1. General Information

These Terms of Service govern all orders placed with Pencil Echoes.

By placing an order, you confirm that you have read and agreed to these terms.

2. Nature of the Service

Pencil Echoes provides:

Custom, handmade portrait drawings created from client-provided photos

Each artwork is:

• Personalized
• Made to order
• Unique and non-resellable

3. Orders & Payment

• Full payment (100% upfront) is required before work begins
• Payment confirms your order and secures your place in the queue
• Once payment is made, the order enters production

4. Consumer Rights (EU Notice)

Under EU law, consumers generally have a 14-day right of withdrawal.

However:

❗ This right does not apply to custom-made or personalized goods

(according to Directive 2011/83/EU)

By placing an order, you acknowledge that:

• The product is custom-made
• Production may begin immediately
• You waive the right of withdrawal once work has started

5. Order Process

The process follows:

1. Order is placed and paid
2. Client submits photo(s)
3. Drawing process begins
4. Final artwork is completed and delivered

6. Revisions Policy

• No revisions are included during or after the drawing process
• The final artwork reflects the artist’s style and interpretation

By ordering, you accept the artistic approach of Pencil Echoes.

7. Refund Policy

Due to the custom nature of the work:

• Full refunds are not available once work has started

However, as a goodwill policy:

Clients may request up to 60% refund if dissatisfied with the final result

Conditions:

• Request must be made after completion
• Refund applies only to dissatisfaction (not change of mind)
• Remaining 40% covers time, labor, and materials

8. Delivery Time

Estimated completion times:

• A4 → ~2 days
• A3 → ~3 days
• B2 → ~5 days
• B0 → ~10 days

⚠️ These are estimates and may vary depending on workload.

9. Express Orders

• A4 / A3 → +50 RON
• B2 / B0 → +100 RON

Express service prioritizes your order but does not guarantee exact deadlines in exceptional situations.

10. Client Responsibilities

The client agrees to:

• Provide clear and usable photos
• Ensure they have rights to use submitted images
• Provide accurate contact information

11. Intellectual Property

• The artist retains copyright of all created artwork
• The client receives the physical artwork

Pencil Echoes may use completed works for:

• Portfolio
• Website
• Social media

Unless the client explicitly requests confidentiality.

12. Limitation of Liability

Pencil Echoes is not liable for:

• Minor differences between photo and artistic interpretation
• Delays caused by external factors (e.g., delivery services)
• Issues arising from poor-quality photos

14. Governing Law

These terms are governed by the laws of:

Romania / European Union

Any disputes will be handled under applicable Romanian law.

The latest version will always be available on the website.

16. Acceptance of Terms

By placing an order, you confirm that:

✔ You accept the no-revision policy

✔ You agree to the refund structure

✔ You waive withdrawal rights after production begins

1. International Shipping & Delivery Policy

Pencil Echoes ships artworks from Romania using national and international postal services.

1. Shipping Methods

All orders are shipped via Romanian Post (Poșta Română) or equivalent international carriers, depending on destination and availability.

Tracking is provided where applicable.

2. EU Delivery

Orders within the European Union are shipped without customs procedures and typically arrive within:

• 5–12 business days after dispatch

3. Non-EU Delivery (Including USA)

For shipments outside the European Union:

• Customs declarations (CN22 / CN23) are completed in accordance with international shipping regulations
• Delivery times may vary depending on customs processing in the destination country

Estimated delivery:

• 7–20 business days (standard)
• Delays may occur due to customs or local postal services

4. Temporary Shipping Restrictions (USA)

Due to postal regulations:

• As of August 2025, shipment of physical goods (parcels) to the United States may be temporarily suspended via Romanian Post
• Document-type shipments may still be available

Customers are advised that:

👉 Shipping availability to the USA may change

👉 The seller is not responsible for restrictions imposed by postal authorities

If shipping is unavailable, alternative solutions or delays will be communicated.

5. Packaging & Protection

All artworks are:

• Carefully packaged using protective materials (rigid envelopes or boxes)
• Secured to prevent bending or damage during transport

6. Delivery Responsibility

Once the order has been shipped:

• The responsibility for delivery lies with the postal carrier
• Pencil Echoes is not liable for delays caused by:
• customs processing
• postal service disruptions
• incorrect address provided by the customer

7. Tracking

Customers receive a tracking number when available.

Tracking may:

• Work fully within Romania
• Continue via local carrier systems (e.g. USPS for USA)

8. Shipping Costs

Shipping costs are:

• Calculated separately from product price
• Based on weight, size, and destination.

2.AFFILIATE PROGRAM TERMS

The Pencil Echoes Affiliate Program allows individuals (“Affiliates”) to earn commissions by promoting custom portrait services.

By joining the program, affiliates agree to comply with all terms outlined below.

2. Commission Structures

Pencil Echoes offers two commission methods:

🔗 A. Standard Affiliate Link (Tracking Link)

• Commission: 30% per sale
• Sales are tracked automatically through a unique affiliate link
• Earnings are visible in the affiliate dashboard

🎟️ B. Coupon Code System

Affiliates may receive a custom discount code.

• Customer receives: 10% discount
• Affiliate earns: 20% commission per sale

⚠️ Important:

• Sales made using coupon codes are NOT automatically tracked in the affiliate dashboard
• These sales will be recorded manually

3. Coupon Code Reporting & Payment

For coupon-based sales:

• Pencil Echoes will generate a monthly report of all sales made using the affiliate’s code
• The report will include:
• Number of orders
• Total commission earned
• Payments will be issued based on this report

4. Payment Terms

• Payments are made monthly
• Minimum payout threshold: €50
• Payment method: PayPal

Pencil Echoes reserves the right to delay payments in case of suspected fraud or violations.

5. Prohibited Activities

Affiliates are strictly prohibited from:

• Self-referrals (using own link or code)
• Creating fake orders
• Using misleading or false claims
• Spamming (unsolicited messages, comments, etc.)
• Impersonating Pencil Echoes

Violation may result in:

❌ Commission cancellation

❌ Removal from the affiliate program

6. Promotion Guidelines

Affiliates must:

• Represent the brand honestly
• Clearly communicate that portraits are custom and hand-drawn
• Avoid unrealistic promises (e.g., guaranteed likeness perfection)

7. Tracking Limitations

• Only purchases made through valid affiliate links or coupon codes will be considered
• Pencil Echoes is not responsible for:
• Lost tracking due to user actions
• Incorrect or missing links
• Expired or misused coupon codes

8. Coupon Code Limitations

• Coupon codes may not be:
• Shared on coupon/deal websites without permission
• Used for paid ads without approval
• Pencil Echoes reserves the right to disable any coupon code at any time

9. Right to Modify Program

Pencil Echoes reserves the right to:

• Change commission rates
• Modify or terminate the affiliate program
• Update these terms at any time

Affiliates will be notified of significant changes.

10. Termination

Affiliate accounts may be suspended or terminated if:

• Terms are violated
• Fraudulent activity is suspected
• Brand reputation is at risk

11. Acceptance

By participating in the affiliate program, the affiliate confirms that they:

✔ Understand both commission systems

✔ Accept manual reporting for coupon sales

✔ Agree to all rules and conditions
