Final Sales and No Returns

• All sales are final. Once a purchase is made, no returns or refunds will be issued under any circumstances.
• I am not obligated to provide instruction on any software-related topics, including but not limited to Unity or Blender.

License Terms

• When purchasing any asset or avatar from my store, you are purchasing a personal license for use by a single individual only. You may not split the price or share the product between multiple parties.

Platform Restrictions

• You are not permitted to convert, transfer, or use my assets or avatars in any platform or game other than VRChat. This includes, but is not limited to, platforms such as Second Life, GTA, Any Sims Games, IMVU etc.

Required Technical Knowledge

• Unity knowledge is required for the use of avatars, and Blender knowledge is required for the use of assets. You are responsible for ensuring you have the necessary skills before purchasing any product.

Upload Restrictions

• Only you or authorized members of my server (such as my moderators) are allowed to upload my avatars onto your account.
• Uploads are free of charge, so there should be no issue with this process.
• If you wish for a friend to upload the asset or avatar for you, they must own the product and you must create a ticket prior to upload for me to confirm that they have the necessary rights to do so.

Liability Disclaimer

• I am not liable for any issues or damages resulting from modifications you make to the assets or avatars, including but not limited to errors, model breakage, or any other issues resulting from user alterations.
• If you violate the terms and conditions by failing to read or adhere to these rules, you may be banned from my store and community, and all rights to use my assets and avatars will be revoked.

No Responsibility for Violations

• I am not liable for any consequences that occur as a result of breaking the rules, including but not limited to account bans, loss of access to products, or any legal issues that arise from misuse.

However, these assets must be part of a completed project or model and cannot be used or redistributed as standalone products.

Attribution and Credit

• When using my assets, you are required to provide proper credit. This includes, at a minimum, a clear credit link to my shop in the description or credits of your project, whether it is for public, commercial, or private use. The credit must be easily visible and legible.

Prohibited Actions

• Reselling, redistributing, price-splitting or claiming the assets as your own is strictly prohibited. You may not give away, sell, or distribute these assets in their original form, modified or unmodified, in any way.
• You may not use my assets in a manner that violates the intellectual property rights of others or any applicable laws.

Technical Knowledge and Support

• You must have sufficient knowledge of Blender or Unity to use and implement the assets in your projects. I'm not required to provide support or guidance for implementing or editing the assets.

Discord Membership Requirement

• To use my products commercially, you must be a member of my official Discord server. Membership is required to ensure that you are informed of updates, support, and any changes to the Terms of Service.

Failure to Comply

• Failure to provide your Discord ID and VRChat username (or any relevant identification for your specific use case) when using the assets for commercial purposes will result in a ban from accessing and using my assets, as this constitutes a breach of these Terms of Service.
• Any violation of these Terms of Service may result in immediate action, including but not limited to account suspension, banning, or legal action. I reserve the right to issue a DMCA takedown against any infringing use of my assets, and I will pursue legal remedies as necessary.

Amendments to Terms

• These Terms of Service are subject to change at any time, with or without notice. It is your responsibility to review these terms periodically. Any changes will take effect immediately upon posting on my official website or Discord. Continued use of the assets after changes are posted constitutes your acceptance of the updated terms.

Governing Law

• These Terms of Service are governed by the laws of the jurisdiction in which I operate, and any disputes arising from these terms will be resolved in accordance with those laws.

Terms of Service for M0SH Models

By purchasing, downloading, or using any model or asset from me, you agree to be bound by the following Terms of Service (TOS). If you do not agree to these terms, you are prohibited from using the models.

Any violation of these terms will result in the immediate revocation of your rights to use the model and blacklisting from my server and future purchases.

1. Authorized Purchase Platform

The only authorized platform to purchase my models is payhip.com/m0shvr Any models obtained from other sources are not considered valid, and you do not hold the rights to use or claim ownership of the model.

2. Gift Purchases

If you are purchasing a model as a gift, you must use the "gift option" at checkout. You are required to provide both the recipient's Discord username and VRC username. Inaccurate or incomplete information may result in the revocation of the license to use the model.

