Welcome to Mushin Journal ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our digital products sold through our storefront, and apply to all purchases made through our store powered by Payhip.

By purchasing or accessing any of our products, you confirm that you have read, understood, and agree to be bound by these Terms. Please read them carefully before completing any purchase.

1. Digital Products

All products sold by Mushin Journal are digital in nature and delivered electronically. No physical products will be shipped. Our digital product catalogue includes, but is not limited to:

• E-books and digital publications
• Downloadable templates and worksheets
• Digital guides and instructional content
• Video content and multimedia files
• Other downloadable digital content

2. Delivery of Products

2a. Immediate Delivery via Payhip

Upon successful payment, most products are delivered immediately through Payhip's platform. You will receive instant access to your download on the checkout confirmation page, as well as a delivery confirmation sent to the email address used at checkout.

2b. Products Delivered via Google Drive

Certain products — particularly those containing video content or large files — may be delivered as a PDF containing a Google Drive access link. In these cases:

• You must have a Google account (Gmail) to access the content.
• The Google Drive link will be included in your delivery email and/or the downloadable PDF provided by Payhip.
• It is your responsibility to ensure you have a valid Gmail account before purchasing products of this type. Product listings will indicate where Google Drive delivery applies.

2c. Email Delivery Stamp & Proof of Purchase

All digital files delivered through Payhip are automatically stamped with the buyer's email address at the time of purchase. This stamp serves as verifiable proof that the file was purchased by and delivered to that specific email address. This stamping mechanism is used to protect our intellectual property and to verify authenticity of purchased files.

If you do not receive your download or experience a technical issue with delivery, please contact us at mushinjournal@gmail.com before initiating any dispute or chargeback.

3. License & Usage Rights

Unless otherwise explicitly stated in the product listing, all digital products sold by Mushin Journal are licensed for personal, non-commercial use only. By purchasing a product, you are granted a single-user, non-transferable license to use the content for your own personal purposes.

You are NOT permitted to:

• Reproduce, copy, or duplicate any product in whole or in part
• Distribute, share, or transmit any product to third parties
• Resell, sublicense, or otherwise commercialize any product
• Modify, adapt, translate, or create derivative works from any product
• Publish or upload any product to any website, platform, file-sharing service, or piracy site
• Claim authorship or ownership of any product or the Mushin Journal brand

All intellectual property rights remain the sole property of Mushin Journal. Purchase of a product grants you a usage license only — not ownership of the content.

4. Payment & Order Processing

All payments are securely processed through Payhip's integrated payment partners. By completing a purchase, you authorize the applicable payment amount to be charged to your selected payment method. You are responsible for ensuring that all payment information provided is accurate and up to date.

5. Refund Policy & No-Chargeback Agreement

5a. All Sales Are Final

Due to the immediate and irrevocable nature of digital product delivery, all sales are final. We do not offer refunds, returns, exchanges, or cancellations under any circumstances once a purchase has been completed and the product has been delivered.

We strongly encourage you to review all product descriptions, previews, and these Terms in full before making a purchase. If you have any questions about a product prior to purchasing, please contact us at mushinjournal@gmail.com.

5b. Technical Support

If you experience a technical issue — such as not receiving your download, a broken link, or a file access problem — please contact us at mushinjournal@gmail.com. We are committed to resolving legitimate technical issues promptly and in good faith.

Technical issues do not constitute grounds for a refund. We will work to ensure you receive access to what you purchased.

5c. Chargeback Waiver

By completing a purchase from Mushin Journal, you expressly agree and acknowledge the following:

• You understand that all products are delivered digitally and immediately upon purchase.
• You understand that Payhip stamps all delivered files with your purchase email as verifiable proof of delivery.
• You waive any right to initiate a chargeback, payment reversal, or dispute through your financial institution, credit card provider, or any third-party payment processor in connection with any purchase made from Mushin Journal.
• You agree that any disputes regarding a purchase must be resolved directly and exclusively with Mushin Journal by contacting mushinjournal@gmail.com.

Initiating a chargeback in violation of this agreement constitutes a material breach of these Terms and may result in:

• Immediate revocation of your license to access and use the purchased product(s)
• Permanent denial of future access to Mushin Journal products and services
• Reporting of the dispute and associated purchase records (including the Payhip email delivery stamp) to the relevant payment processor as evidence of fraudulent dispute
• Civil legal action to recover the disputed amount, associated fees, and damages

We reserve the right to submit proof of delivery — including Payhip's email delivery stamp — as evidence in any chargeback dispute or legal proceeding.

6. Intellectual Property

All content sold, shared, or otherwise distributed through Mushin Journal is protected under applicable copyright and intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell, exploit, or otherwise infringe upon any portion of our content without explicit prior written permission from Mushin Journal.

Unauthorized use of our intellectual property may result in civil or criminal penalties under applicable law.

7. Prohibited Conduct

You agree not to use our products, website, or services for any purpose that is unlawful or prohibited by these Terms. Prohibited conduct includes, but is not limited to:

• Using our products in violation of any applicable local, provincial, national, or international law
• Infringing upon the intellectual property rights of Mushin Journal or any third party
• Misrepresenting ownership or authorship of any of our products
• Uploading, distributing, or sharing our products without authorization
• Attempting to circumvent any digital rights management or access control measures

Violations will result in immediate license revocation and may result in legal action.

8. Disclaimer of Warranties

Our digital products are provided "as is" and "as available." Mushin Journal makes no warranties, express or implied, regarding the completeness, accuracy, reliability, suitability, or availability of any product. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability or fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Mushin Journal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of our products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for the applicable product.

10. Modifications to Products and Terms

We reserve the right to modify, update, suspend, or discontinue any product, service, or aspect of our storefront at any time without prior notice. We also reserve the right to update these Terms at any time. Continued use of our products or services following any changes constitutes your acceptance of the updated Terms. The "Last Updated" date at the top of this document reflects the most recent revision.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Canada, without regard to any conflict of law principles. Any disputes arising out of or relating to these Terms or your use of our products shall be subject to the exclusive jurisdiction of the courts of Canada.
