The terms governing your use of Pure Vie Nutrition's website, services, digital products, and communications.

IMPORTANT NOTICE
This document has been prepared to meet the requirements of the Australian Privacy Act 1988 (Cth), the EU General Data Protection Regulation (GDPR), the UK GDPR (post-Brexit), and the US CAN-SPAM Act 2003, as applicable to the activities of Pure Vie Nutrition.
Pure Vie collective (Pure Vie Nutrition) is operated as a sole trader business based in Australia (83 430 552 495).
1. Agreement to These Terms
These Terms and Conditions ("Terms") govern your access to and use of the Pure Vie Nutrition website (purevienutrition.com), email communications, digital products, and any coaching or programme services (collectively, the "Services").
By accessing our website, subscribing to our email list, downloading any resource, or purchasing any product, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
Pure Vie Nutrition is operated by Ellen Squires trading as Pure Vie Collective (Pure Vie Nutrition), ABN [83 430 552 495], based in Australia. References to "we", "us", "our" throughout these Terms refer to Pure Vie Nutrition. References to "you" or "your" refer to the person accessing or using our Services.
2. Nature of Our Services — Educational Content Only
IMPORTANT — READ CAREFULLY
Pure Vie Nutrition provides general nutritional education. All content — including but not limited to website content, email newsletters, social media content, digital guides, video content, and coaching conversations — is intended for general informational and educational purposes only.
Nothing published or communicated by Pure Vie Nutrition constitutes, or is intended to constitute, personal medical advice, clinical nutrition advice, dietetic advice, or any other form of regulated health advice.
You should always consult a qualified and registered healthcare provider — including your general practitioner, obstetrician, midwife, or an Accredited Practising Dietitian — before making any changes to your diet, supplement routine, or health management, particularly during pregnancy, the postpartum period, or when trying to conceive.
2.1 Scope of Practice
The operator of Pure Vie Nutrition holds a Diploma of Health Science, a Bachelor of Social Science, and a Master of Teaching. The term "nutritionist" is used in accordance with its unregistered status in Australia. The operator is not a registered dietitian under the Australian Health Practitioner Regulation Agency (AHPRA), and does not practise as one.
Our Services are education-based and are designed to help you understand nutritional concepts, interpret nutritional information, and make more informed decisions in partnership with your healthcare team. Our Services do not replace your healthcare team.
2.2 No Client-Practitioner Relationship
Accessing, subscribing to, or purchasing our Services does not create a client-practitioner relationship between you and Pure Vie Nutrition. The exchange of information through email, digital products, or coaching sessions is educational in nature and does not establish any professional duty of care beyond what is expressly stated in any individual service agreement.
3. Digital Products — Purchase, Delivery, and Use
3.1 Products Available
We currently offer or may offer the following categories of digital product:
• Downloadable PDF guides (e.g. "Eating Through the Worst of It", "The Prenatal Supplement Decoder")
• Digital checklists and reference materials (e.g. "The Label Decoder Checklist")
• Online programmes and courses (e.g. "The Pure Vie Pregnancy Method")
• Free downloadable resources available in exchange for email subscription
3.2 Product Delivery
Digital products are delivered electronically upon purchase. You will receive an email containing a download link or access instructions. It is your responsibility to ensure you provide a valid and accessible email address at the time of purchase.
If you do not receive your product within 24 hours of purchase, please check your spam or junk folder before contacting us at elle@purevienutrition.com.
3.3 Licence to Use
Upon purchase, we grant you a non-exclusive, non-transferable, personal licence to access and use the digital product for your own personal, non-commercial purposes. This licence does not permit you to:
• Share, reproduce, distribute, or resell the product or any portion of it.
• Share your login credentials or download link with other people.
• Use the product for commercial purposes or in a commercial setting without our prior written consent.
• Remove, alter, or obscure any copyright notices, disclaimers, or branding within the product.
3.4 Product Disclaimer
All digital products sold by Pure Vie Nutrition are provided for general educational purposes. The information within them is based on publicly available nutritional research and evidence-based guidelines current at the time of publication. However:
• Nutritional science evolves. We make no warranty that information within products will remain current indefinitely.
