APPRAISAL OF THE PRINCIPLE OF CONFIDENTIALITY IN ARBITRATION AND MEDIATION MECHANISMS OF ALTERNATIVE DISPUTE RESOLUTIONS
The present study is aimed at investigating the principles of confidentiality in different alternative dispute settlement procedures with the emphasis placed on the mini-trial. To that end, in addition to studying a number of international documents and regulations, the internal law is explored in the present study. The research methodology principally revolves around the traditional doctrinal approach and resorts to different interpretive techniques.
The specific objectives of this research project are to examine the concept of confidentiality in arbitration and mediation mechanisms of alternative dispute resolution; to evaluate the effectiveness of confidentiality in facilitating open and honest communication between the parties involved in ADR processes; to analyze the impact of confidentiality on the outcomes of arbitration and mediation, including the final decisions or settlements reached. This research consists of a title page, approval page, certification, abstract, list of abbreviations, list of cases, list of status, Chapters One to Five (from introduction to conclusion), and bibliography.
