Terms and Conditions

These Terms and Conditions govern access to the HexaDigital website and the purchase, download and use of digital products made available through HexaDigital.

Please read these Terms carefully before placing an order. By purchasing a product, you confirm that you have read and accepted these Terms, together with the applicable Privacy Policy, Refund Policy and product licence.

The identity and fiscal information shown on the website, checkout and purchase confirmation must correspond to the person legally acting as the seller.

Creator partnerships, revenue-sharing arrangements and product-development collaborations are governed by separate written agreements and are not covered by these customer Terms.


Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to make a purchase.

If you are under 18, a parent or legal guardian must complete the purchase and accept these Terms on your behalf.

By placing an order, you confirm that the information you provide is accurate, complete and current.


Digital products

HexaDigital sells digital products that may include guides, planners, templates, toolkits, worksheets, digital documents and other downloadable materials.

The product page describes the main characteristics of each product, including its content, file format, language, intended audience and any relevant technical requirements or limitations.

Customers should review this information before purchasing. Compatibility with a particular device, application or operating system is guaranteed only where expressly stated on the relevant product page.

Digital products do not include physical goods or physical delivery unless expressly indicated.


Orders and contract formation

An order is placed through the checkout system provided by Payhip or another checkout provider identified on the website.

Before completing the purchase, you are responsible for checking:

  • The selected product
  • The product description and format
  • The total price and currency
  • Any applicable taxes
  • The email address used for delivery
  • Any technical or compatibility requirements
  • The applicable licence and usage restrictions

Submitting an order constitutes an offer to purchase the selected product.

A binding contract is formed when payment has been successfully authorised and an order confirmation has been issued.

HexaDigital may refuse or cancel an order where reasonably necessary because of a payment failure, pricing or technical error, suspected fraud, unlawful activity or violation of these Terms. If payment has already been received for a cancelled order, the corresponding amount will be refunded.


Prices and payments

Prices are displayed on the relevant product page and confirmed during checkout.

The final amount payable, including any applicable taxes or additional charges, will be shown before the order is submitted.

Payments may be processed through third-party providers such as Stripe or PayPal. HexaDigital does not directly receive or store complete payment-card information.

Payment providers may apply their own terms and privacy policies to the services they provide.


Digital delivery

Digital products are normally made available after successful payment through a download page, customer account or email sent to the address provided during checkout.

You are responsible for providing a valid email address and checking your inbox, spam folder and any Payhip account associated with the purchase.

If you do not receive or cannot access the product, contact support@hexadigital.store and include sufficient information to identify the order.

Temporary delays caused by payment verification, technical maintenance, security checks or circumstances outside HexaDigital’s reasonable control do not automatically constitute a failure to deliver. HexaDigital will take reasonable steps to restore access or provide an alternative delivery method.


Accounts and access

Some purchases or downloads may require a Payhip customer account or access through another third-party platform.

You are responsible for maintaining the confidentiality of your login credentials and for activity performed through your account.

You must notify HexaDigital or the relevant platform promptly if you believe that your account or download access has been compromised.

Access credentials and private download links must not be shared with third parties unless the product licence expressly permits it.


Product licences

Purchasing a digital product does not transfer ownership of the product or its intellectual-property rights.

Unless a different licence is clearly stated on the product page or included with the downloaded files, HexaDigital grants the purchaser a limited, personal, non-exclusive, non-transferable and revocable licence to download and use the product for personal, non-commercial purposes.

Under the default licence, you may:

  • Download and store the product on your personal devices
  • Create a reasonable personal backup
  • Print the product for your own use where the format permits it
  • Use the product for the purpose described on its product page

Unless expressly authorised by a separate licence, you may not:

  • Resell, sublicense or commercially distribute the product
  • Share the files, download links or account access with another person
  • Upload the product to a public or shared platform
  • Copy or reproduce the product for distribution
  • Present the product as your own work
  • Remove copyright, attribution or ownership notices
  • Use the product to create a competing product for resale
  • Use the product for unlawful, misleading or harmful purposes

Where a product includes a commercial, extended or custom licence, that specific licence takes precedence over the default licence described above.


Intellectual property

Digital products, website content, text, graphics, branding, layouts, downloads and other materials made available through HexaDigital may be owned by HexaDigital, its operator, a collaborating creator or another identified rights holder.

All rights not expressly granted to the customer remain reserved.

The presence of a creator’s name, brand or contribution does not authorise the customer to use that creator’s identity, image, trademarks or content outside the permissions expressly granted with the product.

Suspected unauthorised distribution or infringement may result in suspension of access and appropriate legal action.


Product information and expected results

HexaDigital aims to provide accurate product descriptions and representative previews.

Minor differences in colours, layout or display may occur depending on the device, software or screen used. These differences do not constitute a defect where the product otherwise corresponds to its description.

Unless expressly stated, digital products are provided for general informational, educational or organisational purposes. They do not constitute legal, tax, financial, medical or other regulated professional advice.

Individual results depend on the customer’s circumstances and use of the product. HexaDigital does not guarantee a specific commercial, financial, educational, fitness or personal outcome.

Nothing in this section limits the customer’s mandatory rights where a product is defective, unavailable or does not conform to its description.


