About these Terms

These Terms and Conditions apply to purchases made through the EMDA HealthTech online store.

EMDA HealthTech is a trading name of EMDA PLUS Ltd, registered in England and Wales under company number 14806141, with its registered office at 50 Pembroke Road, London, England, W8 6NX.

By placing an order, you agree to these Terms. Nothing in these Terms excludes or limits statutory rights that cannot lawfully be excluded or limited.

Our products

EMDA HealthTech sells downloadable digital products, which may include planners, templates, checklists, guides, workbooks and educational resources.

Each product page describes that product’s principal features, format, intended audience, price and any relevant compatibility or usage requirements. Customers should review this information before purchasing.

Product previews are illustrative. The supplied product will correspond materially with its product-page description.

Health and medical information

Some products may contain general health or healthcare-related information. Such information is provided for educational, informational or organisational purposes only.

Products do not provide personalised medical advice, diagnosis, treatment, prescribing, monitoring or emergency care. Purchasing or using a product does not create a doctor–patient relationship with EMDA HealthTech, its founder, authors or contributors.

Customers must follow advice and instructions given by their own appropriately qualified healthcare professionals. Such instructions take priority over general information contained in any EMDA HealthTech product.

Do not delay seeking medical assistance because of information contained in a product. If you believe you may have a medical emergency, contact the appropriate emergency service immediately.

Orders and formation of the contract

Before submitting an order, you are responsible for checking:

• The product selected.

• The product description and intended use.

• The file format and compatibility information.

• The total price displayed at checkout.

• The email address entered for delivery.

Your order constitutes an offer to purchase. A contract is formed when payment is accepted and an order confirmation or download instruction is issued.

We may decline or cancel an order where reasonably necessary, including where there is a pricing or technical error, suspected fraud, misuse or a legal restriction. If we cancel an order after receiving payment, we will refund the amount paid unless the law permits otherwise.

Prices, taxes and payment

Prices are shown in the currency displayed on the product page or checkout. Applicable taxes may be calculated or handled through Payhip according to the customer’s location and the platform’s tax settings.

Payments are processed through third-party payment providers, including Stripe. EMDA HealthTech does not receive or store complete payment-card details.

Digital delivery

Products are delivered electronically through Payhip, normally through an on-screen download link and/or an email sent to the address provided at checkout.

You are responsible for:

• Providing a correct and accessible email address.

• Downloading and securely storing the purchased files.

• Using a compatible device and appropriate software.

• Keeping reasonable backup copies for your permitted use.

If you do not receive access following successful payment, contact emda.educate@gmail.com with your order details. Do not provide complete payment-card details or unnecessary medical information.

Licence and permitted use

Unless a product page or separate licence expressly states otherwise, each purchase grants the purchaser a limited, non-exclusive, non-transferable and revocable licence to use the product for personal, non-commercial purposes.

You may:

• Download and store the product on your own devices.

• Use and complete the product for its stated personal purpose.

• Print reasonable copies for your own use where the product is printable.

• Share information entered into a product with relevant professionals where necessary for its intended purpose.

You may not:

• Share the original or blank product file with another person.

• Resell, sublicense, distribute, publish or upload the product.

• Place it in a shared drive, public website, group, marketplace or file-sharing service.

• Remove or obscure copyright, branding or ownership notices.

• Copy, adapt or use the product to create a competing or commercial product.

• Use it for institutional, organisational, hospital, clinic, training or business-wide distribution without written permission or an appropriate licence.

Professional, institutional, organisational and multi-user use requires a separate licence unless the product page expressly states otherwise.

Intellectual property

All intellectual-property rights in EMDA HealthTech products, store content, branding, graphics, layouts and original written materials belong to EMDA PLUS Ltd, trading as EMDA HealthTech, or to the relevant licensors.

Purchasing a product does not transfer ownership of its intellectual property. Only the limited right of use described in these Terms or an applicable separate licence is granted.

Cancellation and immediate digital delivery

Digital downloads are generally supplied immediately after payment.

Under UK consumer law, consumers normally have a 14-day cancellation period for digital content supplied at a distance. However, that right is lost once supply begins where the consumer has expressly consented to immediate supply and acknowledged that the cancellation right will be lost.

Where checkout asks you to request immediate access and acknowledge loss of the cancellation right, selecting that option allows delivery to begin immediately.

If the legally required consent and acknowledgement have not been obtained, your statutory cancellation rights remain unaffected.

This section does not affect your rights where digital content is faulty, not as described or otherwise fails to conform to the contract.

Faulty or inaccessible products

We aim to supply digital content that is of satisfactory quality, fit for its stated purpose and as described.

If a purchased file is corrupted, materially defective, inaccessible or not as described, contact emda.educate@gmail.com with your order information and a description of the problem.

Where required by law, we will provide an appropriate remedy, which may include repair, replacement, price reduction or refund. We may first request reasonable information or troubleshooting steps to identify and resolve the problem.

Differences caused solely by a customer’s device, operating system, browser, software, screen, printer or settings do not necessarily mean that the product is defective, provided the relevant compatibility information was disclosed accurately.

Customer responsibilities

You are responsible for determining whether a product is appropriate for your intended use, taking professional advice where appropriate.

You must not:

• Use a product for an unlawful purpose.

• Treat general information as personalised professional or medical advice.

• Enter or disclose another person’s information without appropriate authority.

• Send unnecessary sensitive personal, medical or financial information to EMDA HealthTech.

• Use a product in a way that infringes another person’s rights.

Product availability and updates

We may update, improve, correct, withdraw or replace products and store content.

A purchase includes the version supplied at the time of purchase unless the product page expressly includes future updates. We do not guarantee that every product will remain available indefinitely.

Withdrawal or later modification of a product does not affect statutory rights relating to an existing purchase.

Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability arising under consumer law that cannot be excluded.

Subject to the paragraph above, EMDA HealthTech is not responsible for losses caused by:

• Using a product contrary to its description, intended purpose or these Terms.

• Treating general information as personalised professional advice.

• Inaccurate or incomplete information entered by a user.

• Incompatible or outdated third-party devices or software where relevant requirements were disclosed.

• Unauthorised alteration, copying or distribution of a product.

• Events outside our reasonable control.

Where you purchase as a consumer, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for business losses arising from a personal consumer purchase.

Privacy

We process personal information as described in our Privacy Policy. Customers should not send unnecessary sensitive medical, financial or personal information when contacting us.

Third-party services and links

Our store uses third-party services, including Payhip for store hosting and digital delivery and Stripe for payment processing. Those providers operate under their own terms and privacy notices.

External links may be provided for convenience or information. We are not responsible for third-party content or services, except where applicable law provides otherwise.

Please provide your name, order number, product name and a clear description of the issue. Do not provide complete card details or unnecessary medical information.

We will aim to respond within a reasonable period.

Changes to these Terms

We may update these Terms to reflect changes in our products, business operations, platform arrangements or legal obligations.

The Terms applying to a purchase will normally be those presented when the order was placed. Updated Terms will be published on this page with a revised effective date.

General provisions

If any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we delay enforcing a provision, this does not waive our right to enforce it later.

No person other than the purchaser and EMDA PLUS Ltd has the right to enforce these Terms, except where applicable law provides otherwise.

Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

Consumers resident elsewhere retain any mandatory protections provided by the laws of their country of residence and may bring proceedings in any court available to them under applicable law.
