Credit

You are prohibited from removing credit off of or claiming to be the creator of my products. Proper credit must be given via name (eepy.coco) or link (linktree for general credit or link the product page per used product).

File Sharing/Reselling/Redistribution & Customization

You are responsible for your files.

• If any product content is leaked under your possession, no matter how or who leaked it, you will be held accountable as this is a violation of my ToS.

⋆ You are permitted to:

• Edit/alter product textures to your liking for personal use.
• Edit/alter my products for personal use.
• Share/Sell/Redistribute custom clothes or addons for my products, provided, it doesn't include any of the original product files and the original product is linked/credited.
• Share/Sell/Redistribute texture files (e.g. PNGs/JPEGs/PDFs, SPPs, PSDs, etc) sourced from my products IF you to personalize or modify the textures to appear significantly different from the original asset's design.

⋆ You are prohibited from:

• Sharing/Reselling/Redistributing any files contained within my products (including altered ones) unless both parties legally own the product(s) and permission is given by all creators who's products are involved (including myself).
• Ripping any files from my products (including altered ones).
• Use my product's contents for commercial purposes unless it is explicitly stated in the product description.

Licensing & Gifting

• All product contents are licensed for personal use only and are to be accessed solely by you.
• In the case a product is gifted upon purchase, within the checkout process, the gift recipient holds the license for said purchased product.
• You may not gift my products after they are purchased.
• If the purchaser of a gifted product also wants access to the files, they must buy a separate copy for themselves.

Commissions

Any commissions involving my products require both parties to legally own the respective product(s).

Within this condition, between only you and your commissioning client:

⋆ You may share:

• Texture files.
• Material files.
• Edited FBX.
• Edited Blender file.
• Unity package/project

⋆ You may NOT share:

• Anything not legally owned by both parties.

Uploading

• You must have basic knowledge of Unity to upload your avatar.
• All my products are allowed to be used on/for public/cloneable or private avatars unless specified otherwise in their description. (VRCHAT/CHILLOUT/RESONITE ONLY)
• Uploading avatars containing any of my products for others is only permitted if both parties legally own the respective product(s).
• Having someone else upload anything for you containing any of my products is only permitted if both parties legally own the respective product(s).

Content Creation & Media

Use of my products for streaming and video creation is permitted for personal and monetized content, however, using my products for commercial purposes is prohibited.

⋆ Use and/or inclusion of my products is also prohibited within:

• Promoting hateful/discriminatory/dehumanizing and/or illegal content (racism, hate speech, homophobia, etc).
• Any AI content and/or production, including feeding my products into AI in any way.
• Any relation, content, and/or production of NFTs (Non-Fungible Tokens), including blockchain projects and crypto-based promotions.

Age Requirements

• Anyone under the age of 18 is prohibited from including my products in any form of adult content.
• By purchasing any of my products, you are confirming that you are legally permitted to access and use this content in your country/region and are either at least 18 years of age or, if you are under the age of 18, have your legal guardian's consent.

Character Claims

⋆ You are permitted to:

• Create an OC (original character) using my avatar as a base. This includes applying your original design to an avatar I release.

⋆ You are prohibited from:

• Claiming a purchasable texture or public/cloneable avatar I release as your own.
• Selling, adopting out, or commercializing any design/character I release without my explicit permission.

My "General" ToS above applies to commissions as well.

General

• Both parties must follow the terms of service for all avatars/assets involved in the commission. This includes both parties legally owning the avatars/assets.
• If the commission is for an avatar base I do not currently own, the price of said avatar will be covered in commission.
• I reserve the right to use my commission work as examples of my work, including within my portfolio, unless discussed otherwise.
• You may edit texture commissions for personal use only.
• Redistribution or public uploads of edited versions is prohibited.
• I have the right to terminate commission working files after 6 months or less for storage purposes.

I will not take commissions...

• From anyone under 18 without parental consent. If parental consent is given, proof must be provided.
• Of design(s) that you do not own. If it isn’t your character or a purchased design, I have the right to refuse to do the commission.

Revisions & Changes of Commissions

• Revisions are allowed within reason. Excessive revisions may result in an extra fee.
• Once final approval for the commission work has been given, I am not obligated to make any changes.
• If you’re a previous client that has completed work by me, I can make future edits to the commissioned work with an additional price and if I still have the files used in the commission's creation.

Payment & Refunds

• Payment is required up front, in CAD or USD, via Paypal unless discussed beforehand.
• I will not start a commission until some form of payment has been received.
• If payment is pending for any reason, I have the right to work on other commissions in queue who have submitted payment.
• If payment has not been received, the commission will be terminated and may be removed after a certain period of time without notification.
• If a client has failed to communicate within a reasonable amount of time or communication has ended due to the client, I have the right to terminate the commission without notification and retain any payments made up to that point.
• If a client has failed to provide proper communication, refunds will not be provided.
• Once work has been started, no refunds will be given.
• If for some reason, I am unable to complete the commission due to complications on my end, a full refund will be issued.
