Refund & Cancellation Policy
Effective September 19, 2026
This policy covers digital products, personalized plans, consulting, safety-readiness reviews and training sold by James Hildebrandt, sole proprietor doing business as Hildebrandt Safety & Security Consulting (H.S.S.). A separately signed engagement agreement controls over conflicting website terms. This policy applies to purchases for which it is presented and accepted; it does not retroactively change prior purchases.
CONSULTING, PERSONALIZED PLANS AND TRAINING
You may request cancellation by emailing hsssafetyconsulting@gmail.com. Please include your purchase email, order reference and the service. We will confirm the status of work and explain any partial bill.
Before work begins: prepaid service fees are refundable, less only nonrecoverable third-party costs specifically disclosed and authorized in advance.
After work begins: you pay for work actually performed and preauthorized, nonrecoverable expenses, up to the agreed fee. We refund the remaining unearned prepayment. We provide an itemized explanation of completed work and costs. For fixed-price work without priced milestones, the earned amount must reasonably reflect the proportion completed. We do not charge for unperformed work merely because you cancel.
Downloading an intake form or instruction PDF does not mean that consulting has been completed. Preparation, review, research, customization, meetings and training actually performed may be earned work even if the final deliverable has not yet been sent.
Completed services are generally not refundable solely for a change of mind. We will still review missing promised deliverables, material errors, nonperformance and remedies required by law, and determine an appropriate correction, partial refund or refund.
Rescheduling depends on mutual availability. This policy imposes no automatic flat cancellation or no-show penalty. Any additional fee for a reserved appointment must be separately disclosed and agreed before booking. If H.S.S. cancels or cannot complete the service, unearned service fees are refunded.
ACTUAL THIRD-PARTY FEES AND COMMITTED COSTS
For a customer-requested cancellation or discretionary refund not caused by H.S.S. error, breach or failure to deliver, H.S.S. may deduct or bill reasonable, documented third-party costs directly attributable to that order and actually incurred and not recoverable. Examples may include retained payment-processing or platform fees, currency-conversion or refund charges, and preapproved nonrefundable travel, venue, materials or subcontractor commitments. A cost qualifies only if its type and amount, or an understandable calculation method, were clearly disclosed and agreed before purchase or before the expense was authorized, and recovery is permitted by applicable law and payment-provider/card-network rules. Merely listing possible costs here does not authorize an unspecified charge.
We itemize deductions, make reasonable efforts to recover avoidable costs, and credit any amount later recovered. No markup, duplicate recovery, general overhead or undisclosed administrative penalty is added. Completed work and recoverable costs together will not exceed the agreed order or engagement price, including separately approved expenses. Any remaining unearned prepayment is refunded.
We do not deduct these fees when a full refund is legally required, when applicable cancellation or withdrawal rights prohibit deductions, or when the refund results from our error, nonperformance or cancellation. This clause does not authorize a payment-card surcharge, automatic new card charge, or a penalty for a lawful payment dispute. Processing, dispute or collection costs are not automatically payable by a customer merely because a provider charges H.S.S. Mandatory rights and any more protective written promise prevail.
DIGITAL PRODUCTS
Digital purchases are generally final once access is provided. We review duplicate orders or charges, erroneous charges, missing access that cannot reasonably be corrected, corrupt or materially defective files that cannot reasonably be replaced, and products materially different from their description. Depending on the issue, we may correct access, replace a file, or provide an appropriate refund.
A change of mind, not using the product, no longer needing it, or dissatisfaction based solely on personal preference generally does not qualify after access has been provided.
HOW TO REQUEST HELP
Email hsssafetyconsulting@gmail.com with your purchase email, order reference if available, product or service, and a brief explanation. Do not include passwords, full card numbers or confidential incident/personnel records. We may request relevant, limited information to verify the order and assess the issue.
Approved refunds are returned to the original payment method. Processing and bank posting times vary. Any unpaid earned work will be itemized and billed under the agreed payment terms; we will not add an undisclosed penalty.
YOUR RIGHTS
This policy does not restrict non-waivable consumer rights, applicable withdrawal or cancellation rights, legally required refunds, or lawful payment disputes. Where the law requires separate consent to immediate digital delivery or early service performance, this policy does not replace that consent.
