5. Legal Basis for Processing (EU and UK Subscribers)
If you are located in the European Union or United Kingdom, we rely on the following legal bases to process your personal data under the GDPR / UK GDPR:
Consent (Article 6(1)(a) GDPR)
When you submit your email address via a sign-up form, you are giving us your explicit consent to receive the resource requested and our associated email communications. You may withdraw consent at any time by clicking "Unsubscribe" in any email, or by emailing elle@purevienutrition.com.
Contract (Article 6(1)(b) GDPR)
When you purchase a product, processing your information is necessary to fulfil the contract between us (i.e. to deliver your purchase).
Legitimate interests (Article 6(1)(f) GDPR)
For analytics, fraud prevention, and improving our services — where this does not override your rights and freedoms.
Legal obligation (Article 6(1)(c) GDPR)
Where processing is required by law (e.g. retaining financial records under tax law).
6. Email Communications and Your Right to Unsubscribe
All marketing and newsletter emails we send comply with the Australian Spam Act 2003, the US CAN-SPAM Act 2003, and the GDPR/UK GDPR requirements for email consent.
6.1 What We Send
• Free resource delivery emails — sent immediately upon sign-up, containing your requested download.
• Welcome sequence emails — a short series of educational emails delivered over the weeks following your sign-up.
• Weekly newsletter — educational content related to pregnancy and maternal nutrition.
• Product announcements — information about new products or services we offer, relevant to the subject you subscribed for.
6.2 How to Unsubscribe
Every email we send includes a clearly visible "Unsubscribe" link in the footer. Clicking this link will remove you from our mailing list immediately. You may also unsubscribe by emailing hello@purevienutrition.com and requesting removal.
Once you unsubscribe, we will cease sending marketing emails within 10 business days (we aim for immediate processing). We may retain your email address on a suppression list to ensure we do not accidentally re-subscribe you.
6.3 Transactional Emails
If you have purchased a product, we may send you transactional emails (purchase confirmations, product delivery) even if you have unsubscribed from marketing communications. These are not marketing emails and are necessary to fulfil your purchase.
7. How We Store and Protect Your Information
7.1 Storage Location
Your email data is stored on MailerLite servers. MailerLite maintains servers in the European Union and complies with EU data protection standards. For subscribers outside the EU, data may be transferred to and processed in countries with equivalent protections.
Purchase data is stored by Payhip in accordance with their privacy policy. Payment data is handled exclusively by Stripe and PayPal.
7.2 Security Measures
We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. These steps include:
• Using trusted, security-certified third-party platforms for email, payments, and product delivery.
• Not storing payment card details on our own systems.
• Using password-protected accounts with two-factor authentication where available.
• Limiting access to personal information to the minimum necessary.
7.3 Data Retention
We retain your personal information for as long as is necessary for the purposes it was collected, or as required by law:
• Email subscriber data: retained while you are subscribed, and for up to 12 months after unsubscription (to manage suppression lists), unless you request deletion.
• Purchase records: retained for 7 years in accordance with Australian Taxation Office requirements.
• Communications (email replies): retained for as long as reasonably necessary to resolve your enquiry.
8. Sharing Your Information
We do not sell, rent, or trade your personal information. We share information only in the following limited circumstances:

If Pure Vie Nutrition is sold, merged, or its assets transferred to another entity, your personal information may be transferred as part of that transaction. We will notify subscribers of any such change and of their rights under the new arrangement.
