Terms of Service for One Thistle

1. AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and One Thistle (“we,” “us,” or “our”), concerning your access to and use of the onethistle.com website, our Etsy shop, as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site” and our “Services”).
By purchasing or using any of our digital products (the "Products"), you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using our Products and Services and you must discontinue use immediately.
2. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site and our Products are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only.
3. LICENSE TO USE OUR DIGITAL PRODUCTS
When you purchase a digital template from One Thistle, you are purchasing a limited, non-exclusive, non-transferable license to use the template for specific purposes.
a) Permitted Use:
You are granted a license to use the template for your own personal or internal business use only. "Internal business use" is defined as creating finished, branded materials (e.g., product labels, invoices, social media posts) for your own business. You may edit and modify the templates to fit your branding.
b) Prohibited Use:
The license expressly prohibits the following actions:
You may not resell, redistribute, or share the template in its original, editable format, in whole or in part, for any reason.
You may not share the access link to the template editor (e.g., Corjl, Templett, Canva) with any third party. The link is for your use only.
You may not use the templates to create digital products for sale (e.g., you cannot use our label template to create a new label template to sell).
You may not use the templates to create finished products for clients or otherwise use them as part of a design service you offer.
You may not extract and use individual graphics or elements from the template for other projects.
You may not claim the design as your own. One Thistle retains all copyrights to the design of the templates.
Violation of these terms will be considered a breach of copyright and will result in the immediate revocation of your license and may result in legal action.
4. PURCHASES AND PAYMENT
We accept payments through Stripe and PayPal. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.
5. REFUND POLICY
Due to the digital and instant nature of our products, all sales are final and we are unable to offer refunds, returns, or exchanges for any reason.
We provide detailed product descriptions and encourage you to use any available "try before you buy" demo links to ensure a product is the right fit for your needs before purchasing. Please review the product description carefully before making a purchase.
6. PROHIBITED ACTIVITIES
You may not access or use the Site or our Products for any purpose other than that for which we make them available. The Site and Products may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
7. TERM AND TERMINATION
These Terms of Service shall remain in full force and effect while you use the Site or our Products. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF SERVICE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE AND OUR PRODUCTS (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF SERVICE OR OF ANY APPLICABLE LAW OR REGULATION.
8. GOVERNING LAW
These Terms of Service and your use of the Site and our Products are governed by and construed in accordance with the laws of California, USA applicable to agreements made and to be entirely performed within California, USA, without regard to its conflict of law principles.
9. DISCLAIMER
THE SITE AND OUR PRODUCTS ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. LIMITATION OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
