Terms of Service

1. Acceptance of These Terms

These Terms of Service govern your access to and use of the Before They Call online Store and any digital product purchased from Kunkel Group, LLC.

By visiting the Store, completing a purchase, downloading a product, or using a product, you agree to these Terms of Service, the Privacy Policy, and the Refund Policy.

Do not purchase or use a product if you do not agree to these terms.


2. Store Operator

References to “Kunkel Group,” “we,” “us,” and “our” refer to Kunkel Group, LLC.


3. Eligibility and Authority

You must be legally able to enter into a binding agreement to purchase from the Store.

If you purchase on behalf of a company or other organization, you represent that you have authority to accept these terms on that organization’s behalf.


4. Digital Products

The Store sells downloadable business guides and related digital materials.

Product descriptions identify the contents, format, price, and intended use of each product. Minor formatting, design, or editorial differences that do not materially change the product do not constitute non-delivery or misrepresentation.

Products are delivered electronically. No physical product will be shipped unless explicitly stated.


5. Payment, Prices, and Taxes

Prices are displayed before checkout and may be changed at any time before purchase.

Payment is processed through Payhip, Stripe, and other available payment providers. You authorize the payment provider to charge the payment method selected at checkout.

You are responsible for applicable taxes, duties, bank fees, currency-conversion costs, and similar charges unless the checkout states that they are included.


6. Product Access and Delivery

After successful payment, Payhip normally provides a receipt, download page, or customer-account access.

You are responsible for:

  • Entering an accurate email address
  • Maintaining access to that email account
  • Downloading and securely storing your purchased files
  • Protecting your download links and customer-account credentials
  • Using compatible PDF-reading software and equipment

Product access is not guaranteed to remain available indefinitely. Keep a secure backup of purchased files.


7. License and Permitted Use

Purchasing a product gives the purchaser a limited, non-exclusive, revocable, non-transferable license to use the product for the purchaser’s own internal business or personal purposes.

A purchasing business may use the guide with employees or contractors participating in that business’s internal review, provided that:

  • The material remains within the purchasing business
  • It is not given to clients, customers, or unrelated companies
  • It is not posted publicly
  • It is not sold, sublicensed, or repackaged
  • Recipients do not retain or redistribute unauthorized copies

Ownership of the product and its intellectual property does not transfer to the purchaser.


8. Prohibited Uses

You may not:

  • Resell, redistribute, share, sublicense, or give away a product
  • Upload a product to a public or shared file repository
  • Post substantial portions online
  • Copy or reproduce a product for another company
  • Modify a product for resale
  • Use the product as the basis for a competing commercial guide, course, template, or service
  • Present the content as your own original work
  • Remove copyright notices or other ownership markings
  • Use Store content for unlawful, fraudulent, or abusive purposes
  • Attempt to bypass download limits or security controls
  • Use automated systems to scrape, copy, or harvest Store content

9. Intellectual Property

All Store content and products, including text, assessments, worksheets, scoring tools, graphics, layouts, product names, and original frameworks, are owned by or licensed to Kunkel Group, LLC and are protected by applicable intellectual-property laws.

“Before They Call” and related product titles identify products and services offered by Kunkel Group. No ownership or trademark rights are granted through a purchase.


10. Educational Information, Not Professional Advice

The products provide general business education, assessment tools, planning guidance, and practical recommendations.

They are not:

  • Legal advice
  • Financial or accounting advice
  • Tax advice
  • Cybersecurity advice
  • Technical search-engine consulting
  • Personalized marketing consulting
  • A substitute for advice from a qualified professional familiar with your business

Purchasing or using a guide does not create an advisor-client, consultant-client, attorney-client, fiduciary, or other professional relationship with Kunkel Group or Steve Kunkel.


11. No Guaranteed Results

Business, search, website, artificial-intelligence, marketing, and customer outcomes depend on many factors outside Kunkel Group’s control.

We do not guarantee:

  • Increased calls, leads, quotes, appointments, or sales
  • Improved search rankings
  • Specific AI-generated descriptions or summaries
  • Increased revenue or profitability
  • Customer acquisition or retention
  • A particular assessment score
  • That every recommendation will be appropriate for every business

You are responsible for deciding whether and how to apply the information.


12. Artificial Intelligence and Search Information

Search engines, AI systems, directories, review platforms, and digital tools change frequently.

Examples and recommendations concerning these services reflect general business principles and conditions that may change. You should independently verify current platform requirements before making significant technical, legal, or financial decisions.


13. Customer Responsibility

You are responsible for:

  • Evaluating the guide in the context of your business
  • Verifying facts and assumptions
  • Obtaining professional advice when appropriate
  • Reviewing changes before publishing them
  • Complying with laws, licenses, advertising rules, privacy requirements, and industry standards
  • Backing up your website, files, and business information
  • Deciding whether a recommendation is appropriate

Kunkel Group is not responsible for actions you take, fail to take, or direct another person to take based on the product.


14. Third-Party Platforms and Services

The Store relies on third-party providers, including Payhip and Stripe.

Kunkel Group does not control and is not responsible for:

  • Third-party outages
  • Payment-provider decisions
  • Bank or card declines
  • Third-party privacy practices
  • Platform changes
  • Browser or device incompatibility
  • Search-engine or AI-system behavior
  • External websites linked from the Store

Your use of third-party services may be governed by separate terms and policies.


15. Refunds

Purchases are governed by the Refund Policy published on the Store.

Digital product sales are generally final once access is provided, except for approved exceptions or where applicable law requires otherwise.


16. Product Changes and Availability

We may:

  • Update or correct products
  • Change Store content
  • Modify prices
  • Replace files with revised versions
  • Discontinue products
  • Limit access to address fraud, abuse, infringement, or payment disputes

A purchaser is not automatically entitled to future editions, new products, consulting support, or ongoing updates unless the product description expressly includes them.


17. Disclaimer of Warranties

To the maximum extent permitted by law, the Store and its products are provided “as is” and “as available.”

Kunkel Group disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.


18. Limitation of Liability

To the maximum extent permitted by law, Kunkel Group, Steve Kunkel, and their contractors or service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including:

  • Lost revenue
  • Lost profits
  • Lost business opportunities
  • Lost data
  • Website interruption
  • Reputational harm
  • Loss of customers
  • Costs of substitute services

To the maximum extent permitted by law, Kunkel Group’s total liability arising from a product will not exceed the amount you paid for the specific product giving rise to the claim.

Nothing in these terms excludes liability that cannot legally be excluded.


19. Governing Law and Venue

These Terms of Service are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights that apply where you live, disputes will be brought in the appropriate state or federal courts located in Travis County, Texas.

Before filing a legal claim, the parties agree to make a reasonable effort to resolve the issue through direct written communication.


20. Changes to These Terms

We may revise these Terms of Service when our products, Store, providers, or legal requirements change.

The revised terms apply to future Store use and purchases after they are posted. The effective date will be updated when material changes are made.


21. Severability

If any provision is found unenforceable, that provision will be limited or removed to the minimum extent necessary. The remaining provisions will continue in effect.


22. Entire Agreement

These Terms of Service, together with the Privacy Policy, Refund Policy, product description, and checkout terms, constitute the agreement concerning a Store purchase.
