These Terms of Service ("Terms") govern your access to and use of fgraphicsVault (the "Store," "we," "us," or "our"), including all digital products, artwork, flash design packs, and reference illustrations made available for purchase through our storefront(s), including but not limited to Payhip and Lemon Squeezy ("the Platforms"). By purchasing, downloading, or otherwise accessing any product from the Store, you ("Customer," "you") agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Store or purchase any products.

## 1. About Our Products

fgraphicsVault sells **digital downloadable artwork**, including but not limited to traditional Japanese irezumi-style tattoo flash designs, illustration packs, and reference images. These products are intended for use by:

- Tattoo artists, as flash sheets, design reference, or a starting point for client work

- Illustrators and artists, for study, redrawing practice, and personal skill development

- Other creative or reference purposes as described on individual product pages

All products are delivered electronically as digital files (e.g., PDF, JPEG, PNG, or similar formats). **No physical products are shipped.**

## 2. License Grant

License & Legal Terms

You are granted a non-exclusive, non-transferable, perpetual license to use this artwork for personal and commercial projects, including professional tattooing, commissioned artwork, merchandise, apparel, publishing, print products, and related creative or business use.

Permitted Uses:

• Tattooing the design on clients

• Using the artwork in commissioned creative work

• Printing physical stencils, references, posters, canvases, apparel, and merchandise

• Modification, adaptation, recoloring, resizing, or compositional editing for the purpose of applying the design in a specific production context.

• Commercial sale of physical end products incorporating the artwork

Modified or derivative works substantially based on the original artwork remain subject to this license and do not transfer copyright ownership of the original artwork.

You may not:

• Claim authorship, exclusive ownership, or original creation of the artwork or derivative works substantially based on the original artwork

• Register the artwork or derivative works substantially based on the artwork for trademark, exclusive ownership, or exclusive intellectual property claims

• Resell, sublicense, redistribute, share, upload, or commercially distribute the original digital files as standalone assets

• Sell modified versions as competing digital products, stock assets, flash packs, clip art, downloadable resources, or resale collections

• Use the artwork or derivative works, including synthetic derivatives, for AI training, machine learning datasets, generative AI systems, LoRA training, model fine-tuning, or automated image-generation systems

• Use the artwork in unlawful, defamatory, or fraudulent contexts

• Use the artwork for mass industrial manufacturing or exclusive retail distribution without separate written licensing agreement with the original artist.

All copyrights and intellectual property rights in the original artwork remain with the original artist. This license grants usage rights only and does not transfer ownership rights of any kind.

This artwork is provided as-is without warranties or guarantees. The original artist makes no representations regarding third-party intellectual property claims and is not responsible for misuse or unauthorized use by others.

Attribution is appreciated but not required.

## 3. Purchases and Payment

All purchases are processed through our third-party payment and storefront platforms (Payhip and/or Lemon Squeezy). These platforms handle payment processing, and in some cases act as the Merchant of Record for your transaction, meaning your payment is processed and your transaction is legally administered by that platform, not directly by us.

By completing a purchase, you confirm that:

- You are at least 18 years old, or have permission from a parent or legal guardian to make the purchase

- The payment information you provide is accurate and you are authorized to use the chosen payment method

- You understand the product is a digital, instantly-delivered good (see our [Refund Policy] for details on this)

## 4. Delivery

Digital products are delivered via instant download immediately upon successful payment, through the relevant storefront platform (Payhip or Lemon Squeezy). It is your responsibility to:

- Provide a valid, monitored email address at checkout

- Download your files promptly and retain your own backup copies

- Contact us promptly if you do not receive access to your purchased files (see Section 6)

## 5. Prohibited Conduct

You agree not to:

- Attempt to defraud the Store, including through chargebacks for digital products you have already received and accessed

- Use automated systems (bots, scrapers) to access or download content from the Store

- Misrepresent your identity or purpose when contacting us

- Use purchased designs in a manner that violates applicable law, including using designs to create content that is unlawful, defamatory, or infringing on third-party rights

## 6. Technical Issues and Support

If you experience a technical problem with a purchase — such as a corrupted file, missing files, or an inability to access your download — contact us at **fgraphicsvault@proton.me** within **7 days** of purchase. We will work to resolve the issue, including re-sending files or providing a working copy, before any other remedy is considered.

## 7. Intellectual Property

All artwork, designs, branding, and content on the Store, except where explicitly licensed to you under Section 2, remain the exclusive property of fgraphicsVault. Unauthorized use, reproduction, or distribution of our artwork outside the scope of the license granted to you is a violation of these Terms and may constitute copyright infringement.

## 8. Disclaimer of Warranties

Products are provided "as is." While we make reasonable efforts to ensure files are accurate, complete, and free of defects, we do not guarantee that the products will be error-free, uninterrupted, or fit for any specific purpose beyond their general description on the product listing.

Designs are sold as **reference and flash artwork**. We do not guarantee outcomes related to how a design translates onto skin when tattooed, as this depends on the skill and judgment of the individual tattoo artist applying it.

## 9. Limitation of Liability

To the fullest extent permitted by applicable law, fgraphicsVault shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of, or inability to use, the purchased products. Our total liability for any claim related to a purchase shall not exceed the amount you paid for that specific product.

## 10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Store after changes are posted constitutes acceptance of the revised Terms.
