

5.1.

The Buyer must not engage in, promote, facilitate, or knowingly participate in illegal, harmful, abusive, or otherwise prohibited conduct, whether or not such conduct involves, uses, references, or is carried out using any of my models or assets.

5.2.

The following conduct may result in revocation of access to my products and permanent blacklisting:

Ripping, copying, extracting, or obtaining my models or assets without permission
Sharing, leaking, redistributing, or selling my models or assets without permission
Knowingly purchasing, obtaining, distributing, or using leaked, ripped, stolen, or unauthorised copies of my models or assets
Harassment, threats, stalking, doxxing, or targeted abuse
Hate speech, hateful conduct, or discrimination
Sexual exploitation, grooming, sexualisation, or abuse of minors
Creating, possessing, distributing, or facilitating child sexual abuse material (CSAM)
Promoting, facilitating, or participating in illegal activity
Deliberately crashing, disrupting, exploiting, or interfering with VRChat, Discord, or other platforms or their users
Knowingly infringing upon another person's intellectual property or other legal rights

These restrictions apply regardless of whether the conduct involves my models, assets, products, or services.

5.3.

Conduct may be considered a violation of these Terms regardless of where it occurs, including VRChat, Discord, or other platforms, where there is credible and verifiable evidence connecting the Buyer to the prohibited conduct.

5.4.

I reserve the right to assess evidence and determine appropriate action on a case-by-case basis. Allegations alone do not automatically establish a violation of these Terms.

5.5.

Nothing in these Terms permits conduct that violates applicable law or the rules and policies of platforms on which the Buyer participates.

ENFORCEMENT

6.1.

Any violation of this TOS may result in:

Immediate revocation of access to all purchased products
Permanent blacklisting from future purchases
Cancellation or invalidation of associated licence keys or access credentials
Reports to relevant platforms, including VRChat or Discord, for investigation where appropriate
Further action to protect my intellectual property and products

6.2.

Where a licence key or access method has been shared, transferred, leaked, or otherwise compromised, I reserve the right to invalidate the affected key or access method without providing a replacement.

6.3.

If the Buyer is found responsible for redistribution, unauthorised access, infringement, or other serious violations, further action may be taken to recover damages or pursue other remedies where applicable and lawful.

PAYMENT & FRAUD PREVENTION

7.1.

Payments are accepted via PayPal unless otherwise stated.

7.2.

Fraudulent activity, including the use of stolen accounts, payment fraud, or false disputes, may result in immediate revocation of access and blacklisting.

7.3.

Fraudulent chargebacks or disputes may be challenged and escalated where necessary.

CREATOR RIGHTS

8.1.

I (Zgakihiro) retain full ownership and intellectual property rights in all models and associated assets unless otherwise stated in writing.

8.2.

The purchase of a model does not transfer ownership, copyright, or intellectual property rights to the Buyer.

8.3.

I reserve the right to use models, edits, or commissioned work for:

Portfolio display
Social media
Promotional purposes

unless a separate written agreement states otherwise.

GOVERNING LAW

This agreement is governed by the laws of England and Wales.

Nothing in these Terms is intended to remove or restrict any rights or protections that cannot legally be excluded or waived under applicable law.

AGREEMENT TO TERMS

By purchasing, downloading, or using any of my models, you confirm that you have read, understood, and agreed to these Terms.

T.O.S. is subject to change.

Changes to these Terms will apply to future purchases unless otherwise required by applicable law or expressly stated.