• Information is generalised and may not apply to your specific health situation, medical history, or pregnancy circumstances.
• Products are not a substitute for personalised advice from a qualified, registered healthcare provider.
• Results from applying the information in our products will vary based on individual circumstances. No specific health or nutrition outcomes are guaranteed.
4. Pricing and Payment
4.1 Prices
All prices are displayed in Australian Dollars (AUD) unless otherwise stated. Pure Vie Nutrition is not currently registered for Australian GST. If you are purchasing from Australia and GST obligations apply to us at the time of your purchase, prices will be updated accordingly.
Prices may change at any time without prior notice. The price displayed at the time of your purchase is the price you will be charged.
4.2 Payment Processing
Payments are processed securely through Payhip, which uses Stripe and PayPal as payment processors. We do not store, access, or process your payment card details directly. All payment transactions are governed by the terms and privacy policies of the applicable payment processor.
4.3 Currency and Taxes
You are responsible for any applicable taxes in your jurisdiction arising from your purchase, including but not limited to VAT (EU/UK) or GST. If taxes are applicable and we are required to collect them, they will be displayed clearly at checkout.
5. Refund Policy
Summary of refund position:
Due to the digital nature of our products, we generally do not offer refunds once a product has been accessed or downloaded. However, Australian Consumer Law (ACL) provides non-excludable guarantees that apply regardless of this policy. We honour all rights granted to consumers under applicable law.
5.1 General Position on Refunds
Because our products are digital and are delivered immediately upon purchase, we are unable to "take back" a digital product once it has been downloaded or accessed. For this reason, we do not offer change-of-mind refunds.
5.2 Refunds You Are Entitled To Under Australian Consumer Law
Under the Australian Consumer Law (Competition and Consumer Act 2010), you may be entitled to a refund if:
• The product has a major fault, defect, or failure — for example, a file that cannot be opened, is significantly corrupted, or does not match its description in a material way.
• The product is not fit for the purpose it was described as serving.
• The product is not as described.
These rights cannot be excluded, restricted, or modified by this policy or any other agreement.
5.3 Refunds for EU and UK Consumers (Consumer Rights Regulations)
If you are a consumer located in the European Union or the United Kingdom, you may have a statutory right of withdrawal (cooling-off period) for digital content purchased online. However, by purchasing our digital products and accessing or downloading them, you expressly consent to immediate delivery and acknowledge that your right of withdrawal is lost upon download or access, as permitted under the Consumer Rights Directive (EU) 2011/83/EU and the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
If you have not accessed or downloaded your purchase, you may exercise your right of withdrawal by contacting us within 14 days of purchase at elle@purevienutrition.com.
5.4 Faulty Products — How to Claim
If you believe you have received a faulty product, or a product that materially differs from its description, please contact us within 30 days of purchase at elle@purevienutrition.com, providing:
• Your full name and the email address used to purchase.
• Your order reference number (found in your purchase confirmation email).
• A description of the issue.
We will assess your claim and respond within 5 business days. If your claim is upheld, we will provide a replacement, corrected version, or a full refund, at our election, unless you are entitled to a refund as a matter of statutory right.
5.5 Coaching and Programme Services
Refund terms for individual coaching sessions and programme enrolments will be specified in the individual service agreement entered into at the time of enrolment. Where no specific terms are stated, the following apply:
• Individual coaching sessions: cancellations with more than 48 hours' notice will receive a full credit. Cancellations within 48 hours are non-refundable.
• Programme enrolments: no refund after programme access has been granted, except where required by law.
6. Intellectual Property
6.1 Ownership
All content published or made available by Pure Vie Collective (Pure Vie Nutrition) — including but not limited to website content, email content, social media content, video scripts, digital products, guides, checklists, graphics, and branding — is the intellectual property of Pure Vie Collective (Pure Vie Nutrition) and is protected by Australian copyright law and applicable international intellectual property laws.
6.2 Permitted Use
You may:
• Access and read our content for your own personal, non-commercial use.
• Share a link to our content on social media, provided you credit Pure Vie Nutrition.
