Terms and Conditions for the Purchase of Digital Content 

1. Scope and Contracting Parties

These General Terms and Conditions (hereinafter "Terms") apply to all contracts for the purchase of digital products (e.g., sketchnotes, e-books, guides, templates, courses) concluded between

(hereinafter "Seller") 

and the customer (hereinafter "Customer" or "Buyer") via the distribution platform Payhip. 

2. Subject Matter of the Contract and Product Availability 

  • The subject of the contract is the sale of digital content (data produced and supplied in digital form). The exact specifications and system requirements can be found in the respective product description. 
  • The digital content is provided either as an immediate download (e.g., PDF, PNG) or by granting access to an online platform (e.g., for online courses), depending on the product purchased. 

3. Formation of Contract 

  • The presentation of digital products on the Payhip sales page does not constitute a legally binding offer, but rather an invitation to place an order. 
  • By clicking the order button (e.g., "Buy Now", "Purchase", or "Place Order"), the Customer submits a binding offer to purchase. 
  • The contract is concluded as soon as the Seller, or the platform operator Payhip acting on behalf of the Seller, accepts the order by providing the download link or sending a confirmation e-mail. 

4. Prices, Payment, and Delivery 

  • The prices stated at the time of the order shall apply. Due to the small business status (Kleinunternehmerregelung) under Austrian tax law (§ 6 Abs. 1 Z 27 UStG), no VAT/turnover tax is charged or displayed by the Seller. 
  • Payment shall be processed using the payment methods provided by Payhip (e.g., PayPal, credit card via Stripe). 
  • Upon successful payment, the Customer will receive an e-mail containing a download link or access credentials for the purchased digital product. 

5. Terms of Use (Copyright & Intellectual Property) 

  • All digital products offered (sketchnotes, texts, artworks, graphics) are protected by copyright law. 
  • Unless stated otherwise in the product description, the Seller grants the Customer a simple, non-transferable, non-sublicensable, perpetual, and worldwide right to use the digital content exclusively for personal, non-commercial use. 
  • Any commercial use, reproduction, distribution to third parties, publication on the internet, or resale of the files (including modified versions) is strictly prohibited without the express prior written consent of the Seller. 

6. Right of Withdrawal for Digital Content 

  • Consumers residing within the European Union generally have a statutory right of withdrawal. 
  • Important notice regarding premature expiration: For contracts concerning the supply of digital content not delivered on a tangible medium (downloads/streams), the right of withdrawal expires prematurely if the Customer has expressly consented to the execution of the contract beginning before the end of the withdrawal period, and has acknowledged that they lose their right of withdrawal by giving this consent. 

7. Warranty and Liability 

  • Statutory warranty regulations under Austrian law shall apply. 
  • The Seller assumes no liability for the uninterrupted or error-free availability of the digital products, provided that the disruption lies within the sphere of the platform operator Payhip or the Customer's internet service provider. 

8. Governing Law and Severability 

  • These Terms shall be governed by and construed in accordance with the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence. 
  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