Updates and availability

A purchase includes only the product, content, version and updates expressly described on the product page at the time of purchase.

Future updates, additional editions, new modules or related products are not included unless expressly stated.

HexaDigital may correct errors, update download files or make reasonable changes needed to maintain security, compatibility or legal compliance, provided that such changes do not unlawfully reduce the product’s essential features.


Right of withdrawal for digital content

Consumers in the European Union or European Economic Area normally have a 14-day right of withdrawal for distance contracts.

For digital content supplied without a physical medium, this right may be lost once delivery or downloading begins only when the consumer has:

  • Given prior express consent for delivery to begin during the withdrawal period
  • Acknowledged that starting delivery causes the loss of the right of withdrawal
  • Received confirmation of that consent and acknowledgement as required by law

If these requirements have not been satisfied, the customer retains any withdrawal rights provided by applicable law.

To exercise an available right of withdrawal, contact support@hexadigital.store with the order details and a clear statement requesting withdrawal.

Defective or non-conforming products

The loss of the right of withdrawal does not remove the customer’s statutory rights when digital content is defective, inaccessible or does not conform to the description or agreed requirements.

If a product is defective or cannot be accessed, contact support@hexadigital.store and provide:

  • The order number or purchasing email address
  • A description of the problem
  • Relevant screenshots or error messages, where available
  • Information about the device or software being used, where relevant

Depending on the circumstances and applicable law, HexaDigital may provide a corrected file, replacement download, restored access, price reduction, contract termination or refund.

Mandatory consumer protections and legal conformity guarantees cannot be excluded or restricted by these Terms.


Refunds

Refund requests are handled in accordance with the Refund Policy and applicable consumer law.

A refund is not automatically due solely because a customer changed their mind after validly consenting to immediate delivery and acknowledging the loss of the right of withdrawal.

This does not affect refunds or other remedies required by law for defective, unavailable, incorrectly described or non-conforming digital content.

Any voluntary refund offered by HexaDigital does not waive the right to apply these Terms to future purchases.


Customer support

Support requests may be submitted to support@hexadigital.store.

Customers should provide sufficient order and technical information to allow the request to be investigated.

Response times may vary depending on the nature and complexity of the request. Any specific support period or response time stated on a product page forms part of the product description.


Acceptable use

You must not use the website, store or digital products to:

  • Violate applicable law or the rights of another person
  • Distribute malware or harmful code
  • Attempt to gain unauthorised access to accounts or systems
  • Interfere with the security or operation of the website
  • Commit fraud or misuse payment services
  • Infringe intellectual-property or privacy rights
  • Circumvent access controls or licence restrictions

HexaDigital may suspend access where reasonably necessary to investigate or prevent misuse, fraud, security incidents or material violations of these Terms.

Suspension will not affect mandatory consumer rights relating to a valid purchase.


Third-party platforms and links

The website and purchasing process may rely on third-party services, including Payhip, Stripe, PayPal, Netlify and Google.

These services are operated independently and may be subject to their own terms, privacy policies and technical requirements.

HexaDigital is not responsible for third-party content or services outside its reasonable control. However, using a third-party provider does not remove HexaDigital’s obligations as the seller where applicable.


Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or violations of mandatory consumer rights.

Subject to those mandatory protections, HexaDigital is responsible for losses that are a foreseeable consequence of its breach of these Terms.

HexaDigital is not responsible for losses caused solely by:

  • Incorrect information supplied by the customer
  • Failure to meet clearly stated compatibility requirements
  • Unauthorised sharing or misuse of the product
  • Third-party systems outside HexaDigital’s reasonable control
  • Events that HexaDigital could not reasonably prevent or overcome

If you purchase a product for business or professional purposes, HexaDigital will not be liable for indirect losses, loss of profit, loss of revenue, loss of business opportunities or loss of data except where such limitation is prohibited by law.


Events outside reasonable control

HexaDigital is not responsible for delays or failures caused by events outside its reasonable control, including widespread network failures, payment-provider outages, hosting interruptions, cyberattacks, natural disasters or government actions.

HexaDigital will take reasonable steps to limit the effects of such events and restore the affected service.


Privacy

Personal data is processed in accordance with the HexaDigital Privacy Policy and applicable data-protection law.

The Privacy Policy explains what information is collected, why it is used, how long it is retained and how users can exercise their rights.


Changes to these Terms

HexaDigital may update these Terms to reflect changes in its services, products, providers or legal obligations.

The version applying to a purchase is normally the version made available when the order was placed. Material changes will not retroactively remove rights already acquired through a completed purchase.

The latest version and its effective date will be published on this page.


Governing law and disputes

These Terms are governed by Italian law.

If you are a consumer residing in another country, you retain any mandatory protections granted by the law of your country of residence that cannot be excluded by contract.

Before starting formal proceedings, customers are encouraged to contact support@hexadigital.store so that HexaDigital can attempt to resolve the matter directly.

Any dispute will be submitted to the courts determined by applicable law. Where mandatory consumer law provides that the courts of the consumer’s place of residence have jurisdiction, that protection remains unaffected.


Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful and enforceable.