3. Prohibited Activities

• Sharing, Leaking, and Trading: Sharing, leaking, trading, or engaging in price splitting of my models/assets is strictly prohibited. Sharing models for "testing" purposes is also not allowed.
• Public Uploads: My models are only permitted for private use. Uploading or distributing the models publicly is strictly forbidden and will result in action taken against your account.
• Model Parts & Edits: Taking parts from my models or editing them for redistribution is prohibited. You may only use assets purchased directly from the credited creator’s store/server. My edits to the asset are not permitted for reuse without explicit permission.
• Reselling or Claiming as Your Own: You are not permitted to resell, redistribute, or claim ownership of the models or any assets i may have edited myself under any circumstances.

4. Model Use for Streaming & Social Media

If you use my models for streaming or social media content, you must provide proper credit. Include a link to the model in the description or, for platforms like Instagram, Twitter, or TikTok, tag me in the caption. I appreciate seeing your content!

5. No Head/Body Swaps or Heavy Edits

• Head/Body Swaps: You are not permitted to swap the head or body of my models.
• Heavy Edits: Significant changes that make the model unrecognizable are prohibited. Minor clothing adjustments and texture/skin modifications are allowed.
• Allowed Modifications: Texture/color swaps and hair additions are permitted, provided they are within reasonable limits and maintain the integrity of the original model.

Feel free to open a ticket in my server if you are unsure wether the edits you've made are allowed!

6. Account Information & Accuracy

Providing incorrect Discord and VRC usernames during purchase will prevent you from making any future transactions and will result in the loss of rights to use the model. Ensure that all information is accurate and up-to-date.

7. Ownership and Attribution

• Ownership: Even if you heavily edit a model, you are required to credit me as the original creator. You may not claim my work as your own.
• Texture Credits: If you use my model to showcase textures, the texture creator must provide a direct link to the model used.

8. Use Restrictions

• VRChat Use Only: My models are licensed exclusively for use in VRChat. You are not permitted to use my models for any other platform or application.
• Head/Body Sculpt Restrictions: My head and body sculpts are exclusive to me. You are not permitted to use them for personal or commercial purposes.

9. Discord Server Ban Consequences

If you are banned from my Discord server, you lose all rights to use any of my products. You are no longer authorized to download, distribute, or utilize any models purchased from me.

10. Terms Modification

These Terms of Service are subject to change at any time. Any changes will be communicated accordingly, and you are responsible for reviewing and adhering to the most current version.

RENDER TERMS AND CONDITIONS

By commissioning or requesting a render using my model, you agree to the following terms. If you do not agree to these terms, you are prohibited from proceeding with the render.

Approval Required for Renders

• You must ask for my permission before commissioning a render of my model to any third party, even if it is not an official commission. This includes any render requests, whether or not the work is being done for personal or commercial use.

Render Collaboration

• Any render commission involving my model must be a collaboration between the individual who is commissioning the render and the person doing the actual rendering. This ensures that both parties involved are in agreement regarding the usage of the asset.

(Ex. of what I mean being but not restricted to, making sure you add the render artist as a collaborator on your post if possible on the platform it's being posted on)

Asset Distribution Restrictions

• You are not permitted to share or distribute the full package of the model (including the original files). Only the necessary FBX file and textures required for the render may be provided to the third party working on the render.

By downloading or using any free models from my server, you agree to the following terms. If you do not agree to these terms, you are prohibited from accessing or using the models.

1. Terms of Use for Free Models

• The Terms of Service for all models remain the same, regardless of whether they are free or paid. However, models made available for free on my server are explicitly server-bound, meaning they are only permitted for use by individuals who access them through my server.

1. Unauthorized Distribution or Use

• If you see my models offered for free outside of my server, it is a violation of my TOS. You have no rights to use, download, or distribute any models found in such unauthorized locations.

1. Unauthorized Model Access

• You are not permitted to enter my server, download any free models, and then leave the server. Engaging in this activity will result in an immediate ban from the server, and you will be blacklisted from accessing or using any of my models in the future.

1. Free Uploads in My Server

• We offer free uploads for models within my server. However, this privilege is strictly for users who follow the proper channels and adhere to the rules outlined in these Terms of Service.