• Quote brief extracts from our content for educational purposes, provided you attribute Pure Vie Nutrition as the source.
6.3 Prohibited Use
You may not, without our prior written consent:
• Reproduce, copy, or republish substantial portions of our content.
• Use our content in a commercial context.
• Represent our content as your own.
• Create derivative works based on our products or content.
• Use our brand name, logo, or trademarks without authorisation.
6.4 User-Generated Content
If you share feedback, testimonials, or content relating to your experience with Pure Vie Nutrition (for example, in a reply email, social media post, or direct communication), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in our marketing materials, with your prior consent where required by law.
7. Free Resources
Certain resources (such as "The Pregnancy Nutrition Myth-Buster") are made available at no charge in exchange for an email address subscription. By claiming a free resource, you agree to:
• Receive the associated email welcome sequence and ongoing newsletter communications from Pure Vie Nutrition.
• The same terms of use applying to paid digital products in respect of the content of the free resource (see Section 3).
You may unsubscribe from email communications at any time. Unsubscribing does not remove your right to access any free resource you have already downloaded.
8. User Conduct
When accessing or using our Services, you agree not to:
• Use our Services in any way that is unlawful, harmful, or deceptive.
• Impersonate Pure Vie Nutrition or any of its representatives.
• Attempt to gain unauthorised access to any part of our website, systems, or accounts.
• Use automated tools (bots, scrapers) to collect content from our website.
• Transmit any content that is abusive, offensive, defamatory, or infringes any third-party rights.
9. Disclaimer of Warranties
To the maximum extent permitted by law:
• Our Services are provided "as is" and "as available" without warranty of any kind, express or implied.
• We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.
• We do not warrant that the information in our content, products, or communications is complete, accurate, or current at the time you access it, or that it will remain so.
• We make no warranty regarding the suitability of our content for any particular individual's health circumstances.
Nothing in these Terms excludes any guarantee, warranty, condition, or right that cannot be excluded under the Australian Consumer Law or any other applicable statute.
10. Limitation of Liability
To the fullest extent permitted by law, Pure Vie Nutrition and its operator will not be liable for any:
• Loss of income, profit, or opportunity arising from your use of our Services.
• Indirect, consequential, special, or punitive damages.
• Health outcomes, medical decisions, or clinical results arising from the application of any information in our content or products.
• Loss or damage arising from your reliance on any third-party platform linked to or referenced in our content.
Where liability cannot be excluded under the Australian Consumer Law (for example, for a major failure of a consumer guarantee), our liability is limited, at our election, to resupply of the service, or the cost of having the service resupplied.
Nothing in this limitation of liability section excludes or limits any statutory rights you have as a consumer under the Australian Consumer Law, the UK Consumer Rights Act 2015, or applicable EU consumer protection legislation, which cannot be contractually excluded.
11. Third-Party Links and References
Our content may reference or link to third-party websites, research papers, organisations, or resources. These references are provided for informational purposes only and do not constitute endorsement of those parties or their content. We have no control over, and accept no responsibility for, the accuracy or reliability of third-party content.
12. Termination of Access
We reserve the right to terminate or suspend your access to our Services at any time, without notice, if we reasonably believe you have violated these Terms or are using our Services in a way that could cause harm to us or others.
Upon termination, any licence granted to you to use our products will cease immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and intellectual property sections) will continue to apply.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for the resolution of any dispute arising under or in connection with these Terms.
Before initiating any formal dispute, we encourage you to contact us at elle@purevienutrition.com to attempt resolution informally. Most concerns can be resolved promptly through direct communication.
Nothing in this clause affects any statutory rights you may have under Australian Consumer Law, UK consumer protection legislation, or EU consumer protection legislation.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify subscribers by email. Your continued use of our Services after the posting of any changes constitutes acceptance of the revised Terms.
We recommend reviewing these Terms periodically, particularly before making a purchase.
15. Entire Agreement and Severability
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pure Vie Nutrition with respect to your use of our Services and supersede any prior agreements or understandings.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be severed from the remaining Terms, which will continue in full force and effect.
